DAY//SHIFT Festival Waiver & Release of Liability

By purchasing a ticket and/or attending DAY//SHIFT Festival, I acknowledge and agree to the following terms and conditions:

Assumption of Risk

I understand that participation in fitness classes, workouts, wellness activities, recreational activities, recovery services, demonstrations, and festival experiences involves inherent physical risks, including but not limited to muscle strains, falls, dehydration, dizziness, illness, allergic reactions, equipment-related injuries, serious injury, permanent disability, or death.

I understand that certain activities and activations at DAY//SHIFT Festival may involve strenuous physical activity, use of fitness equipment, exposure to outdoor weather conditions, bodywork or recovery modalities, and participation in activities led by independent instructors, vendors, or wellness providers.

I voluntarily choose to participate in all activities at my own risk and certify that I am physically capable of participating. I understand it is my responsibility to consult with a physician prior to participation if necessary.

Release of Liability

In consideration of being allowed to participate in DAY//SHIFT Festival, I hereby release, waive, discharge, and hold harmless M’Bodied Mvmt LLC, DAY//SHIFT Festival, Marisa Winslow, event staff, instructors, DJs, performers, volunteers, sponsors, vendors, wellness providers, venue partners, contractors, and affiliates from any and all liability, claims, demands, damages, costs, expenses, or causes of action arising out of or related to any injury, illness, loss, damage, accident, delay, or participation in the event, whether caused by negligence or otherwise, to the fullest extent permitted by law.

Independent Vendor & Service Disclaimer

I understand that certain products, services, food, beverages, wellness treatments, recovery services, demonstrations, and activations are provided by independent third-party vendors, sponsors, and service providers.

DAY//SHIFT Festival and M’Bodied Mvmt LLC are not responsible for the actions, products, services, advice, treatments, or conduct of independent vendors, food trucks, sponsors, instructors, or third-party participants.

Medical Treatment Authorization

I authorize DAY//SHIFT Festival staff, emergency personnel, and medical providers to obtain or provide medical treatment deemed necessary in the event of injury, illness, accident, or emergency during the festival. I understand that I am solely responsible for any medical expenses incurred.

Outdoor Event & Weather Policy

I understand that DAY//SHIFT Festival is an outdoor event and that weather, environmental conditions, or unforeseen circumstances may affect festival operations, schedules, performances, classes, vendors, or activities.

DAY//SHIFT Festival reserves the right to modify, postpone, pause, relocate, or cancel portions of the event at any time for safety, operational, weather-related, or unforeseen reasons without liability.

Photo & Video Release

I understand that DAY//SHIFT Festival may be photographed, filmed, or otherwise recorded for promotional, advertising, marketing, social media, and commercial purposes.

By attending the festival, I grant M’Bodied Mvmt LLC and DAY//SHIFT Festival permission to use my image, likeness, appearance, voice, and participation in any photographs, videos, livestreams, recordings, or promotional materials without compensation or approval rights.

Personal Responsibility & Conduct

I agree to conduct myself respectfully and safely throughout the festival. I understand that DAY//SHIFT Festival reserves the right to deny entry or remove any attendee for unsafe, disruptive, threatening, illegal, intoxicated, or inappropriate behavior without refund.

Ticket Policy

All ticket sales are final. No refunds, exchanges, or transfers will be issued unless otherwise determined by DAY//SHIFT Festival organizers.

Age Requirement & Minor Participation

DAY//SHIFT Festival is open to attendees ages 16 and older.

Attendees under the age of 18 must have permission from a parent or legal guardian to attend and participate in festival activities. By purchasing a ticket for a minor attendee, the parent or legal guardian acknowledges and agrees to the terms of this waiver on behalf of the minor participant and accepts responsibility for the minor’s participation.

Acknowledgment & Agreement

By purchasing a ticket, signing this waiver, and/or attending DAY//SHIFT Festival, I acknowledge that I have carefully read and fully understand this Waiver & Release of Liability. I understand that this agreement is legally binding and that I voluntarily agree to its terms.
