PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE OR TO RECOVER MONEY DAMAGES IF YOU ARE INJURED OR IF YOUR PROPERTY IS DAMAGED. DO NOT SIGN THIS DOCUMENT UNLESS YOU UNDERSTAND IT.
1. Acknowledgment of Risk
I understand that participation in ClubTrackSTPete (“the Program”), including all coached track workouts, running, sprinting, plyometric drills, strength and conditioning exercises, stretching, and related physical activity, carries inherent risks. These risks include, but are not limited to: muscle strains and tears, ligament and tendon injuries, sprains, fractures, joint injuries, cardiovascular events, dehydration and heat-related illness, falls, collisions with other participants, and other physical injury, temporary or permanent, including in rare cases death. I understand these risks exist whether or not reasonable safety precautions are taken.
2. Voluntary Participation
I affirm that my participation in the Program is entirely voluntary. I am solely responsible for assessing my own physical condition and fitness level before each session. I confirm that I know of no medical condition that would prevent my safe participation in strenuous physical activity, or, if such a condition exists, that I have consulted a physician and received clearance to participate. I agree to inform the coach, Ryan (BillianBuilt / ClubTrackSTPete), of any injury, illness, or condition that may affect my ability to safely participate, before each session begins.
3. Assumption of Risk
I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties (defined below) or others, and assume full responsibility for my participation. I understand that coaching cues, drill instructions, and exercise guidance provided during sessions are intended to support my training but do not eliminate the inherent risks of physical activity.
4. Release and Waiver of Liability
In consideration of being permitted to participate in the Program and to use the track facility, I, for myself and on behalf of my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue ClubTrackSTPete, BillianBuilt, Liquid Gold LLC, Ryan (in his individual and coaching capacity), and the facility owner/school whose track is used for the Program, together with their respective officers, employees, agents, and volunteers (collectively, the “Released Parties”), from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Program or while on the premises where the Program is conducted.
5. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of or related to my participation in the Program, whether caused by my negligence or otherwise.
6. Medical Treatment Authorization
I authorize ClubTrackSTPete staff to arrange for or administer first aid and to call emergency medical services on my behalf in the event of an injury or medical emergency during a session. I understand I am responsible for any costs associated with medical treatment or transport.
