DISCOLATES AND CINCO SOCCER

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO SUE.

This Release applies to everyone who signs up for the collaborative class between Discolates ("Host") and CINCO Soccer, and to the social gathering that follows it (the "Post-Hang").

PARTIES AND ACTIVITY

Participant: the person signing below, or the minor on whose behalf a parent or legal guardian signs.

Activity: the class, including mat Pilates, 5-a-side soccer play, warm-ups, drills, stretching, and any related movement or fitness activity, plus the Post-Hang, including travel between locations at the event, food, beverages, and any other social activity connected to the event.

Date(s) / Location(s): November 15, 2026, 9:30 AM to 12:30 PM, at CNCO Soccer, 5305 E. Henry Ave, Tampa, Florida 33610.

Releasees: Discolates, CINCO Soccer, and each of their respective owners, administrators, directors, agents, officers, members, instructors, coaches, volunteers, and employees; other participants; any sponsors and advertisers; and the owners and lessors of the premises where any part of the Activity takes place.

IN CONSIDERATION of being permitted to participate in any way in the Activity, I, for myself and for my personal representatives, assigns, heirs, and next of kin, agree to the terms below.

1. ACKNOWLEDGMENT AND FITNESS TO PARTICIPATE

I acknowledge, agree, and represent that I understand the nature of the Activity, including Pilates and 5-a-side soccer, and that I am qualified, in good health, and in proper physical condition to participate. I have told the instructor about any injury, pregnancy, or medical condition that could affect my participation, and I understand I may modify or skip any movement at any time. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue participation.

2. ASSUMPTION OF RISK

I FULLY UNDERSTAND THAT:

(a) PILATES, 5-A-SIDE SOCCER, AND RELATED ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS").

(b) THESE RISKS MAY BE CAUSED BY MY OWN ACTIONS OR INACTIONS, THE ACTIONS OR INACTIONS OF OTHERS PARTICIPATING, THE CONDITION OF THE PLAYING SURFACE, FLOOR, EQUIPMENT, OR PREMISES, OR THE NEGLIGENCE OF THE RELEASEES NAMED ABOVE.

(c) THERE MAY BE OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES EITHER NOT KNOWN TO ME OR NOT READILY FORESEEABLE AT THIS TIME.

I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I INCUR AS A RESULT OF MY PARTICIPATION, OR THAT OF A MINOR FOR WHOM I SIGN, IN THE ACTIVITY.

3. POST-HANG, FOOD, AND ALCOHOL

The Post-Hang is a social gathering and is part of the Activity for purposes of this Release. I understand that food and beverages may be served or available, that allergens may be present, and that I am solely responsible for what I eat and drink and for my own transportation afterward. I will not drive if I have consumed alcohol or any other impairing substance. Alcohol is for adults 21 and over only.

4. RELEASE, WAIVER, AND COVENANT NOT TO SUE

I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASEES (INCLUDING CNCO SOCCER) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT, OR ON ACCOUNT OF ANY MINOR FOR WHOM I SIGN, CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS.

5. INDEMNITY

I FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I OR ANYONE ON MY BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LIABILITY, DAMAGES, OR COSTS ANY OF THEM MAY INCUR AS A RESULT OF SUCH CLAIM.

6. MEDICAL TREATMENT

I authorize the Releasees to seek emergency medical care for me, or for the minor for whom I sign, if needed. I am responsible for all resulting medical and transport costs. I have disclosed any condition the Host should know about that could affect safe participation.

7. INSURANCE

The Host maintains commercial general liability insurance covering the Activity, and CNCO Soccer is named as an additional insured. This insurance does not replace my own health coverage, which I understand is my responsibility. Nothing in this Release limits recovery under the Host's insurance policy to the extent the law does not allow the claim to be released.

8. MINOR PARTICIPANTS

If the Participant is under 18, I am the Participant's parent or legal guardian and have authority to sign. I make the acknowledgments, assumptions of risk, release, and indemnity above on behalf of the minor and on my own behalf, to the fullest extent Florida law allows.

9. PHOTO AND VIDEO

I grant the Host and CINCO Soccer permission to photograph and record the Activity and to use my image or the minor's image for promotion, with no payment owed. I may opt out in writing before the event.

10. GOVERNING LAW, VENUE, AND SEVERABILITY

This Release is governed by the laws of the State of Florida. Any dispute will be brought in the state courts located in Hillsborough County, Florida. I intend this to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any portion is held invalid, the balance will continue in full force and effect.

11. ACKNOWLEDGMENT

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE.
