This is a binding legal agreement. By signing this Waiver, Release, and Assumption of Risk Agreement ("Waiver and Release"), I acknowledge that I am voluntarily participating in activities at Palm Beach Padel LLC and agree to be bound by the terms herein. This agreement is executed in consideration of being allowed access to all or any part of the Padel Facility located at 1710 Old Okeechobee Rd, West Palm Beach, Florida 33409 (the "Padel Facility").


1. ASSUMPTION OF RISK
I acknowledge and understand that engaging in padel or any physical activity carries inherent risks, including serious personal injury, permanent disability, paralysis, or death. These risks exist regardless of the level of supervision, equipment, or instruction provided.


These risks include but are not limited to:
Strains, sprains, fractures, and dislocations.
Spinal cord injuries, head injuries, and concussions.
Falling, tripping, or slipping on courts, sidewalks, or facility areas.
Collisions with other players, walls, fences, or objects.
Being struck by balls or rackets.
Injuries caused by improper use or malfunction of equipment.
Travel-related incidents to and from the facility.
Psychological or emotional stress and fatigue.
Injuries may result from my own actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, including but not limited to participants, spectators, instructors, or staff.


I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN.


2. WAIVER AND RELEASE OF LIABILITY
I voluntarily agree to release, hold harmless, and discharge Palm Beach Padel LLC, its owners, members, partners, affiliates, employees, volunteers, contractors, sponsors, agents, and representatives ("Releasees") from any and all liability, claims, demands, causes of action, damages, or expenses, of any kind or nature, which may arise from or in connection with my participation at the Padel Facility.


This release includes but is not limited to:
Negligence or fault of Releasees.
Failure to maintain or supervise the facility.
Any condition of the premises or equipment.
Improper instruction or lack of supervision.
Any personal property loss or damage.


I EXPRESSLY WAIVE MY RIGHT TO FILE A LAWSUIT AGAINST PALM BEACH PADEL LLC AND THE RELEASEES, EVEN IF INJURIES OR DAMAGES ARE CAUSED BY THEIR NEGLIGENCE.

3. INDEMNIFICATION
I agree to indemnify and hold harmless the Releasees from any and all costs, legal fees, liabilities, or claims brought by third parties arising out of my conduct, negligence, or participation in activities at the Padel Facility.


4. FACILITY RULES AND CODE OF CONDUCT
I agree to abide by all rules, safety policies, and behavioral guidelines, including:
Wearing appropriate athletic attire and footwear.
Respecting all participants and staff.
Refraining from aggressive, dangerous, or disruptive behavior.


If I notice a hazardous situation, I will immediately notify Palm Beach Padel staff and withdraw from participation.


5. PERSONAL PROPERTY
Palm Beach Padel LLC is not responsible for lost, damaged, or stolen personal belongings. No illegal substances, alcohol, or tobacco products are permitted on the premises, including parking and outdoor areas.


6. HEALTH DECLARATION AND MEDICAL CONSENT
I certify that I am in good physical condition and do not have any medical condition that would prevent me from participating safely. If necessary, I have consulted with a medical professional.
I consent to receive emergency medical treatment in case of injury or illness. I am solely responsible for all medical costs incurred.


7. COVID-19 AND COMMUNICABLE DISEASES
I acknowledge the contagious nature of communicable diseases, including COVID-19, and voluntarily assume the risk of exposure. I agree to comply with all health protocols and release Palm Beach Padel LLC from liability related to illness or exposure.


8. IMAGE AND MEDIA RELEASE
I grant Palm Beach Padel LLC permission to photograph or record my participation for promotional purposes. I understand that these materials may be used online, in social media, or in marketing materials without compensation to me. Media remains the property of Palm Beach Padel LLC.


9. CANCELLATION AND NO-SHOW POLICY
Non-Members: Free cancellation up to 24 hours before playtime. Full fee charged after that.
Gold Members: Free cancellation up to 12 hours before playtime.
Platinum Members: Free cancellation at any time.
Cancellations within the allowed window will be refunded as club credit only.
Rainouts: Full refund to the original payment method.
No-shows: No refunds.


10. GOVERNING LAW AND JURISDICTION
This Waiver and Release shall be governed by and interpreted in accordance with the laws of the State of Florida. Any legal proceeding shall take place exclusively in Palm Beach County, Florida.


11. ACKNOWLEDGMENT OF UNDERSTANDING
I acknowledge that I have read this Waiver and Release in full, understand its contents, and sign it voluntarily. I am aware that I am giving up legal rights by signing this document, including the right to sue the Releasees.
