Participant Waiver, Release of Liability & Assumption of Risk Agreement

By registering for and participating in the “5K TO CAVA” event (“Event”), organized and hosted by Prolification Fitness LLC, Marquise Belanger, affiliated hosts, volunteers, sponsors, partners, vendors, and any associated individuals or entities (collectively referred to as the “Released Parties”), I acknowledge and agree to the following:

1. ASSUMPTION OF RISK

I understand that participating in a running event, fitness activity, or outdoor group activity involves inherent risks, dangers, and hazards, including but not limited to:

Slips, trips, falls, collisions, and physical injuries
Muscle strains, dehydration, exhaustion, heat-related illness, cardiac events, or death
Uneven pavement, potholes, curbs, road hazards, construction zones, traffic conditions, and other city/environmental hazards
Actions or negligence of other participants, pedestrians, bicyclists, motorists, or members of the public
Weather conditions including rain, wind, heat, cold, or poor air quality
Conditions of public streets, sidewalks, parks, trails, and lakefront areas
Delays in emergency medical response
Theft, damage, or loss of personal property

I knowingly and voluntarily assume all risks associated with participation in the Event, whether known or unknown, foreseeable or unforeseeable.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, liabilities, demands, damages, costs, expenses, injuries, losses, or causes of action arising out of or related to my participation in the Event.

This release includes, but is not limited to:

Personal injury
Property damage
Illness
Disability
Economic loss
Wrongful death
Accidents involving traffic, city infrastructure, public pathways, or other participants

I understand that this release applies regardless of whether such claims arise from negligence, acts, omissions, or other conduct by the Released Parties, except in cases of gross negligence or willful misconduct where prohibited by law.

3. MEDICAL ACKNOWLEDGMENT

I certify that I am physically capable of participating in this Event and have no medical condition that would prevent safe participation.

I understand that no medical insurance is provided by the Released Parties.

I authorize emergency medical treatment if necessary and understand that I am solely responsible for any resulting medical costs, expenses, or transportation fees.

4. COMPLIANCE WITH EVENT RULES

I agree to:

Follow all event instructions and safety guidelines
Obey traffic laws, pedestrian signals, and directions from volunteers or staff
Conduct myself responsibly and respectfully throughout the Event
Avoid reckless, dangerous, or disruptive behavior

I understand the Released Parties reserve the right to remove participants for unsafe or inappropriate conduct.

5. WEATHER, ROUTE & EVENT CHANGES

I understand that the Event route, schedule, location, or activities may be modified, delayed, or canceled due to weather, safety concerns, city regulations, emergencies, or other unforeseen circumstances.

I understand that registration fees, if applicable, may be non-refundable unless otherwise stated by the Event organizers.

6. PHOTO, VIDEO & MEDIA RELEASE

I grant the Released Parties permission to photograph, video record, and otherwise capture my likeness during the Event.

I authorize the use of these materials for promotional, marketing, advertising, social media, and commercial purposes without compensation or further approval.

7. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any claims, demands, liabilities, damages, or expenses arising from:

My participation in the Event
My actions or negligence
Any damage or injury caused by me to another participant or third party
8. ACKNOWLEDGMENT OF PUBLIC LOCATION

I understand this Event takes place in public areas including city streets, sidewalks, trails, and public property not owned or controlled by the Released Parties.

I acknowledge that the Released Parties are not responsible for the condition, maintenance, safety, or operation of public spaces, traffic conditions, or actions of third parties.

9. SEVERABILITY

If any provision of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10. AGREEMENT & ELECTRONIC CONSENT

By signing below or registering electronically for this Event, I acknowledge that:

I have carefully read and fully understand this Waiver and Release Agreement
I understand I am giving up substantial legal rights
I voluntarily agree to all terms and conditions
I am at least 18 years old, or a parent/legal guardian has signed on my behalf.
