EVENT LIABILITY WAIVER, RELEASE OF CLAIMS & ASSUMPTION OF RISK

Digital Acceptance Agreement

Event: The Bondfire – Community Bonfire Night
Location: 1338 E Curry Rd., Tempe, AZ
Organizers: Revival Wellness Experience LLC; MAKST LLC; and all affiliated owners, organizers, volunteers, contractors, performers, instructors, vendors, sponsors, and representatives (collectively, the “Released Parties”)

IMPORTANT LEGAL NOTICE

By checking the box indicating “I agree”, I acknowledge that I have read, understand, and agree to the terms of this legally binding waiver. This agreement waives certain legal rights, including the right to sue.

1. ASSUMPTION OF RISK

I understand that attending and participating in this event involves inherent risks, including but not limited to:
	•	Open flames, fire pits, bonfires, embers, sparks, heat, smoke, and fire performance
	•	Uneven or natural outdoor terrain, including dirt, gravel, grass, and low-light conditions
	•	Crowds, music, movement of people, and limited visibility
	•	Standing, walking, dancing, sitting, or other physical activity
	•	Weather conditions (heat, cold, wind, rain)
	•	Food and beverage consumption, including potential allergens
	•	Actions or omissions of other participants

I voluntarily choose to attend and participate with full knowledge and acceptance of these risks, whether known or unknown, foreseeable or unforeseeable.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by Arizona law, I release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, liabilities, demands, damages, losses, costs, or causes of action, whether arising from negligence or otherwise, related to or resulting from:
	•	My attendance at or participation in the event
	•	My presence at the event location
	•	Any injury, illness, property damage, or death I may sustain

This release applies even if caused in whole or in part by the negligence of the Released Parties.

3. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
	•	My actions or omissions
	•	My violation of this agreement
	•	My participation in the event

4. MEDICAL ACKNOWLEDGMENT

I affirm that I am physically and mentally able to participate and have no condition that would make my participation unsafe. I understand the Released Parties do not provide medical care.

I authorize emergency medical treatment if necessary and accept full responsibility for any related costs.

5. PERSONAL PROPERTY

I understand that I am solely responsible for my personal belongings. The Released Parties are not responsible for loss, theft, or damage to personal property.

6. PHOTO, VIDEO & MEDIA RELEASE

I grant permission for the Released Parties to capture and use photographs, video, or audio recordings of me for promotional, marketing, educational, or documentation purposes without compensation.

7. SUBSTANCE-FREE EVENT & CONDUCT

I acknowledge that this is a substance-free event and agree to follow all posted rules and instructions. I understand I may be asked to leave without refund for unsafe or disruptive behavior.

8. GOVERNING LAW & SEVERABILITY

This agreement shall be governed by the laws of the State of Arizona. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

9. DIGITAL ACCEPTANCE & ENTIRE AGREEMENT

By checking the box to accept this waiver, I confirm that:
	•	I am at least 18 years old (or have legal authority to accept on behalf of a minor)
	•	I have read and understand this agreement in full
	•	I am voluntarily agreeing to be legally bound by its terms

This agreement constitutes the entire agreement between myself and the Released Parties regarding this event.
