WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (THE "AGREEMENT") CONTAINS A WAIVER OF YOUR RIGHT TO SUE, A RELEASE OF ALL CLAIMS, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PARTICIPATING.
WAIVER: In return for being permitted to participate in the event described below, including all associated activities and services offered at the event, and use of the premises, facilities, staff, equipment, and transportation (collectively the "Event"), I, for myself and for my heirs, representatives, executors, administrators, successors, assigns, and any other person or entity acting on my behalf or on behalf of my estate, do hereby release, waive, discharge, and promise not to sue the Protected Parties (as identified below) for any claim, damages, or liability, including those arising from the negligence of the Protected Parties, in connection with my participation in the Event. This includes, without limitation, personal injury (including death), accidents, illnesses, and loss or damage to personal property.
Protected Parties: CHAI NRG LLC, its owners, shareholders, sponsors, advertisers, service and treatment providers, event organizers, lessors of the premises where the Event is located, and all officers, directors, employees, and agents of any of the foregoing.
EVENT DESCRIPTION: Event Name: CHAI NRG Activities: May include, but are not limited to, ice plunges, sports classes (such as mat Pilates), saunas, compression therapy, stretching, physical activity, intravenous (IV) treatments, red light therapy, food and beverage service, group congregation, chiropractic treatment, massage, dunk tanks, inflatable slides, and obstacle courses.
ASSUMPTION OF RISKS: I acknowledge and agree that participation in the Event is voluntary and involves inherent risks, which may vary and include but are not limited to:
Death
Paralysis
Heart attacks
Stroke
Electrocution from electrical equipment
Drowning
Hypothermia/Hyperthermia
Frostbite
Exhaustion or heat stroke
Eye, joint, or bone injuries
Concussions and loss of consciousness
Scratches, bruises, sprains, and other injuries
Risks associated with the consumption of food and beverages, including choking, foodborne illness, allergic reactions
Minor/Severe burns
Exacerbation of pre-existing conditions
Exposure to COVID-19 or any other communicable disease
By electronically signing this Agreement, I represent that I have considered these risks, consulted a healthcare provider if needed, and voluntarily chose to participate despite these risks.
INDEMNIFICATION: I agree to indemnify, defend, and hold the Protected Parties harmless from any claims, actions, suits, costs, expenses (including attorney and expert witness fees), damages, and liabilities that may arise out of my breach of this Agreement or participation in the Event.
REPRESENTATION OF AGE: I represent that I am at least 18 years of age at the time of signing this Agreement. I understand that individuals under the age of 18 are strictly prohibited from participating in or attending the Event, regardless of the presence of a parent or legal guardian.
PUBLICITY RELEASE: I authorize the Protected Parties to use my name, image, and/or voice (collectively "Likeness") in any photograph, video, or sound recording taken during the Event ("Materials") for any advertising, marketing, or lawful purpose, through any medium now known or hereafter created. I waive any right to inspect or approve the Materials, and I agree not to seek compensation for their use.
CONTENT OWNERSHIP: By participating in the Event, I acknowledge that all content created, including photographs, videos, and audio recordings, is exclusively owned by CHAI NRG LLC, including all rights to use, reproduce, modify, display, and distribute such content. Participants waive any claim to ownership or compensation.
SEVERABILITY: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
GOVERNING LAW: This Agreement is governed by the laws of the State of Florida, without regard to its conflict of law provisions.
CONSENT TO ELECTRONIC SIGNATURE: I agree that clicking the consent box or electronically signing this Agreement has the same legal effect as a physical signature and confirms my intent to be bound by this Agreement.
ACKNOWLEDGMENT OF UNDERSTANDING: I have read this Agreement, fully understand its terms, and acknowledge that I am waiving substantial rights, including my right to sue the Protected Parties. I confirm that I am signing this Agreement freely and voluntarily, without any inducement.
