FUELED N' FIT FITCAMP

PARTICIPANT LIABILITY WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK


1. ACKNOWLEDGMENT OF RISKS

I understand that participation in Fueled N' Fit Fitcamp involves physical exercise and outdoor fitness activities that carry inherent risks. These activities may include, but are not limited to, strength training, cardiovascular exercise, running, jumping, lifting weights, resistance training, bodyweight exercises, and the use of fitness equipment.

I understand that potential risks include muscle strains, sprains, falls, joint injuries, overexertion, dehydration, heat-related illness, dizziness, fainting, and other injuries, including serious injury, permanent disability, or death.

I voluntarily choose to participate and knowingly accept the inherent risks associated with these activities.

2. HEALTH AND FITNESS RESPONSIBILITY

I affirm that I am voluntarily participating in Fitcamp and believe I am physically able to participate safely. I understand that it is my responsibility to consult a healthcare professional before beginning an exercise program if I have any concerns about my health or physical condition.

I agree to inform the instructor of any limitations, injuries, or symptoms that may affect my ability to exercise safely. I agree to exercise within my personal limits, follow instructions, take breaks when necessary, stay hydrated, and stop exercising if I experience pain, dizziness, chest discomfort, shortness of breath beyond normal exertion, or other concerning symptoms.

I understand that the instructor does not provide medical advice, diagnosis, or treatment.

3. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS BY SIGNING THIS AGREEMENT.

To the fullest extent permitted by Florida law, I voluntarily assume the risks of participating in Fueled N' Fit Fitcamp and hereby release and discharge Melissa Palmer, Fueled N' Fit Fitcamp, and their respective owners, instructors, assistants, agents, and representatives from claims, demands, causes of action, or liability for personal injury, illness, death, or property damage arising out of or related to my participation in Fitcamp, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, to the extent such a release is permitted by law.

This release applies to activities conducted at Deltona City Hall, 2345 Providence Blvd, Deltona, Florida 32725, and any other location where Fitcamp activities may take place.

Nothing in this agreement is intended to release liability that cannot legally be waived, including liability for gross negligence or intentional misconduct where applicable.

4. EQUIPMENT AND OUTDOOR CONDITIONS

I understand that Fitcamp may take place outdoors and that weather, uneven surfaces, traffic, other individuals, and environmental conditions may create additional risks.

I agree to use all equipment responsibly and only as instructed. I will immediately report damaged equipment, unsafe conditions, or hazards to the instructor.

I understand that I am responsible for wearing appropriate workout clothing and footwear and bringing adequate water for hydration.

5. EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency, I authorize the instructor or designated representative to contact emergency medical services if reasonably necessary. I understand that I am responsible for any medical expenses incurred on my behalf, to the extent permitted by law.

I understand that the instructor is not obligated to provide emergency medical treatment and that emergency assistance may not be immediately available.

6. INDEMNIFICATION

To the extent permitted by Florida law, I agree to be responsible for claims or losses caused by my own negligent or wrongful conduct during participation, including damage or injury I cause to others. This provision is not intended to require me to indemnify any released party for that party's own negligence unless such an obligation is expressly permitted by law.


7. ACKNOWLEDGMENT AND SIGNATURE

I acknowledge that I have carefully read this agreement, understand its contents, and understand that it affects my legal rights. I have had the opportunity to ask questions before signing. I am signing voluntarily and intend for this agreement to apply to my participation in Fueled N' Fit Fitcamp, including future sessions, unless otherwise required by law.

Cancellation policy
