AURÉA SOCIAL: RELEASE OF LIABILITY & WAIVER AGREEMENT

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

DEFINITION OF PARTIES

Auréa Social is a brand operated by Avari Entertainment LLC (“Company”). For the purposes of this Agreement, “Company” includes Auréa Social, Avari Entertainment LLC, its founder (Valeria Gutiérrez), employees, volunteers, agents, sponsors, and venue partners.

1. VOLUNTARY PARTICIPATION & ASSUMPTION OF RISK

I voluntarily choose to participate in Auréa Social events, which may include Pilates, movement-based classes, and other physical activities.

I understand that these activities involve inherent risks, including but not limited to muscle injury, falls, dehydration, allergic reactions, or other physical harm. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Company or others, and I accept full responsibility for my participation.

2. ACKNOWLEDGMENT OF NEGLIGENCE (TEXAS REQUIREMENT)

I UNDERSTAND THAT THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY FOR ANY CLAIMS BASED ON THE NEGLIGENCE OF THE COMPANY.

I EXPRESSLY AGREE THAT I AM WAIVING ANY RIGHT TO BRING LEGAL CLAIMS AGAINST THE COMPANY FOR INJURIES OR DAMAGES CAUSED BY ITS ORDINARY NEGLIGENCE.

3. MEDICAL DISCLAIMER & THIRD-PARTY SERVICES

I understand that the Company is not a medical provider and does not offer medical advice, diagnosis, or treatment.

From time to time, independent third-party vendors or sponsors may offer services such as B12 injections, IV therapy, skincare treatments, or food and beverage samples. These services are provided solely by independent contractors and are not supervised or controlled by the Company.

I acknowledge and agree that:

The Company makes no representations or warranties regarding the safety, effectiveness, or qualifications of any third-party provider
I am solely responsible for evaluating whether to participate in such services
I assume all risks associated with these services, including but not limited to allergic reactions, illness, injury, or death
I understand that I should consult with a licensed healthcare provider before participating in any medical or wellness-related service.

4. FITNESS TO PARTICIPATE

I certify that I am physically fit and able to participate in the activities offered. I do not have any medical condition that would make my participation unsafe.

I agree to listen to my body, modify movements as needed, and stop participation if I experience pain, discomfort, dizziness, or any unusual symptoms.

5. EMERGENCY MEDICAL AUTHORIZATION

In the event of an injury or medical emergency, I authorize the Company and its representatives to obtain emergency medical treatment on my behalf if deemed necessary. I understand that I am responsible for any costs incurred as a result of such treatment.

6. COMPREHENSIVE RELEASE & WAIVER

In consideration of being allowed to participate, I hereby release, waive, and forever discharge the Company from any and all liability, claims, demands, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me or to any property belonging to me, whether caused by negligence or otherwise, while participating in any activity or while on the premises.

7. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Company from any loss, liability, damage, or costs, including attorney fees and court costs, that may arise from my participation in the event.

This Agreement shall bind my family members, heirs, assigns, and personal representatives to full extent. 

8. PERSONAL PROPERTY

I understand that the Company is not responsible for any lost, stolen, or damaged personal belongings. I bring all personal items at my own risk.

9. RULES & CONDUCT

I agree to follow all instructions, guidelines, and safety protocols provided by the Company’s staff and instructors. Failure to do so may result in removal from the event without refund.

10. MEDIA RELEASE

I grant the Company the irrevocable right to use my image, likeness, voice, and appearance in any photography or video captured during the event for marketing, social media, and promotional purposes, without compensation.

11. THIRD-PARTY TICKET PURCHASES

If I am purchasing a ticket on behalf of another participant, I represent and warrant that I have informed the participant of this Agreement and that they will be required to review and agree to these terms prior to participating in the event.

I understand that each participant must individually accept this Agreement, and no person will be allowed to participate without doing so. 

If a ticket is purchased on my behalf, I acknowledge that my participation constitutes acceptance of this Agreement, and I agree to be bound by its terms to the fullest extent permitted by law.

12. CONDITION OF PARTICIPATION

As a condition of participation, I understand that I must personally review and accept this Agreement prior to engaging in any event activities.

The Company reserves the right to deny participation to any individual who has not completed this Agreement, regardless of ticket purchase status.

13. GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. ACKNOWLEDGMENT

BY PURCHASING A TICKET OR PARTICIPATING IN THIS EVENT, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I AGREE TO THESE TERMS FREELY AND VOLUNTARILY.
