Thank you for registering for the Cold Plunge Event! By signing this waiver, you acknowledge and accept the terms and conditions outlined below and assume all risks associated with participation.

1. Event Description
The Cold Plunge Event is a wellness experience that includes, without limitation: exposure to cold water, food and beverages offered at the event, physical activity, intravenous treatments, congregation of people, and other activities. Participation in this event is entirely voluntary and involves certain inherent risks that cannot be completely eliminated regardless of the care taken to avoid them.

2. Acknowledgment of Risks
I acknowledge and understand that participation in the Cold Plunge Event involves inherent and unpredictable risks, including but not limited to:

Physical Risks: Cold shock, hypothermia, hyperthermia, frostbite, exhaustion, heat stroke, eye, bone, or joint injuries, concussions, loss of consciousness, scratches, bruises, sprains, drowning, slippery surfaces causing falls, malfunctioning cold plunge equipment, muscle cramps, nerve damage, and other injuries.
Food and Beverage Risks: Choking, foodborne illnesses, allergic reactions, adverse reactions, or contamination. Participants are responsible for verifying the safety of food and beverages they consume. Cool Beans Social Club is not liable for third-party vendor services.
Environmental Risks: Weather conditions, outdoor debris, uneven terrain, wet surfaces, insects, wildlife encounters, and other environmental hazards.
Equipment Risks: Electrical malfunctions, burns, improper use of cold plunge or IV equipment, and unanticipated defects or failures in provided equipment.
Other Risks: Minor and severe burns, exacerbation of pre-existing conditions, exposure to COVID-19 or other pathogens, dizziness, dehydration, cardiac events (e.g., heart attacks, strokes), fainting, paralysis, or electrocution from electrical equipment.
Mental and Emotional Risks: Discomfort, anxiety, or distress from exposure to cold water or other activities.
Unknown Risks: Other risks may not yet be known but may include, without limitation, unforeseen physical, environmental, or health-related issues.
I acknowledge that these risks may result in injury, illness, permanent disability, or death and voluntarily assume all such risks.

3. Waiver of Liability, Including Negligence
In consideration of being allowed to participate in the Cold Plunge Event:

I hereby release, waive, and discharge Cool Beans Social Club, its officers, employees, agents, contractors, affiliates, and volunteers (collectively, "the Released Parties") from any and all liability, claims, or demands arising from or related to my participation in the event, including, but not limited to, liability arising from the negligence of the Released Parties.
I understand and agree that this waiver includes any claims based on the negligent actions or omissions of the Released Parties, including but not limited to negligent supervision, maintenance of facilities, or operation of the event, to the fullest extent permitted by law.
I further agree to indemnify and hold harmless the Released Parties from any claims, damages, or losses arising out of my participation, including attorney’s fees and costs.
4. Health Requirements and Representation
By signing this agreement, I represent, warrant, and declare the following:

I have fully considered the risks associated with participating in the event.
I do not have any health or medical condition or personal sensitivity that might be exacerbated by participation.
I have consulted with my medical provider about my participation or have knowingly decided not to consult a medical provider.
I am making an informed decision to participate in the event despite the potential risks.
Cool Beans Social Club strongly recommends that participants consult a medical professional prior to engaging in activities such as cold plunges or intravenous treatments.

5. Safety Instructions
I agree to follow all safety instructions provided by event organizers, including but not limited to:

No jumping into the plunges.
No overexposure to cold temperatures (time limits will be enforced).
No pushing others into the water.
Participants must adhere to guidelines for intravenous treatments and cold exposure, including recommendations for individuals with heart conditions, pregnant individuals, or other contraindications.
Failure to follow these instructions may result in removal from the event.

6. Emergency Medical Consent
In the event of a medical emergency, I consent to receive medical treatment deemed necessary by event organizers. I understand that I am solely responsible for all associated costs. I acknowledge that emergency services may not be immediately available and accept all risks associated with this.

7. Publicity Release
I grant Cool Beans Social Club permission to use photographs, videos, or other recordings of me taken during the event for promotional or marketing purposes without compensation or further notice. by attending you agree that your provided information( including email) may be used for event communications, promotions and marketing purposes. your data may be shared with event partners but will be always handled responsibly. opt out anytime.

8. Severability
If any provision of this waiver is deemed unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law
This agreement shall be governed by and construed under the laws of the State of Florida, without regard to its conflict of law principles.

10. Consent to Electronic Signature
I agree that my electronic signature on this waiver is legally binding as if signed in person.

11. Force Majeure
Cool Beans Social Club shall not be held liable for any delays, interruptions, or cancellations of the event caused by circumstances beyond their control, including but not limited to acts of God, government restrictions, natural disasters, or public health emergencies.

12. Acknowledgment of Understanding
By signing below, I acknowledge that I have read, understood, and agree to this waiver and release. I am aware that this is a legally binding document and that by signing it, I am waiving certain legal rights, including the right to sue, even for negligence on the part of the Released Parties.
