Nightcrawl X is taking the concept of nightlife fitness further by expanding across new fitness disciplines and new locations, but keeping the same underground energy. ERG PRESSURE ROOM kicks off the party in the heart of downtown by turning ERG rowing into a dark, team-based endurance showdown!

Teams of five rotate on the ERGs throughout an incredible DJ set, stacking as many meters as possible before the last song ends.

It sounds simple, but it wont feel simple. The atmosphere is going to be tighter, louder, darker, and more explosive than any nightcrawl so far! You will feel like you are traveling through space!

Liability Waiver and Release of Liability Agreement
This Waiver and Release of Liability Agreement (“Agreement”) is entered into between the undersigned participant (“Participant”) and 37429 LLC (dba “Nightcrawl”), its owner and certified trainer Matthew Shepherd, Downtown Strength and Conditioning, and all venue owners, landlords, lessors, operators, managers, and affiliated entities associated with the facility, as well as their respective officers, members, managers, employees, contractors, agents, representatives, volunteers, insurers, affiliates, and successors (collectively, the “Releasees”).

1. Event Description
Nightcrawl ERG (Row) is a team-based indoor rowing and ski-erg competition that combines endurance exercise with music, lighting, and a high-energy atmosphere. The event involves continuous rowing and ski-erg activity over a fixed time window, with teams rotating on and off assigned Concept2 rowing and ski-erg machines to accumulate total distance.
The event is conducted indoors at Downtown Strength and Conditioning (Miami, Florida) in a darkened, tightly packed environment with amplified music, dim or colored lighting, limited visibility, and brief use of strobe or pulsing light effects at designated moments.
Participants may be in close proximity to other participants, equipment, spectators, and staff throughout the event.

2. Acknowledgment of Age, Fitness, and Medical Clearance
I affirm that I am at least 18 years old. Minors are not permitted.


I affirm that I am in good physical condition and medically cleared to participate in strenuous cardiovascular and endurance exercise, including prolonged rowing and ski-erg activity.


I will not participate if I have any injury, illness, medical condition, or physical limitation that could be aggravated by participation, including but not limited to heart conditions, respiratory conditions, joint issues, fainting risk, or sensitivity to flashing lights.



3. Exercise Proficiency and Participant Responsibilities
I certify that I understand and am familiar with proper rowing and ski-erg technique, including safe mounting, dismounting, handle control, foot retention, damper use, and pacing.


I agree to follow all instructions, demonstrations, and safety guidance provided by event staff, MCs, and trainers.


I understand that team rotations are self-managed, and I am responsible for entering and exiting machines safely and attentively.


I acknowledge that failure to follow instructions or safe conduct may result in removal from the event without refund.



4. Assumption of Risk and Inherent Dangers
I understand and voluntarily accept that participation involves inherent risks, including but not limited to:
Slips, trips, or falls due to sweat, darkness, cables, or floor conditions


Collisions or contact with other participants due to tight spacing or low visibility


Muscle strains, tendon injuries, joint injuries, overuse injuries, or rhabdomyolysis


Cardiovascular events, dizziness, fainting, dehydration, or overexertion


Equipment malfunction, misuse, or unexpected resistance changes


Finger, hand, foot, or shin injuries while mounting or dismounting ERG machines


Hearing damage or sensory disorientation due to loud music


Disorientation or seizure risk due to dim lighting or strobe effects


Delayed emergency response due to lighting, noise, or crowd density


Transmission of communicable diseases, including COVID-19 or other illnesses


I voluntarily assume all known and unknown risks associated with participation and accept full responsibility for any injury, loss, or damage I may suffer.

5. Release and Waiver of Liability
In consideration of being permitted to participate, I hereby release, waive, discharge, and covenant not to sue the Releasees from any and all claims, demands, causes of action, or liabilities arising out of or related to my participation in the event, including claims based on negligence, to the fullest extent permitted by Florida law.
This release includes claims for personal injury, death, property damage, or economic loss.
This waiver does not apply to gross negligence or intentional misconduct where prohibited by law.

6. Indemnification and Defense
I agree to indemnify, defend, and hold harmless the Releasees from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:
My actions or omissions during the event


My failure to follow instructions or safety protocols


Any injury or damage I cause to other participants, spectators, staff, or property



7. Emergency Care and Medical Treatment
I understand that limited first aid may be available but is not a substitute for professional medical care.


I authorize event staff to obtain emergency medical treatment on my behalf if deemed necessary.


I accept full financial responsibility for any medical services rendered.


I agree to disclose relevant medical conditions during registration if applicable.



8. Media Release
I grant permission to 37429 LLC and its affiliates to use my name, image, likeness, and voice in photographs, video, or other media for promotional, marketing, or commercial purposes without compensation or approval rights.

9. Personal Property
I acknowledge that I am solely responsible for my personal belongings. The Releasees are not responsible for loss, theft, or damage to personal property.

10. No Refund Policy
All registration fees are final, non-refundable, and non-transferable, regardless of attendance or event cancellation due to circumstances beyond the Releasees’ control.

11. Governing Law, Venue, and Severability
This Agreement shall be governed by the laws of the State of Florida.


Any dispute shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.


If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.

By accepting this Agreement, I confirm that:

I voluntarily assume all risks associated with participation


I agree to be legally bound by its terms


This electronic acceptance is valid and enforceable as a handwritten signature
