COMPREHENSIVE LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

This Comprehensive Liability Waiver, Release of Claims, and Assumption of Risk Agreement (“Agreement”) is entered into by the registered participant (“Participant”) in favor of Callie Federow, Center Club Pilates, Elmhurst University, the owner or operator of the event premises, and their respective owners, officers, trustees, directors, employees, contractors, instructors, volunteers, sponsors, affiliates, insurers, successors, and assigns (collectively, the “Released Parties”).

This Agreement applies to Participant’s attendance at or participation in outdoor Pilates classes and related check-in, warm-up, exercise, cool-down, and event activities organized or instructed by Callie Federow and Center Club Pilates at Elmhurst University during September 2026 (collectively, the “Activities”).

By accepting this Agreement through the registration platform, Participant acknowledges and agrees to the following terms:

PARTICIPANT ELIGIBILITY

Participant confirms that they are at least 18 years old and legally able to enter into this Agreement.

ASSUMPTION OF RISK

Participant understands that Pilates, physical exercise, outdoor fitness classes, and related programming involve inherent and other risks, whether known or unknown and whether foreseeable or unforeseeable. These risks include, but are not limited to:

• Muscle soreness, strains, sprains, fractures, joint injuries, back or neck injuries, overexertion, dizziness, fainting, cardiovascular events, illness, and other bodily injury;

• Slips, trips, collisions, and falls;

• Uneven, wet, slippery, muddy, obstructed, or otherwise unpredictable outdoor terrain;

• Grass, dirt, holes, debris, insects, pollen, plants, and other natural or environmental conditions;

• Heat, cold, wind, rain, lightning, sun exposure, dehydration, poor air quality, and changing weather conditions;

• Contact with other participants, instructors, members of the public, personal mats, or surrounding objects;

• Aggravation of a known or unknown injury, illness, or medical condition;

• Exposure to communicable illnesses; and

• Delayed access to emergency or medical assistance because the Activities take place outdoors.

Participant knowingly and voluntarily accepts and assumes full responsibility for all risks of injury, illness, death, property damage, or other loss arising from or related to participation in the Activities, including risks caused in whole or in part by the ordinary negligence of a Released Party.

Participant understands that they may decline any exercise, request a modification, rest, or discontinue participation at any time.

RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED UNDER ILLINOIS LAW, PARTICIPANT KNOWINGLY, VOLUNTARILY, AND EXPRESSLY RELEASES, WAIVES, AND FOREVER DISCHARGES THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO PARTICIPANT’S ATTENDANCE AT OR PARTICIPATION IN THE ACTIVITIES.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER LOSS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, INCLUDING NEGLIGENT INSTRUCTION, SUPERVISION, EVENT OPERATION, OR MAINTENANCE OR CONDITION OF THE PREMISES.

Participant understands that this provision means Participant is giving up the right to bring claims covered by this Agreement, including claims alleging ordinary negligence by a Released Party.

Nothing in this Agreement is intended to waive or release claims arising from willful and wanton misconduct or any liability that cannot legally be waived under Illinois law.

MEDICAL FITNESS AND PARTICIPANT RESPONSIBILITY

Participant is responsible for determining whether they are physically and medically able to participate safely in the Activities.

Participant agrees to consult a physician or other qualified healthcare professional before participating if Participant is pregnant, postpartum, injured, recovering from surgery or illness, taking medication that may affect physical activity, has a medical condition, or otherwise has concerns about participating safely.

Participant agrees to notify the instructor before class of any injury, pregnancy, medical condition, physical limitation, or other concern that may affect participation.

Participant is solely responsible for monitoring their physical condition and agrees to stop participating if they experience pain, dizziness, shortness of breath, weakness, nausea, or unusual discomfort.

Participant understands that the Released Parties are not physicians and do not provide medical advice, diagnosis, or treatment.

INDEMNIFICATION

To the fullest extent permitted by law, Participant agrees to indemnify and hold harmless the Released Parties from claims, liabilities, damages, or expenses arising directly from Participant’s own negligent or intentional conduct, Participant’s violation of event or venue rules, or materially false information provided by Participant in connection with the Activities.

EMERGENCY MEDICAL ASSISTANCE

If Participant becomes injured or ill and is unable to make decisions independently, Participant authorizes the Released Parties to contact emergency services and provide reasonable assistance until emergency personnel arrive.

Participant understands that the Released Parties are not obligated to provide medical care or transportation. Participant accepts financial responsibility for any ambulance, hospital, medical, transportation, or related expenses incurred on Participant’s behalf.

PHOTO AND VIDEO RELEASE

Participant understands that photos and videos may be taken during the Activities to capture and share the Center Club Pilates experience.

Participant gives Callie Federow and Center Club Pilates permission to use photos or videos in which Participant may appear for social media, website, advertising, and other promotional purposes without compensation.

Participants who prefer not to be featured are encouraged to let the instructor know before class so reasonable efforts can be made to honor that preference.

PERSONAL PROPERTY

Participant is solely responsible for their mat, clothing, phone, wallet, and any other personal property brought to the Activities.

To the fullest extent permitted by law, Participant releases the Released Parties from claims involving the loss, theft, or damage of Participant’s personal property.

OUTDOOR AND PUBLIC-SPACE ACKNOWLEDGMENT

Participant understands that the Activities will take place outdoors on property owned or managed by Elmhurst University and may occur near public walkways, roads, buildings, students, visitors, or other activities.

Participant agrees to comply with all applicable laws, venue policies, safety instructions, and reasonable directions given by the instructor, event personnel, or Elmhurst University.

Participant understands that the Activities may be delayed, modified, relocated, shortened, or canceled because of weather, air quality, ground conditions, venue requirements, emergencies, or other circumstances beyond the organizer’s control.

NO GUARANTEES

Participant understands that no guarantees or promises have been made regarding fitness results, physical outcomes, safety outcomes, or Participant’s overall experience.

GOVERNING LAW AND SEVERABILITY

This Agreement shall be governed by and interpreted under the laws of the State of Illinois.

If any provision is determined to be invalid or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

BINDING EFFECT

This Agreement shall be binding upon Participant and Participant’s heirs, estate, executors, administrators, personal representatives, and legal representatives.

ENTIRE AGREEMENT

Participant understands that this Agreement contains the complete agreement regarding the subjects addressed herein and may not be modified except through a written agreement accepted by Participant and the applicable Released Party.

ACKNOWLEDGMENT AND AGREEMENT

Participant acknowledges that they have carefully read this entire Agreement, fully understand its terms, and voluntarily agree to be bound by it.

PARTICIPANT UNDERSTANDS THAT THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF LIABILITY, INCLUDING A RELEASE OF CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

PARTICIPANT UNDERSTANDS THAT THEY ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR CLAIMS COVERED BY THIS AGREEMENT.

By accepting this Agreement through the registration platform, Participant confirms that they are the registered Participant, are at least 18 years old, and have read, understood, and voluntarily accepted the entire Agreement.

Participant agrees that their electronic acceptance, together with the registration platform’s record of their identity and the date and time of acceptance, shall have the same force and effect as a handwritten signature.
