Plunge Boston, LLC880 Broadway St, Suite M, Saugus, MA 01906WAIVER AND RELEASE OF LIABILITY
1. Assumption of Risk - I acknowledge and understand that participating in activities at Plunge Boston, LLC (the Facility), including but not limited to cold plunge therapy, sauna therapy, red light therapy, Normatec compression, mobility exercises, and physical therapy (collectively, the Activities), involves inherent risks. These risks include but are not limited to physical or psychological injury, illness (including communicable diseases), disfigurement, disability, death, property damage, theft, or other loss arising from participation. I voluntarily assume all risks associated with these Activities, whether known or unknown, even if arising from the negligence of Plunge Boston, LLC or its representatives.

2. Release of Liability - I hereby release, discharge, and hold harmless Plunge Boston, LLC, its owners, officers, employees, agents, contractors, volunteers, successors, and assigns (Released Parties) from any and all liability, claims, or causes of action arising out of or related to my participation in the Activities, including but not limited to injuries, illnesses, or damages caused by the negligence of the Released Parties or third parties.

3. Indemnification - I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, or expenses (including attorney's fees) arising out of or related to my participation in the Activities or breach of this Waiver and Release.

4. Health and Safety - I certify that I am in good health and have no medical condition that would prevent safe participation in the Activities. I agree to the following Facility policies:
Cold Plunge Tubs: Chlorinated and maintained regularly. I will not use the tubs if I have any open wounds, bacterial, viral, or fungal infections, or other contagious conditions.
Saunas: Designed for safe use but should not be used beyond personal tolerance levels.
Red Light Therapy Rooms, Mobility Area, and Normatec Lounge: Used at my own discretion and risk.
Cleaning and Sanitation: Equipment is cleaned regularly to ensure safety and hygiene.
Wet Areas: I understand and accept that floors and other surfaces may be wet or slippery due to the nature of the Activities. I assume all risks associated with slipping or falling and agree to exercise caution while moving through the Facility, especially in designated wet areas.
Allergies and Sensitivities: I understand that sanitizing chemicals, such as chlorine or bromine, are used in the tubs and may cause adverse reactions. I agree to discontinue use if I experience any such reactions.

5. Pre-Existing Medical Conditions - I certify that I have consulted a physician and disclosed any pre-existing medical conditions, such as cardiovascular issues or other conditions impacted by extreme temperatures, before participating. I accept full responsibility for any health complications arising from undisclosed conditions.

6. Shared Spaces and Communicable Conditions - I acknowledge that the Facility operates in shared spaces. While Plunge Boston, LLC follows strict cleaning protocols, I accept the risk of exposure to communicable illnesses or conditions due to the shared nature of the Facility.

7. Use of the Facility and Personal Property - I understand that all equipment and facilities are used at my own risk. Plunge Boston, LLC is not responsible for theft, loss, or damage to personal belongings brought into the Facility.

8. Online Payments and Memberships - Plunge Boston, LLC uses a third-party platform, Vagaro, for online payments, membership management, and scheduling. I acknowledge that Plunge Boston, LLC does not store payment information and is not liable for any issues, including but not limited to data breaches or errors, arising from Vagaros services.

9. Emergency Response - I acknowledge that Plunge Boston, LLC does not provide on-site medical personnel. In the event of a medical emergency, staff may assist in contacting emergency services but are not liable for any delays or outcomes.

10. Facility Rules and Participant Obligations
Appropriate Conduct: I agree to abide by all posted rules and staff instructions. Failure to comply may result in removal without refund.
Alcohol and Drugs: Participation while under the influence of drugs or alcohol is strictly prohibited.
Weight Limitations: I agree not to use equipment beyond its designated capacity.
Clothing Requirements: I agree to wear proper swimwear or clothing specifically designed for use in cold plunge tubs and saunas

11. Property and Facility Damage - I agree to assume responsibility for any damages caused by my actions or negligence to Facility property and agree to reimburse Plunge Boston, LLC for repair or replacement costs.

12. Governing Law and Severability - This Waiver and Release shall be governed by the laws of the Commonwealth of Massachusetts. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

13. Acknowledgment of Understanding - I have read and fully understand this Waiver and Release. By signing, I acknowledge that I am waiving certain legal rights and agree to all terms.
