Three-day, two-night surf and camping road trip from Tempe, Arizona to San Miguel and Ensenada, Baja California, Mexico. We’ll road-trip through Baja, camp near the coast, surf based on conditions, explore Ensenada, grab tacos along the waterfront, and potentially visit La Bufadora before returning to Tempe Sunday evening. Beginner/intermediate friendly overall, with all water activities based on conditions and individual ability.

BAJA SURF & CAMPING TRIP

PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT

1. Voluntary Participation
I understand that my participation in this independently organized Baja surf and camping trip (“Trip”) is entirely voluntary.

I understand that this Trip is a private recreational outing and is not sponsored, operated, endorsed, supervised, or insured by Arizona State University, Arizona Outdoors Club, or any other university, club, employer, travel company, tour operator, or governmental organization, unless expressly stated otherwise in writing.

I am responsible for deciding whether I am physically, mentally, legally, and practically capable of participating.

2. Activities Covered
I understand that activities during the Trip may include, but are not limited to:

surfing, swimming, entering or exiting the Pacific Ocean, beach activities, camping, campfires, cooking, hiking or walking over uneven terrain, traveling on paved and unpaved roads, driving or riding in motor vehicles, riding in caravans, visiting remote locations, traveling through Mexico, crossing international borders, visiting Ensenada, San Miguel, Valle de Guadalupe, Tecate, La Bufadora/Punta Banda and surrounding areas, and other voluntary recreational activities.

The exact itinerary and activities may change because of weather, surf, tides, road conditions, border conditions, campsite availability, safety concerns or group decisions.

3. Acknowledgment and Assumption of Risk
I understand that this Trip involves inherent and other risks that may result in serious injury, illness, permanent disability, property damage, or death.

These risks include, but are not limited to:

waves, shorebreak, rip currents, undertows and strong ocean currents;
drowning or near drowning;
collisions with surfboards, rocks, reefs, other surfers, swimmers or objects;
marine wildlife;
cold water exposure and hypothermia;
cuts, sprains, fractures, head injuries and other surfing injuries;
changing tides, swell, wind and weather;
cliffs, rocks, loose terrain and uneven ground;
remote locations and delayed access to emergency medical services;
vehicle crashes, mechanical failures and poor road conditions;
unpaved, sandy, muddy or otherwise difficult roads;
driving in Mexico and unfamiliar traffic conditions;
theft, robbery, loss or damage to property;
foodborne illness, contaminated water or other illness;
campfires, cooking equipment and burns;
encounters with animals or insects;
limited cellular coverage or communication;
actions or negligence of other participants, motorists or third parties;
international travel and border-crossing complications;
and other risks that may be known or unknown, foreseeable or unforeseeable.
I voluntarily choose to participate despite these risks and knowingly assume the risks inherent in these activities and travel.

4. Surfing and Water Safety
I understand that ocean conditions can change rapidly.

I acknowledge that a beach being suitable for surfing does not necessarily mean that it is suitable for swimming or suitable for every surfer.

I am personally responsible for determining whether an activity is within my ability.

I agree not to enter the water if I believe conditions exceed my ability or comfort level.

I understand that the Trip Organizer may recommend that certain individuals not enter the water or may recommend that the group avoid the water entirely, but I understand that such recommendations do not transfer responsibility for my personal safety to the Trip Organizer.

I remain responsible for my own decisions and actions.

5. International Travel, Passport, Visa and Immigration Responsibility
I understand that this Trip involves international travel between the United States and Mexico.

I am solely responsible for determining and confirming that I possess all documents and legal authorization necessary to:

depart the United States;
enter Mexico;
remain in Mexico during the Trip; and
legally re-enter the United States.
This may include, depending on my individual circumstances, a valid passport, visa, permanent resident card, I-20, DS-2019, travel signature, immigration documentation, Mexican immigration documentation or other documents.

If I am an international student, visa holder, permanent resident, non-U.S. citizen or otherwise subject to immigration requirements, I understand that it is my responsibility to consult the appropriate university international student office, attorney, government agency, embassy, consulate or other qualified authority before participating.

I understand that Enrique De La Garza III is not providing immigration or legal advice and makes no representation or guarantee that I will be admitted into Mexico or permitted to re-enter the United States.

I accept all responsibility for consequences resulting from missing, expired, incorrect or inadequate travel or immigration documentation, including denial of entry, detention, questioning, fines, additional travel expenses or inability to return with the group.

6. Transportation and Vehicles
I understand that transportation will primarily occur through privately owned vehicles and carpools.

Unless otherwise expressly agreed, drivers are independent participants and are not employees, professional drivers or transportation providers of the Trip Organizer.

If I drive, I represent that I:

possess a valid driver's license;
am legally permitted to operate the vehicle;
maintain any insurance required for travel in Mexico;
am responsible for ensuring the vehicle is safe and appropriately maintained;
and will comply with applicable traffic laws.
If I ride as a passenger, I voluntarily accept the ordinary and inherent risks associated with automobile transportation and international road travel.

I understand that the Trip Organizer does not guarantee the condition, insurance coverage, driving ability or conduct of another participant's vehicle or driver.

7. Personal Property
I am solely responsible for my own surfboards, wetsuits, camping equipment, electronics, passport, money, vehicle and other belongings.

I understand that the Trip Organizer is not responsible for property that is lost, stolen, damaged, destroyed or left behind during the Trip.

8. Alcohol and Personal Conduct
If alcohol is present, I am responsible for complying with applicable laws and making responsible decisions.

I agree that I will not operate a vehicle while impaired.

I understand that my consumption of alcohol or other substances is my own voluntary decision and responsibility.

I remain responsible for injuries, damages or consequences resulting from my own actions.

9. Medical Conditions and Emergency Care
I represent that I am sufficiently physically capable of participating in the activities I voluntarily undertake.

I am responsible for bringing any medications, medical equipment or other personal health supplies I require.

If I become injured or ill and am unable to provide consent, I authorize reasonable emergency assistance to be sought on my behalf.

I understand that emergency care in remote areas of Baja California may be delayed or limited.

I am responsible for costs associated with medical treatment, evacuation, transportation, hospitalization or other emergency services provided to me.

10. RELEASE OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE AND DISCHARGE ENRIQUE DE LA GARZA III, THE TRIP ORGANIZER, AND ANY VOLUNTEER TRIP LEADERS OR COORDINATORS FROM CLAIMS ARISING FROM MY PARTICIPATION IN THIS TRIP, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE EXTENT SUCH A RELEASE IS PERMITTED BY APPLICABLE LAW.

I understand that by signing this Agreement, I am giving up substantial legal rights.

This release is intended to apply to risks associated with the activities and circumstances specifically described in this Agreement.

Arizona courts require releases seeking to cover a party's own negligence to communicate that intention clearly, rather than relying on a broad or ambiguous disclaimer.

11. Matters Not Released
Nothing in this Agreement is intended to release liability that cannot legally be waived under applicable law.

This Agreement does not purport to excuse intentional misconduct or any other conduct for which prospective waiver is prohibited by law.

12. Indemnification
To the extent permitted by law, I agree to be responsible for claims, costs or damages caused by my own acts or omissions during the Trip.

I agree to indemnify and hold the Trip Organizer harmless from third-party claims arising from my negligent, reckless or unlawful conduct.

13. No Guarantee of Safety
I understand that the Trip Organizer may provide information, recommendations, directions or safety guidance, but cannot identify or eliminate every hazard.

I understand that no statement by the Trip Organizer constitutes a guarantee that an activity, location, campsite, road, surf break, border crossing or other circumstance is safe.

14. Changes, Delays and Cancellation
I understand that weather, surf, road closures, vehicle problems, border delays, government action, campsite access or other circumstances may cause changes to the itinerary.

I accept the possibility of delayed arrival or return, changed activities, changed campsites or cancellation of part or all of the Trip.

Unless specifically agreed otherwise, I remain responsible for my own resulting expenses.

15. Arizona Law
I agree that, to the extent legally permissible, this Agreement will be interpreted under the laws of the State of Arizona.

Any dispute arising from this Agreement or my participation in the Trip will, to the extent legally permissible, be brought in an appropriate court located in Maricopa County, Arizona.

16. Severability
If any portion of this Agreement is found invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

17. Entire Agreement and Acknowledgment
I acknowledge that I have had the opportunity to read this Agreement carefully and ask questions before signing.

I understand its contents and voluntarily agree to its terms.

I understand that this document includes an assumption of risk and release of liability, including certain claims involving ordinary negligence.

I certify that I am at least 18 years old and legally capable of signing this Agreement.
