UNIVERSAL PARTICIPANT WAIVER, INFORMED CONSENT, AND RELEASE OF LIABILITY
PCF Wellness Consulting Inc
(including PCF Wellness Consulting Inc dba The Wellness Collective)
This Waiver, Informed Consent, and Release of Liability (“Agreement”) is entered into on this date by the undersigned participant (“Participant”) in connection with participation in any and all fitness, wellness, recreational, movement, or educational activities, events, or services (collectively, the “Activities”) organized or facilitated by PCF Wellness Consulting Inc, including PCF Wellness Consulting Inc dba The Wellness Collective (collectively, the “Released Party”).

1. Voluntary Participation and Medical Clearance
The Participant affirms that their participation in the Activities is voluntary and that they are in good health and physically able to engage in the Activities. The Participant acknowledges the recommendation to consult with a physician before participating in any strenuous physical activity or outdoor group movement.

2. Assumption of Risk
The Participant understands that the Activities may include, but are not limited to: indoor and outdoor exercise classes, cycling, walking or running groups, strength training, yoga, stretching, mindfulness sessions, bodywork, wellness workshops, or fitness assessments. These may take place on public or private property, including but not limited to parks, museums, studios, gyms, or community centers.
Participant acknowledges that participation involves inherent risks, including but not limited to:
Physical exertion, overuse injuries, slips or falls


Environmental risks such as uneven terrain, inclement weather, traffic, and wildlife


Exposure to elevated temperatures during outdoor programming, including the risk of heat-related illnesses such as dehydration, heat exhaustion, or heat stroke, particularly during periods of heat advisory


Transportation to and from event sites


Emotional responses during mindfulness or wellness sessions


The Participant fully assumes all risks—known and unknown—associated with their participation, including those arising from negligence of the Released Party, except to the extent caused by gross negligence or willful misconduct.

3. Waiver and Release of Liability
In consideration of being allowed to participate in the Activities, Participant, on behalf of themselves and their heirs, assigns, personal representatives, executors, and administrators, hereby knowingly and voluntarily waives, releases, and discharges PCF Wellness Consulting Inc (including PCF Wellness Consulting Inc dba The Wellness Collective) and its respective officers, directors, employees, contractors, agents, affiliates, and successors (collectively, the “Released Party”) from any and all claims, causes of action, or liability for injuries, damages, or losses of any kind—whether to person or property—arising out of or related to participation in the Activities, even if arising from negligence or omission of the Released Party.
This waiver does not absolve any party of liability for intentional misconduct or gross negligence.

4. Personal Responsibility
The Participant agrees to follow all instructions, safety protocols, and conduct expectations. The Participant assumes full responsibility for monitoring their own physical and mental well-being and modifying or discontinuing participation as needed, especially during high temperatures or other adverse conditions.

5. Media Release
Participant grants permission for PCF Wellness Consulting Inc (including PCF Wellness Consulting Inc dba The Wellness Collective) to photograph or record the Activities for use in promotional and educational materials.

6. Acknowledgment of Understanding
The Participant has read this Agreement, understands its contents, and signs it voluntarily and without reservation. This waiver is intended to be as broad and inclusive as permitted under applicable law.
