RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE.

This Agreement is entered into between Wild Wellness Club, LLC, a Florida limited liability company doing business as Wild Thing ("Wild Thing," "we," "us," "our"), located at 162 NW 73rd Street, Miami, Florida 33150, and the individual signing below ("Participant," "I," "me").
This Agreement applies to every person who books, attends, or enters Wild Thing's premises, however the booking was made, including bookings through ClassPass, SweatPals, or any other third-party platform, and including drop-ins, class packs, memberships, guests, event attendees, and complimentary visits.

1. Definitions

1.1 "Activities" means all yoga, movement, fitness, wellness, and recreational activities offered, hosted, or sponsored by Wild Thing, on or off our premises, including heated classes conducted at temperatures up to 105°F, non-heated classes, workshops, events, retreats, and any use of the Facilities.
1.2 "Premises" means the property at 162 NW 73rd Street, Miami, Florida, including the movement room, hallways, restrooms, changing areas, and the enclosed outdoor backyard.
1.3 "Backyard Facilities" means the outdoor area and everything in it: the cold plunge, the outdoor showers, the floating deck, the outdoor training equipment, the tiled surface area, the loose-rock walking surfaces, the awning structure, and the gates.
1.4 "Alley Exit" means the optional gate leading from the backyard to the adjacent alley, which is not owned, controlled, or maintained by Wild Thing.
1.5 "Facilities" means the Premises and the Backyard Facilities collectively.
1.6 "Released Parties" means Wild Wellness Club, LLC and its members, managers, officers, directors, employees, independent contractors, instructors, agents, volunteers, affiliates, successors and assigns, and the owner and landlord of the Premises.

2. Eligibility

I am at least 18 years of age. Wild Thing does not admit minors to any Activity or any part of the Facilities.

3. Agreement to Follow Rules

3.1 I agree to observe and obey all posted rules, warnings, and signage, and to follow all instructions given by Wild Thing staff or instructors, whether oral or written.
3.2 All rules posted at the Facilities are incorporated into this Agreement by reference. Violating a posted rule is a breach of this Agreement, and I assume full responsibility for any injury or loss resulting from my failure to follow it.

4. Assumption of Risk - General

4.1 I understand the Activities and use of the Facilities involve inherent and other risks of injury, illness, disability, and death, and that some risks cannot be eliminated regardless of the care taken.
4.2 General risks include, without limitation: strenuous physical exertion; stretching, twisting, inversion, and weight-bearing movement; muscle strains, sprains, tears, and fractures; joint, back, neck, and spinal injury; overexertion, dizziness, and fainting; cardiac events including heart attack; slips, trips, and falls; contact with props, mats, or equipment; physical adjustments or assists by instructors; contact with other participants; exposure to communicable disease; and property damage, theft, or loss.
4.3 I knowingly and voluntarily assume all such risks, whether they arise from the ordinary negligence of the Released Parties or from any other cause.

5. Assumption of Risk - Heated Classes

Heated classes are conducted at temperatures up to 105°F. Risks include heat exhaustion, heat stroke, dehydration, electrolyte imbalance, nausea, dizziness, fainting, and cardiac stress. I agree to hydrate before and after class, rest when needed, and leave the room if I feel unwell. Mats and floors may become slippery when wet.

6. Assumption of Risk - Outdoor Grounds

The backyard is an outdoor environment. Risks include: uneven, loose, and shifting walking surfaces, including loose rock that can roll underfoot and cause ankle injury; wet and slippery surfaces; surfaces that become hot in direct sun and can cause contact burns to bare feet; level changes, edges, and gaps in decking; splinters and exposed hardware; limited visibility in low light; sudden weather including heat, sun exposure, rain, wind, and lightning; falling debris from overhead structures; and insects, reptiles, and other wildlife. Barefoot use of all outdoor surfaces is at my own risk.

7. Assumption of Risk - Cold Plunge

THE COLD PLUNGE IS SELF-SERVICE. NO LIFEGUARD IS ON DUTY. NO WILD THING STAFF MEMBER SUPERVISES, MONITORS, OR OBSERVES COLD PLUNGE USE AT ANY TIME. NO ONE WILL KNOW IF I AM IN DISTRESS.
7.1 The cold plunge is maintained at approximately 45°F to 55°F.
7.2 Immersion at this temperature can cause an immediate, involuntary, and uncontrollable physiological response. Risks include, without limitation:

* (a) cold shock response - involuntary gasping, hyperventilation, and loss of breath control on entry;
* (b) cardiac arrhythmia, sudden elevation of blood pressure and heart rate, heart attack, and cardiac arrest;
* (c) hypothermia and post-immersion afterdrop;
* (d) dizziness, disorientation, and fainting, including after exiting the water;
* (e) loss of consciousness while immersed;
* (f) drowning, including drowning in shallow water;
* (g) non-freezing cold injury and nerve damage;
* (h) slips and falls on wet surfaces entering and exiting; and
* (i) exposure to bacteria, viruses, and other microorganisms present in recreational water, and to water-treatment equipment and byproducts.

Any of these may result in catastrophic injury, permanent disability, paralysis, or death.
7.3 I agree to each of the following:

* (a) I will not use the cold plunge alone. I will make sure another adult is present in the backyard and aware I am entering the water.
* (b) I will limit each immersion to a maximum of five (5) minutes.
* (c) I will not submerge my head, hold my breath underwater, dive, jump, or enter head-first.
* (d) I will enter and exit slowly and under my own power, and will not use the cold plunge if I am unable to enter and exit unassisted.
* (e) I will exit immediately if I experience chest pain, difficulty breathing, numbness, confusion, disorientation, dizziness, or uncontrollable shivering.
* (f) I will not use the cold plunge if I have consumed alcohol, cannabis, or any drug or medication that may impair my judgment, coordination, perception of temperature, or cardiovascular response.
* (g) I will shower before entering.
* (h) I will not bring glass, food, or beverages into the plunge area.

7.4 The cold plunge cover is a thermal cover only. It is not a safety cover. It is not designed, rated, or intended to prevent entry, entrapment, or drowning, and it will not support the weight of a person. I will not stand, sit, walk, or place any object on it.
7.5 The cold plunge is not a medical device. Wild Thing makes no representation that cold water immersion provides any health, therapeutic, recovery, or medical benefit.

8. Assumption of Risk - Outdoor Showers

Risks include slips and falls on wet decking and wet finished surfaces; splinters and exposed or corroded hardware. Hot water is supplied and is controlled by the user. I am solely responsible for testing and adjusting the water temperature before and during use.

9. Assumption of Risk - Outdoor Training Equipment

The outdoor pull-up and dip equipment is unsupervised. Risks include falls from height, equipment failure, hand tears and grip failure, dropped-weight and impact injury, and landing on hard or uneven surfaces. I agree to inspect the equipment before each use and not use it if anything appears damaged, loose, or unsafe; to use no more than one person per bar at a time; and to follow all posted equipment rules. I will not use the equipment if I am not physically capable of doing so safely.

10. Assumption of Risk - Alley Optional Exit

10.1 The primary and recommended route in and out of the backyard is through the studio.
10.2 The Alley Exit is provided as an optional convenience only. The alley is not owned, leased, controlled, maintained, inspected, lit, or repaired by Wild Thing.
10.3 If I choose to use the Alley Exit I do so entirely at my own risk. Known conditions in and around the alley include: concrete steps and level changes; narrow passage areas; water discharge and standing water; wet and slippery surfaces; uneven paving; limited or no lighting; and the presence of third parties and debris outside Wild Thing's control.
10.4 I elect whether to use the Alley Exit. Wild Thing does not require, direct, or recommend its use, and assumes no responsibility for any condition in the alley or for anything that happens to me there.

11. Health Representation and Medical Acknowledgment

11.1 I represent that I am in good physical health and medically able to participate in the Activities and use the Facilities I choose to use.
11.2 I represent that I do not have, and have not been diagnosed with, any of the following, or, if I do, that I have consulted a physician and obtained clearance to participate, including specific clearance for cold water immersion if I intend to use the cold plunge:
cardiovascular disease or any heart condition; high or uncontrolled blood pressure; arrhythmia or history of cardiac events; history of stroke; circulatory disorders including Raynaud's phenomenon; cold urticaria or cold allergy; epilepsy or any seizure disorder; asthma or other respiratory conditions; diabetes; peripheral neuropathy or reduced sensation; pregnancy or recent childbirth; recent surgery, open wounds, or active infection; eating disorders; any condition affecting circulation, temperature regulation, or the ability to sense heat or cold; and use of any medication affecting heart rate, blood pressure, circulation, or thermoregulation.
11.3 I agree to inform Wild Thing of any condition, injury, or limitation relevant to my participation, and to update that information if it changes. Wild Thing does not screen participants, does not review medical histories, and relies entirely on the accuracy of my representations in this Section.
11.4 I will not participate if I am ill, injured, impaired, or have been advised by a medical professional not to participate.
11.5 Wild Thing does not provide medical services, emergency medical services, lifeguard services, or supervision of any kind in the Backyard Facilities.

12. Backyard Access Terms

12.1 Access to the Backyard Facilities is limited to individuals who have attended a booked class at Wild Thing on that same day.
12.2 Backyard access ends sixty (60) minutes after the conclusion of the class I attended.
12.3 Wild Thing may close the backyard or any part of it at any time and without notice - for weather, maintenance, water quality, or any other reason - without refund or credit.

13. Guests

13.1 Every guest I bring must execute this Agreement before entering the Facilities. Guests are subject to this Agreement on the same terms as I am.
13.2 I am responsible for my guest's compliance with all posted rules, this Agreement, and Wild Thing's policies, and for any injury, loss, or damage caused by my guest. My indemnification obligation in Section 17 extends to any claim arising from my guest's participation or conduct.
13.3 Guest passes, including when they may be redeemed, are governed by the Terms.

14. Communicable Disease

Being in a shared space and using shared water and equipment involves risk of exposure to communicable diseases, including bacterial, viral, and fungal infections. Wild Thing cannot eliminate this risk. I assume it voluntarily.

15. Release and Waiver of Liability

In consideration of being permitted to participate in the Activities and use the Facilities, I hereby release, waive, discharge, and covenant not to sue the Released Parties from and for any and all claims, demands, actions, causes of action, damages, losses, costs, and expenses of any kind - including those for personal injury, illness, disability, death, and property damage - arising out of or in any way related to my participation in the Activities, my use of the Facilities, my use of the Alley Exit, or my presence on the Premises, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent permitted by Florida law.
This release binds me and my heirs, next of kin, executors, administrators, personal representatives, estate, and assigns.

16. Covenant Not to Sue

I agree not to bring, and to cause my heirs, executors, administrators, personal representatives, estate, and assigns not to bring, any claim, suit, or action against any Released Party for anything released under Section 15.

17. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claim, liability, damage, loss, cost, or expense - including reasonable attorneys' fees and costs at trial and on appeal - brought by or on behalf of me, my family, my heirs, my estate, my guests, or any third party, arising out of or related to my participation in the Activities, my use of the Facilities, my conduct on the Premises, the participation or conduct of any guest I bring, or my breach of this Agreement.

18. Personal Property

Wild Thing is not responsible for lost, stolen, or damaged personal property, whether left in lockers, cubbies, the backyard, or anywhere else on the Premises. I am advised not to bring valuables.

19. Emergency Medical Treatment

I consent to receive emergency medical treatment that any Released Party, emergency responder, or medical professional deems advisable in connection with my participation, and I am solely financially responsible for that treatment and any transport.

20. Video Surveillance

The Premises, including the backyard, are monitored by video surveillance for safety and security. I consent to being recorded. Recordings are retained and deleted according to Wild Thing's ordinary retention practices.

21. Photograph, Video, and Likeness Release

21.1 I grant Wild Thing the right to photograph and record me at the Facilities and at Wild Thing events, and to use, reproduce, publish, and display my name, image, likeness, and voice in Wild Thing's marketing, advertising, social media, and promotional materials, in any medium, without compensation.
21.2 I may decline or withdraw consent at any time going forward by emailing [hello@wildthingyoga.com](mailto:hello@wildthingyoga.com). Withdrawal applies to future use and does not require removal of materials already published.

22. Third-Party Bookings and Platforms

22.1 This Agreement applies to me in full, on identical terms, regardless of how I booked, including bookings made through ClassPass, SweatPals, Wellhub or any other third-party platform, marketplace, or reseller (each, a "Platform").
22.2 No agency. No Platform is an agent, partner, employee, or representative of Wild Thing, and Wild Thing is not an agent of any Platform. Wild Thing is not responsible for any act, omission, statement, representation, description, pricing, scheduling error, data handling, privacy practice, service interruption, or failure of any Platform, and I will not assert any claim against the Released Parties arising from a Platform's conduct.
22.3 No greater duty. Booking through a Platform does not create any duty, obligation, warranty, or standard of care of Wild Thing different from or greater than what this Agreement provides. Any representation about Wild Thing, its Facilities, its Activities, or its safety made by a Platform and not made directly by Wild Thing is not binding on Wild Thing and I do not rely on it.
22.4 Separate agreements. My relationship with a Platform is governed solely by my agreement with that Platform, which controls my payment, booking, cancellation, and any fees charged by that Platform. Wild Thing staff cannot waive, alter, refund, or credit any fee charged by a Platform. Those matters are directed to the Platform.
22.5 Waiver required. This Agreement must be executed before I enter the Facilities regardless of booking channel. Wild Thing may deny entry to any person who has not executed it.

23. Relationship to the Terms of Service

23.1 Wild Thing's Terms of Use & Membership Agreement (the "Terms"), at wildthingyoga.com/terms-of-service, are incorporated by reference and apply to my membership, purchases, billing, cancellation, and use of the Services.
23.2 This Agreement governs all matters relating to risk, liability, release, indemnification, and personal injury. The Terms govern all commercial matters. If there is any conflict between the two documents on a matter of liability or release, this Agreement controls.
23.3 Nothing in this Agreement limits any right I have under Florida's health studio law, including the cancellation and refund rights set out in the Terms.

24. Dispute Resolution and Governing Law

24.1 This Agreement is governed by the laws of the State of Florida, without regard to conflict of laws principles.
24.2 Except as provided in 24.3, any dispute, claim, or controversy arising out of or relating to this Agreement, the Activities, or the Facilities shall be resolved exclusively by binding arbitration administered in Miami-Dade County, Florida, by the American Arbitration Association under its applicable rules. I waive the right to a trial by jury and the right to participate in any class, collective, or representative action.
24.3 Small-claims carve-out. Either party may bring an individual claim in the small claims court of Miami-Dade County if the claim is within that court's jurisdictional limit and is brought on an individual basis.
24.4 Venue for any matter not subject to arbitration lies exclusively in the state or federal courts in Miami-Dade County, Florida.

25. Electronic Signature and Records

I agree this Agreement may be signed electronically, that my electronic signature has the same legal effect as a handwritten signature, and that Wild Thing and its booking platform may retain this Agreement together with the date, time, and electronic record of my signature as the authoritative record. I consent to receive this Agreement and related records electronically.

26. General

26.1 Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remainder stays in force.
26.2 No duress. I am signing voluntarily, without pressure or duress, and have had the opportunity to read this Agreement in full and to seek independent legal advice.
26.3 Arm's length. This Agreement has been fairly presented and no rule of construction against the drafting party applies.
26.4 Survival. Sections 15 through 19 and 23 through 26 survive the end of my membership or participation.
26.5 No waiver. Wild Thing's failure to enforce any provision is not a waiver of it.
26.6 Duration. This Agreement applies to my current and all future participation until I revoke it in writing. Revocation ends my right to participate.
26.7 Headings. Headings are for convenience only.

ACKNOWLEDGMENT

By signing, I confirm that:

* I am 18 or older.
* I have read this entire Agreement and understand it.
* I understand the cold plunge is self-service, that no lifeguard or staff member supervises it, and that risks include cardiac arrest, loss of consciousness, drowning, and death.
* I have accurately represented my medical condition in Section 11.
* If I use the Alley Exit, I do so at my own risk on property Wild Thing does not own or control.
* I am giving up substantial legal rights, including the right to sue and the right to a jury trial.
