ALIVE Waiver and Release of Liability

By purchasing a ticket for and attending ALIVE on September 19, 2026 at Washington Park, Burlingame, California, I acknowledge and agree to the following:

Assumption of Risk

I understand that ALIVE is a fitness and wellness festival featuring physical activities such as yoga, Pilates, strength training, running, walking, stretching, mobility, group fitness classes, and other wellness experiences.

I understand that participation in these activities involves inherent risks, including but not limited to falls, collisions, equipment-related injuries, muscle strains, illness, dehydration, heat-related conditions, permanent injury, or death. I voluntarily choose to participate and assume all risks associated with my attendance and participation, whether known or unknown.

Medical Fitness

I represent that I am physically able to participate in the activities I choose to attend. I understand that I am responsible for determining whether I am medically fit to participate and agree to participate only at a level appropriate for my own health and fitness.

If I require emergency medical assistance during the event, I authorize event personnel to obtain such assistance on my behalf if deemed necessary. I understand that I am solely responsible for any medical expenses incurred.

Release of Liability

To the fullest extent permitted by law, I release and hold harmless ALIVE, the Wendy Tam MOC Research Fund, Three Stars Foundation, the event organizers, instructors, volunteers, sponsors, vendors, partners, the City of Burlingame, Washington Park, and their respective officers, directors, employees, agents, contractors, and representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to my attendance or participation in ALIVE, including those arising from the ordinary negligence of the released parties, except where prohibited by law.

Personal Property

I understand that I am solely responsible for my personal belongings. ALIVE is not responsible for any lost, stolen, or damaged personal property.

Photography and Media Release

I grant ALIVE and its authorized partners permission to photograph, film, and record me during the event and to use my name, image, likeness, voice, and recordings for promotional, educational, fundraising, marketing, or other lawful purposes without compensation.

Event Changes

I understand that the event schedule, instructors, vendors, activities, and programming are subject to change without notice. ALIVE reserves the right to postpone, modify, or cancel the event due to weather, safety concerns, or other circumstances beyond its reasonable control.

Ticket Policy

I acknowledge that all ticket sales are final and non-refundable except where required by applicable law.

Governing Law

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the State of California. Any legal action arising out of or relating to this Waiver or participation in ALIVE shall be brought exclusively in the state or federal courts located in San Mateo County, California, to the extent permitted by applicable law.

Acknowledgment

By purchasing a ticket and attending ALIVE, I acknowledge that I have carefully read and understand this Waiver and Release of Liability. I understand that I am giving up certain legal rights, including the right to bring certain legal claims, and I voluntarily agree to all of its terms. My purchase of a ticket constitutes my acceptance of and agreement to all of the terms of this Waiver.

Includes: Access to all general fitness classes*, vendor village and wellness experiences, complimentary samples from participating brands, entry into festival raffles and giveaways, live DJ and emcee programming, and access to community activations and experiences (*Limited-capacity experiences subject to availability)

Includes everything in the General Festival Pass, plus: priority access to class registration, first access to limited-capacity experiences, priority booking for select recovery and wellness services, additional raffle entries, VIP check-in lane, and exclusive ALIVE VIP wristband
