LIABILITY RELEASE, WAIVER, AND ASSUMPTION OF RISK AGREEMENT

WARNING: THIS IS A LEGALLY BINDING DOCUMENT. BY SIGNING, YOU GIVE UP CERTAIN LEGAL RIGHTS.

I, the undersigned participant, acknowledge that participation in surf lessons, water sports, and related activities (hereafter referred to as “Activities”) involves inherent risks, including but not limited to:

Drowning or near-drowning

Collisions with surfboards, other participants, or objects

Injuries from waves, ocean currents, rocks, or marine life

Physical strain, exhaustion, or other injuries from surfing or related exercises

Property damage or personal loss

I fully understand that these risks may result in serious injury, permanent disability, or death, and I voluntarily assume all such risks, known and unknown.

1. RELEASE OF LIABILITY

I hereby release, waive, discharge, and covenant not to sue any surf school, instructors, staff, volunteers, or affiliates (collectively “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur to me while participating in Activities, whether caused by the negligence of the Released Parties or otherwise.

2. ASSUMPTION OF RISK

I acknowledge that surfing and related Activities are extreme sports and that serious accidents may occur. I voluntarily assume full responsibility for any risks of injury, death, or property damage while participating in Activities.

3. MEDICAL DECLARATION

I certify that I am physically fit, have no medical condition that would prevent participation, and have consulted a physician if necessary. I consent to receive emergency medical treatment if required and agree to be responsible for all medical costs incurred.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of my participation in Activities or my violation of this Agreement.

5. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Activities take place. If any part of this Agreement is held invalid, the remainder shall continue in full force and effect.

6. ACKNOWLEDGEMENT

I acknowledge that I have read this Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I sign this Agreement freely and voluntarily.
