PRO Fitness and Sports Academy
Liability Waiver and Release Agreement

This Waiver and Release Agreement ("Agreement") is a legally binding document between PRO Fitness and Sports Academy ("Gym") and the undersigned individual ("Participant"). By signing this Agreement, the Participant acknowledges and agrees to the terms and conditions outlined herein.

1. Assumption of Risk
1.1 The Participant acknowledges that participation in fitness activities, training programs, classes, and use of gym facilities, equipment, and amenities involves inherent risks, including but not limited to:
Physical injury (e.g., sprains, strains, fractures, dislocations).
Medical conditions (e.g., heart attacks, stroke, heat-related illnesses).
Exposure to communicable diseases, including COVID-19.
1.2 The Participant voluntarily assumes all risks associated with their participation in fitness activities, use of Gym facilities, and engagement with Gym programs.

2. Waiver and Release of Liability
2.1 The Participant expressly releases, waives, and discharges the Gym, its owners, directors, officers, employees, contractors, agents, representatives, and affiliates ("Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to:
Injuries, damages, or losses sustained during participation in fitness activities or use of Gym facilities.
Negligence, except gross negligence or willful misconduct, by the Released Parties.
2.2 This waiver applies to claims for personal injury, property damage, or wrongful death arising from participation in Gym activities or presence on Gym premises.

3. Medical Clearance and Health Representation
3.1 The Participant acknowledges the importance of consulting a physician before beginning any fitness program.
3.2 By signing this Agreement, the Participant represents that:
They are in good health and physically able to engage in fitness activities.
They have no medical conditions, illnesses, or injuries that could endanger themselves or others during participation.
3.3 The Participant agrees to disclose any medical conditions, allergies, or limitations to Gym staff before participation.

4. Use of Facilities and Equipment
4.1 The Participant agrees to use Gym facilities, equipment, and amenities responsibly and as intended.
4.2 The Participant acknowledges that improper use of equipment or failure to follow staff instructions may increase the risk of injury.
4.3 The Participant agrees to notify Gym staff immediately of any malfunctioning or damaged equipment.

5. Indemnification
5.1 The Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, expenses, or legal actions, including attorney fees, arising out of:
The Participant’s use of Gym facilities or participation in activities.
The Participant’s negligence, misconduct, or violation of Gym policies.

6. Communicable Diseases and Public Health Risks
6.1 The Participant acknowledges that participation in Gym activities may expose them to communicable diseases, including but not limited to COVID-19.
6.2 The Participant agrees to comply with all Gym health and safety protocols, including but not limited to:
Wearing face coverings when required.
Maintaining appropriate physical distancing.
Refraining from using the Gym if experiencing symptoms of illness.
6.3 The Participant releases the Gym from liability for any illness, injury, or health condition resulting from exposure to communicable diseases while on the premises.

7. Rules and Code of Conduct
7.1 The Participant agrees to abide by all Gym rules, regulations, and policies, including those governing:
Proper attire and footwear.
Respectful behavior toward staff and other members.
Use of lockers, personal property, and designated spaces.
7.2 Failure to comply with Gym policies may result in suspension or termination of membership without refund.

8. Photography and Media Release
8.1 The Participant consents to the use of their image, likeness, or recordings taken during participation in Gym activities for promotional purposes.
8.2 Participants may opt out by submitting a written request to Gym management.

9. Minors
9.1 For Participants under the age of 18, this Agreement must be signed by a parent or legal guardian.
9.2 The parent or guardian assumes all liability and risks associated with the minor’s participation in Gym activities.

10. Governing Law and Dispute Resolution
10.1 This Agreement is governed by the laws of the State of Illinois.
10.2 Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Cook County, Illinois.

11. Sever ability
11.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment and Agreement
By signing below, the Participant acknowledges that they have read, understood, and voluntarily agreed to this Waiver and Release Agreement. The Participant confirms they are signing this Agreement of their own free will and intend for it to be legally binding.
