INJURY AND PROPERTY DAMAGE WAIVER AND RELEASE OF LIABILITY

Participant Waiver, Release of Liability, and Assumption of Risk Agreement

IMPORTANT: THIS IS A LEGAL AGREEMENT. PLEASE READ CAREFULLY BEFORE AGREEING.

In consideration of being permitted to participate in any way in activities, events, and gatherings organized by the Black Pickleball Alliance (“BPA”), including but not limited to practices, matches, clinics, open plays, social events, tournaments, and other related functions (collectively, the “Activities”), I, the undersigned participant, or legal guardian if participant is under the age of 18, acknowledge, understand, and agree to the following:

1. Assumption of Risk

I understand that participation in pickleball and related recreational or social activities involves inherent risks of physical injury, property damage, or loss. These risks may include, but are not limited to: slips, trips, collisions, falls, overexertion, contact with other participants, faulty equipment, unpredictable playing surfaces, and the potential for serious injury or death.

I voluntarily assume all such risks, both known and unknown, even if arising from the negligence or misconduct of BPA, its organizers, volunteers, affiliates, sponsors, or other participants.

2. Release and Waiver of Liability

I hereby release, discharge, and hold harmless the Black Pickleball Alliance, its officers, members, event hosts, volunteers, agents, sponsors, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, or causes of action for injury, illness, property damage, death, or other losses arising from or in any way related to my participation in the Activities, whether caused by the negligence or misconduct of the Released Parties or otherwise.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, and expenses (including reasonable attorney’s fees) arising from or related to my actions or omissions while participating in the Activities.

4. Lost or Stolen Property

I understand and agree that the Black Pickleball Alliance and the Released Parties are not responsible for any lost, stolen, or damaged personal property during participation in any BPA Activities or while on event premises. I agree to be solely responsible for the security of my belongings.

5. Medical Treatment

I authorize the Released Parties to obtain emergency medical treatment for me if necessary and agree to be responsible for any associated costs. I certify that I am physically fit to participate in pickleball and related Activities and that I have no known medical conditions that would prevent safe participation.

6. Photographs and Media Release

I grant BPA permission to use any photographs, video, or audio recordings of me taken during the Activities for promotional, educational, or other lawful purposes, without compensation.

7. Governing Law and Severability

This waiver shall be governed by and interpreted under the laws of the state Texas. If any provision is found to be unenforceable by a court of final jurisdiction, the remainder of the waiver shall remain in full force and effect.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND AGREE TO IT FREELY AND VOLUNTARILY.
