RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

Event Name: Barebones Athletics Wellness Event

Location: The Nest, DeLand, Florida

1. By signing below, I acknowledge that I am at least 18 years of age and legally competent to enter into this agreement.

2. ACKNOWLEDGMENT OF RISKS

I understand that participation in the Barebones Athletics Wellness Event includes, but is not limited to:

High-intensity functional training (including but not limited to F45-style workouts)

Strength training

Cardio exercises

Mobility and stretching

Breathwork

Cold plunge exposure

Vendor product sampling

Interaction with third-party vendors

Exposure to loud music, crowds, and outdoor/garage-style environments

I understand that these activities involve inherent risks, including but not limited to:

Muscle strains, sprains, tears

Broken bones

Heart attack, stroke, or other cardiovascular events

Slipping or falling

Cold shock response or hypothermia (from cold plunge)

Allergic reactions to food, beverages, or products

Dehydration

Equipment malfunction

Exposure to communicable illnesses

Injury caused by other participants

Property damage or theft

I voluntarily assume full responsibility for any and all risks of injury, illness, death, or property damage.

3. MEDICAL REPRESENTATION

I represent that:

I am physically fit and have no medical condition that would prevent safe participation.

I have consulted a physician if necessary.

I am not pregnant (if applicable) or under medical restriction.

I understand cold exposure may not be appropriate for individuals with heart conditions, high blood pressure, or other medical concerns.

I understand that no medical personnel are guaranteed to be on-site.

4. RELEASE OF LIABILITY

In consideration of being permitted to participate, I hereby release, waive, discharge, and covenant not to sue:

Barebones Athletics LLC

F45 Training DeLand

Matthew Slafkovsky

The Nest (DeLand, FL)

Property owners, landlords, or affiliated entities

Event staff

Volunteers

Contractors

Coaches

DJs

Vendors

Sponsors

Agents and representatives

(collectively referred to as “Released Parties”)

From any and all liability, claims, demands, actions, or causes of action arising out of or related to:

Personal injury

Illness

Disability

Death

Property damage

Theft or loss

Negligence (including ordinary negligence of the Released Parties)

5. INDEMNIFICATION AGREEMENT

I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorney’s fees) arising from:

My participation

My actions or negligence

Damage caused by me to property or other individuals

6. THIRD-PARTY VENDOR DISCLAIMER

I acknowledge that vendors, sponsors, and service providers at the event are independent third parties.

Barebones Athletics and The Nest:

Do not manufacture vendor products

Do not guarantee safety or quality of vendor goods or services

Are not responsible for allergic reactions, misuse, or injury from vendor products or services

Participation with vendors is at my own risk.

7. COLD PLUNGE & RECOVERY SPECIFIC WAIVER

I understand that cold plunge and recovery modalities involve additional risks including:

Hyperventilation

Fainting

Cardiac stress

Shock response

I voluntarily assume these risks and agree that I am participating at my own discretion.

8. PROPERTY & PERSONAL BELONGINGS

I understand that:

I am responsible for my own belongings.

The Released Parties are not responsible for lost, stolen, or damaged items.

9. PHOTOGRAPHY & MEDIA RELEASE

I grant Barebones Athletics the irrevocable right to:

Photograph and record me

Use my image, likeness, and voice

Use content for marketing, social media, advertising, and promotional materials

Use content without compensation

10. RULES & REMOVAL

I agree to:

Follow all event rules

Follow staff instructions

Conduct myself respectfully

The Released Parties reserve the right to remove any participant without refund for unsafe or disruptive behavior.

11. SEVERABILITY

If any portion of this agreement is found unenforceable under Florida law, the remaining provisions shall remain in full force and effect.

12. GOVERNING LAW

This agreement shall be governed by the laws of the State of Florida.

13. VOLUNTARY EXECUTION

I HAVE READ THIS RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS TERMS.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.

I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
