COMPREHENSIVE EVENT PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PHOTOGRAPHY CONSENT

DISCLAIMER:

DiscoFit Collective LLC, its founders, staff, employees, and instructors (collectively referred to as "Releasees") are not liable for any injury, illness, disability, death, property damage, or other harm ("Losses") sustained by any person participating in events, activities, classes, or programs ("Events") hosted, organized, or listed by DiscoFit Collective LLC, including those on the DiscoFit Collective website, social media, or any associated platforms.

In consideration of my acceptance and participation in Events organized by DiscoFit Collective LLC, or listed on the DiscoFit Collective website, social media, or any associated platforms, I hereby release, indemnify, and agree not to sue the Releasees for any present or future claims, causes of action, Losses, liabilities, demands, lawsuits, costs, and expenses (including attorney fees) arising from ordinary negligence, strict liability, breach of contract, or any other legal theory, related to or arising from my participation in the Events.

I understand and acknowledge the inherent risks and dangers associated with physical exercise and participation in Events. These risks include but are not limited to, bodily injury, trauma, strains, sprains, fractures, dislocations, cardiovascular complications, respiratory issues, allergic reactions, dehydration, heat-related illnesses, communicable diseases (including but not limited to COVID-19), and death.

I understand that the Releasees do not provide medical or healthcare services, and I affirm that I am solely responsible for consulting with a physician or other qualified healthcare professional before participating in any Events, especially if I have any underlying medical conditions, disabilities, or special needs that may affect my ability to safely participate.

COVID-19:

I am aware of the ongoing risks associated with COVID-19 and understand that participation in Events carries the potential risk of exposure to the virus. I acknowledge that guidelines, regulations, and recommendations from health authorities may change rapidly and that I am responsible for staying informed and following appropriate safety measures. I voluntarily assume all risks related to COVID-19 and release the Releasees from any claims or liabilities associated with exposure or transmission.

RELEASE OF LIABILITY:

I hereby waive, release, discharge, and covenant not to sue the Releasees from any and all claims, liabilities, demands, causes of action, Losses, injuries, or damages of any kind arising from my participation in the Events. This release extends to any claim or cause of action arising directly or indirectly out of any negligent act or omission, breach of duty, strict liability, or other legal theory related to the Events.

ASSUMPTION OF RISK:

I acknowledge and understand that my participation in the Events involves inherent risks and dangers, both known and unknown, and I voluntarily assume full responsibility for all risks, whether specifically identified or not. I acknowledge that I have had the opportunity to ask questions, seek clarifications, and discuss any concerns related to the risks associated with the Events.

HEALTH DECLARATION:

I confirm that:

I am physically fit and do not have any medical conditions that would put me at risk while participating in the event.

I have not been advised by a medical professional to refrain from physical activity.

If I experience discomfort, pain, dizziness, or any medical issue during the event, I will stop immediately and seek assistance.

PHOTOGRAPHY CONSENT:

I consent to being photographed, videotaped, or filmed during the Events by DiscoFit Collective LLC, its representatives, or other authorized personnel. I grant DiscoFit Collective LLC, its legal representatives, and assignees the unrestricted right and permission to copyright, use, publish, reproduce, or distribute my images, including photographs, videos, or audio recordings, for promotional, advertising, educational, or other lawful purposes. I waive any rights to inspect or approve the finished products.

I understand that the Releasees are under no obligation to use my images and that any commercial use of my images will not entitle me to compensation or remuneration.

GENERAL PROVISIONS:

I understand and agree that this waiver and release of liability is binding upon my heirs, executors, administrators, personal representatives, and assigns. I acknowledge that this agreement is intended to be as broad and inclusive as permitted by applicable laws and that if any portion is held invalid, the remainder will continue in full legal force and effect.

I acknowledge that I have carefully read this comprehensive waiver, release of liability, assumption of risk, and photography consent agreement and fully understand its contents. I voluntarily agree to its terms and acknowledge that I have given up substantial rights by signing this document.
