This Fourth of July, we’re taking over the pool at Hotel Nikko San Francisco for an afternoon of sunshine, cocktails, music, and the kind of energy that makes summer unforgettable.

Expect DJs spinning feel-good favorites all day, poolside cocktails, beautiful people, elevated activations, and a crowd that’s actually there to have a good time. Whether you’re floating in the pool, dancing with a drink in hand, or making memories with friends old and new, this is your official invitation to spend Independence Day weekend the OTT way.

No backyard BBQs. No crowded waterfronts. No standing around wondering where the vibe is.

2–5. LIABILITY WAIVER, MEDIA RELEASE, NO REFUNDS & 21+ ACKNOWLEDGEMENT

OTT JULY 4TH POOL PARTY

ASSUMPTION OF RISK, LIABILITY WAIVER, RELEASE OF CLAIMS, MEDIA RELEASE, AND TICKET POLICY

By purchasing a ticket to and/or attending the OTT July 4th Pool Party (“Event”), hosted by Over The Top (“OTT”), you acknowledge and agree to the following:

1. ASSUMPTION OF RISK

I understand that participation in the Event involves inherent risks, including but not limited to:

* Swimming and pool-related activities
* Slipping, falling, or other accidents occurring in or around the pool area
* Injury resulting from participation in recreational activities
* Injury caused by the actions or negligence of other attendees
* Exposure to alcohol consumption by myself or others
* Illness, property damage, bodily injury, permanent disability, or death

I voluntarily assume all risks associated with attending and participating in the Event, whether known or unknown, foreseeable or unforeseeable.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless:

* Over The Top (OTT)
* Hotel Nikko San Francisco
* Event sponsors and partners
* Event staff, volunteers, contractors, vendors, DJs, performers, and affiliates
* Their respective owners, officers, directors, employees, agents, and representatives

from any and all claims, liabilities, demands, causes of action, damages, losses, costs, or expenses arising out of or related to my attendance at or participation in the Event, including those arising from ordinary negligence.

This release includes, but is not limited to, claims involving personal injury, death, property damage, theft, loss of personal belongings, or any pool-related incident.

3. ALCOHOL ACKNOWLEDGEMENT

I understand that alcoholic beverages may be served and consumed at the Event.

I agree that:

* I am solely responsible for my own alcohol consumption.
* I will drink responsibly.
* I will not operate a vehicle while impaired.
* OTT and its affiliates are not responsible for any injury, accident, damage, loss, or harm resulting from my consumption of alcohol before, during, or after the Event.

Any attendee appearing visibly intoxicated, disruptive, or unsafe may be removed from the Event without refund.

4. 21+ EVENT REQUIREMENT

This Event is strictly limited to individuals twenty-one (21) years of age or older.

A valid government-issued photo ID is required for entry.

OTT reserves the right to deny entry to any attendee who cannot provide acceptable proof of age. No refunds will be issued in such circumstances.

5. NO REFUNDS POLICY

ALL SALES ARE FINAL.

No refunds, exchanges, credits, or transfers will be issued for any reason, including but not limited to:

* Scheduling conflicts
* Travel issues
* Illness
* Failure to attend
* Weather conditions
* Removal from the Event due to violation of Event rules
* Denied entry due to inability to provide valid identification

In the event the Event is postponed, rescheduled, relocated, or modified, tickets will remain valid for the rescheduled Event and will not be eligible for refund except where required by applicable law.

6. PHOTO, VIDEO & MEDIA RELEASE

I understand that photography, videography, livestreaming, and other recording activities may occur during the Event.

By attending the Event, I grant OTT, its affiliates, sponsors, partners, and authorized representatives the irrevocable right and permission to:

* Photograph, record, and capture my image, likeness, voice, appearance, and participation
* Use, edit, reproduce, publish, distribute, display, broadcast, and otherwise exploit such content in any format or media now known or later developed
* Use such content for advertising, marketing, promotional, commercial, editorial, social media, public relations, and other lawful purposes

I understand that I will not receive compensation, royalties, approval rights, or additional notice regarding such use.

7. EVENT RULES

OTT reserves the right to refuse entry to or remove any attendee who:

* Engages in unsafe behavior
* Violates venue rules
* Harasses other attendees
* Damages property
* Creates a disturbance
* Fails to comply with staff instructions

Removal from the Event will not entitle the attendee to a refund.

8. AGREEMENT

By purchasing a ticket, entering the venue, or attending the Event, I acknowledge that I have read, understood, and voluntarily agree to all terms contained in this Assumption of Risk, Liability Waiver, Media Release, and Ticket Policy.

I further acknowledge that I am at least 21 years of age and legally competent to enter into this agreement.
