RELEASE OF LIABILITY AND ASSUMPTION OF RISK

I agree to all the terms and conditions stated in this document
Assumption of Risk: I acknowledge that the Activity involves potential dangers, including
personal or psychological injury, pain, suffering, temporary or permanent disability, death,
property damage, and/or financial loss. I understand that any injuries I might sustain could be
caused by the Company&#39;s actions, omissions, or negligence, including emergency response or
rescue operations. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM
KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN
EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND AGREE TO
ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH,
AND/OR PROPERTY DAMAGE ARISING FROM THE ACTIVITY, WHETHER
CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE.
Waiver and Release: I waive and release all present and future claims against the Company,
arising from any injury, disability, death, or property damage linked to my participation in the
Activity. I commit to not bring any such claims against the Company and release them from
liability for such claims, except for gross negligence, willful misconduct, or claims that
California law prohibits releasing through an agreement.
Photo Release: Client hereby grants Company and its affiliates, including but not limited to
trainers, instructors, and marketing personnel, the irrevocable and unrestricted right to use,
reproduce, and distribute any photographs, images, or likenesses of the Participant taken during
training sessions, fitness classes, events, or promotional activities, for marketing, promotional, or
informational purposes. These materials may be used in various media including, but not limited
to, websites, social media, brochures, and advertisements. The Participant releases and
discharges Company from all claims and demands arising out of or in connection with the use of
said photographs, images, or likenesses.
Indemnification: I shall defend, indemnify, and hold the Company harmless from any losses,
damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards,
penalties, fines, costs, or expenses (including reasonable attorney fees and the costs of enforcing
indemnification rights under this Release) resulting from third-party claims related to my
participation in the Activity, including claims related to my own negligence or the Company&#39;s
ordinary negligence.
Entire Agreement and Governing Law: This Release constitutes the entire agreement between
the Company and me regarding its subject matter, superseding all prior agreements. If any
provision is invalid or unenforceable in one jurisdiction, it won&#39;t affect other provisions or its
validity in another jurisdiction. This Release binds the Company and me, as well as our heirs,
successors, and assigns. All matters concerning this Release are governed by the laws of the
State of [AZ], and any disputes must be brought in the federal and state courts.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF
THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP
SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.  I
AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT.
