Brighton Tennis Club Participant Consent, Waiver, and Release Agreement

By selecting **"I Agree"** below, I acknowledge that I have read, understood, and voluntarily agree to the following terms and conditions:

## Assumption of Risk

I understand that participating in tennis activities, including lessons, clinics, practices, matches, tournaments, camps, fitness activities, and other related events (collectively, the "Activities"), involves inherent risks. These risks include, but are not limited to, slips, falls, collisions, being struck by tennis balls or racquets, physical exertion, weather conditions, equipment failure, and other known and unknown hazards that may result in personal injury, illness, permanent disability, property damage, or death.

I voluntarily choose to participate in these Activities and knowingly assume all risks associated with my participation.

## Release of Liability

To the fullest extent permitted by applicable law, I release, waive, and forever discharge **Brighton Tennis Club**, its owners, directors, coaches, instructors, employees, volunteers, contractors, agents, and representatives from any and all claims, liabilities, demands, actions, damages, losses, costs, or expenses arising out of or relating to my participation in the Activities, except to the extent caused by gross negligence or willful misconduct where such rights cannot legally be waived.

I understand that participation is entirely voluntary and at my own risk.

## Medical Responsibility

I certify that I am physically able to participate in tennis activities. I understand that I am responsible for determining whether I am medically fit to participate.

In the event of an emergency, I authorize Brighton Tennis Club to seek emergency medical assistance if necessary. I understand that I am solely responsible for any medical expenses incurred.

## Personal Property

I understand that Brighton Tennis Club is not responsible for any lost, stolen, or damaged personal property, including but not limited to racquets, bags, clothing, electronics, jewelry, or other personal belongings.

## Photo and Video Consent

I grant Brighton Tennis Club permission to photograph, record, or film me during club activities.

I authorize Brighton Tennis Club to use my image, likeness, voice, photographs, and video recordings for lawful promotional and marketing purposes, including but not limited to social media, websites, newsletters, advertisements, printed materials, and other promotional content, without compensation or additional approval.

If I do not wish to appear in promotional materials, I understand that it is my responsibility to notify the club in writing before participating.

## Facility Acknowledgment

I understand that Brighton Tennis Club conducts activities at facilities owned and operated by third parties, including schools and other organizations. Brighton Tennis Club rents or is granted permission to use these facilities but does not own, manage, or maintain them.

I acknowledge that Brighton Tennis Club is not responsible for the condition, maintenance, repair, or operation of the facility except as required by applicable law.

## Participant Conduct and Property Damage

I agree to conduct myself in a safe and respectful manner and to follow all instructions provided by club staff.

I accept financial responsibility for any damage to the facility, courts, equipment, or property resulting from my intentional misconduct or negligent or reckless actions. I understand that Brighton Tennis Club is not responsible for damage caused by participants to property owned by the facility or any third party.

## Indemnification

To the extent permitted by law, I agree to indemnify and hold harmless Brighton Tennis Club, its owners, coaches, employees, volunteers, contractors, and representatives from any claims, damages, liabilities, or expenses arising from my actions or my violation of this Agreement.

## Electronic Consent

I understand that selecting **"I Agree"** constitutes my electronic signature and has the same legal effect as signing this Agreement with a handwritten signature.

By selecting **"I Agree,"** I acknowledge that:

* I have read and understand this Agreement in its entirety.
* I have had the opportunity to ask questions before agreeing.
* I voluntarily accept these terms.
* I understand that I am giving up certain legal rights, including the right to bring certain legal claims against Brighton Tennis Club, to the fullest extent permitted by law.
* I agree that my electronic acceptance of this Agreement is legally binding.
