This class is designed for **all levels**, so whether you're brand new to dance, a K-Pop lover, a pom girlie, or an experienced dancer looking for something fun and different, there's a place for you.

# SPARC SOCIAL COLLECTIVE LLC

## GENERAL PARTICIPANT WAIVER, RELEASE OF LIABILITY & PHOTO/MEDIA RELEASE

By participating in any class, event, workshop, training session, fitness activity, dance activity, social gathering, pop-up, or other activity hosted, organized, sponsored, or facilitated by **Sparc Social Collective LLC** (“Sparc”), I acknowledge and agree to the following:

### 1. ASSUMPTION OF RISK

I understand that participation in Sparc activities may involve physical activity, movement, dance, exercise, stretching, fitness instruction, use of equipment or props, and/or participation in environments with other participants.

I understand that these activities may involve inherent and unforeseeable risks, including but not limited to muscle strains, sprains, falls, collisions, soreness, fatigue, dizziness, or other physical injury.

I voluntarily choose to participate and knowingly assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.

I am responsible for determining whether I am physically and otherwise able to safely participate in any Sparc activity. I understand that Sparc and its instructors, contractors, employees, partners, volunteers, and representatives are not providing medical advice or medical clearance.

If I experience pain, dizziness, illness, injury, or otherwise feel unable to safely continue an activity, I agree to stop participating and seek appropriate assistance.

### 2. RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, I release and agree not to hold liable **Sparc Social Collective LLC**, along with its owners, members, employees, instructors, contractors, volunteers, representatives, event partners, venue partners, and agents (collectively, the “Released Parties”), for claims, demands, damages, losses, or expenses arising out of or related to my participation in Sparc activities, including claims relating to personal injury, illness, property damage, or loss.

This release applies to risks arising from my voluntary participation in Sparc activities, including risks associated with the physical activity itself, the use of equipment, interaction with other participants, and the premises or venues where activities occur, to the fullest extent permitted by law.

Nothing in this waiver is intended to waive or release any right or claim that cannot legally be waived or released under applicable law.

### 3. MEDICAL TREATMENT

In the event of an emergency, injury, or medical situation arising during my participation, I authorize Sparc and/or its representatives to seek or facilitate appropriate emergency medical assistance on my behalf if reasonably necessary.

I understand that I am responsible for any medical expenses, treatment costs, transportation costs, or other expenses incurred as a result of an injury or medical situation.

### 4. PERSONAL RESPONSIBILITY

I agree to follow reasonable instructions provided by Sparc, its instructors, staff, and event personnel.

I understand that I am responsible for participating within my own abilities and for communicating any relevant limitations or concerns to the instructor or appropriate Sparc representative.

I agree not to participate while impaired by alcohol, drugs, or any other substance that could reasonably affect my ability to participate safely.

### 5. PHOTO, VIDEO & MEDIA RELEASE

I understand that Sparc activities and events may be photographed, filmed, or otherwise recorded.

By participating, I grant **Sparc Social Collective LLC** and its authorized representatives permission to photograph, record, and/or otherwise capture my image, likeness, voice, and participation during Sparc activities and events.

I authorize Sparc to use such photographs, videos, recordings, and other media (“Media”) for legitimate business, marketing, promotional, advertising, social media, website, email, event recap, educational, and other promotional purposes, in any format or medium now known or later developed.

I understand that the Media may be edited, reproduced, published, distributed, displayed, shared, or otherwise used without additional approval or compensation to me.

I waive any right to inspect or approve the final Media or the specific use of my image, likeness, or voice before publication.

I understand that I will not receive payment, royalties, or other compensation for the use of Media featuring me.

I release Sparc and its authorized representatives from claims arising from the permitted use of the Media, including claims relating to privacy, publicity, or use of my likeness, to the fullest extent permitted by law.

### 6. SOCIAL MEDIA & THIRD-PARTY SHARING

I understand that Sparc may share Media on social media platforms or with event, venue, brand, sponsorship, or marketing partners in connection with Sparc activities.

Once Media is posted or distributed publicly, Sparc cannot guarantee how third parties may further share, repost, save, or otherwise use that Media.

### 7. PERSONAL PROPERTY

I understand that I am responsible for my personal belongings while participating in Sparc activities. Sparc is not responsible for lost, stolen, or damaged personal property.

### 8. PARTICIPANT ACKNOWLEDGMENT

By signing below, I confirm that:

* I have read and understand this Waiver and Release.
* I voluntarily agree to participate in Sparc activities.
* I understand the risks associated with participation.
* I accept responsibility for my own participation and safety.
* I agree to the release of liability described above to the fullest extent permitted by law.
* I grant the photo, video, and media rights described above.
* I understand that this agreement applies to my participation in Sparc activities and events unless otherwise stated in writing.

I have had the opportunity to ask questions regarding this Waiver before signing.
