LIABILITY

I hereby understand and acknowledge that the training, programs and events held by Yotam
Trains, LLC dba LuxFit SF, may expose me to many inherent risks, including accidents, injury,
illness, or even death. I assume all risk of injuries associated with participation including, but not
limited to, falls, contact with other participants, the effects of the weather, including high heat
and/or humidity, and all other such risks being known and appreciated by me.
I hereby acknowledge my responsibility in communicating any physical and psychological
concerns that might conflict with participation in activity. I acknowledge that I am physically fit
and mentally capable of performing the physical activity I choose to participate in. After having
read this waiver and knowing these facts, and in consideration of acceptance of my participation
and LuxFit SF furnishing services to me, I agree, for myself and anyone entitled to act on my
behalf, to HOLD HARMLESS, WAIVE AND RELEASE LuxFit SF, its officers, agents,
employees, organizers, representatives, and successors from any responsibility, liabilities,
demands, or claims of any kind arising out of my participation in LuxFit SF training, programs
and/or events.
I indicate that I have read and understand this Waiver of Liability. I am aware that this is a
waiver and a release of liability and I voluntarily agree to its terms.

NO WARRANTY
LuxFit SF MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICES
AND, TO THE EXTENT ALLOWED BY LAW, WE (I) DISCLAIM ALL IMPLIED WARRANTIES
AND REPRESENTATIONS, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND
NON-INFRINGEMENT; (II) DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION
WITHOUT INTERRUPTION OR ERRORS OR BE ACCURATE, SECURE OR TIMELY; AND (III)
PROVIDE THE SERVICES ON AN “AS-IS” AND “AS-AVAILABLE” BASIS.

EXCLUSION OF LIABILITY
You agree that, to the extent permitted by law, your sole and exclusive remedy for any
dissatisfaction or problems with the Services is to stop using and, where applicable, uninstall the
Services.
TO THE EXTENT PERMITTED BY LAW, LuxFit SF, ITS AFFILIATES, AND THEIR
RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS,
SERVICE PROVIDERS, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, “LuxFit
SF PARTIES”) SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY
DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE
DAMAGES, OR ANY LOSS OF USE, DATA, OPPORTUNITIES, REPUTATION, PROFITS OR
REVENUES, ARISING OUT OF THE SERVICES OR THESE TERMS.
TO THE EXTENT THAT LuxFit SF IS LIABLE FOR ANY DIRECT DAMAGES FOR ANY
CLAIMS ARISING OUT OF OR IN CONNECTION TO THE SERVICES OR THESE TERMS, IN
NO EVENT SHALL LuxFit SF’S LIABILITY FOR SUCH DIRECT DAMAGES EXCEED, IN THE
AGGREGATE FOR ALL CLAIMS, ONE HUNDRED U.S. DOLLARS ($100). Except for any
liability of LuxFit SF pursuant to the preceding sentence, you acknowledge and agree that the
other LuxFit SF Parties have no liability to you for any direct damages arising out of the
Services or these Terms.

LuxFit SF is not a health care or medical provider and we aim to provide useful information, not
professional medical advice. The Services are not medical devices and the features, services
and content made available therein, including, without limitation, any suggestions, nutritional
plans or information, regimens, exercises, workouts, recipes, advice, information or other
materials are provided solely for general informational purposes, do not constitute medical
advice, and are not intended to diagnose, treat, cure or prevent any disease or injury, or as a
substitute for a professional medical evaluation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LuxFit SF IS NOT RESPONSIBLE OR
LIABLE, EITHER DIRECTLY OR INDIRECTLY, FOR ANY INJURIES OR DAMAGES THAT
ARE SUSTAINED FROM YOUR PHYSICAL ACTIVITIES OR YOUR USE OF, OR INABILITY
TO USE, ANY SERVICES OR FEATURES OF THE SERVICES, INCLUDING ANY CONTENT
OR ACTIVITIES THAT YOU ACCESS, PAY OR REGISTER FOR OR LEARN ABOUT
THROUGH OUR SERVICES, EVEN IF CAUSED IN WHOLE OR PART BY THE ACTION,
INACTION OR NEGLIGENCE OF LuxFit SF, OR BY THE ACTION, INACTION OR
NEGLIGENCE OF OTHERS.
