FEARLESS RUN CLUB ATX
PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK
By registering for or participating in any Fearless Run Club ATX event, including trail runs, walks, group workouts, meetups, and related activities, I acknowledge and agree to the following:
1. ASSUMPTION OF RISK & TRAIL SAFETY
I understand that running and walking on trails involve inherent risks, including falls, collisions, uneven terrain, rocks, roots, loose gravel, mud, wildlife, extreme heat, humidity, rain, lightning, dehydration, overexertion, serious injury, permanent disability, or death.
I voluntarily assume all known and unknown risks associated with my participation. I confirm that I am physically capable of participating, accept responsibility for my fitness level, hydration, footwear, and personal safety, and agree to stop if I experience concerning symptoms.
2. RELEASE OF LIABILITY
To the fullest extent permitted by Texas law, I release, waive, and discharge Fearless Run Club ATX, its owners, organizers, run leaders, volunteers, sponsors, partners, affiliates, and representatives from claims, liabilities, damages, or expenses arising from my participation, including claims based on ordinary negligence, to the extent legally permitted.
I understand that this release is intended to cover certain legal claims I might otherwise have against the released parties.
3. PACE GROUPS & PARTICIPANT RESPONSIBILITY
I understand that pace groups, including 11-, 12-, 13-, and 14-minute-per-mile groups, and walking groups are informal guidelines, not guaranteed paces or individual supervision. I am responsible for selecting a group appropriate for my abilities and may slow down, stop, or withdraw at any time.
I agree to follow reasonable safety instructions from run leaders and volunteers and remain aware of my surroundings.
4. EMERGENCIES & MEDICAL AUTHORIZATION
I understand that Fearless Run Club ATX is a community running and walking group, not a medical or emergency-response organization. Organizers and volunteers may not be able to monitor every participant or provide immediate assistance, and emergency response may be delayed on trails.
If I am unable to provide consent during an emergency, I authorize organizers or representatives to seek emergency medical assistance on my behalf. I accept responsibility for medical, transportation, and related expenses incurred.
5. PHOTO & VIDEO RELEASE
I grant Fearless Run Club ATX permission to photograph and record my image, likeness, and voice during events and use such materials for social media, promotional materials, and other club-related purposes without compensation.
6. DOGS, MINORS & PARTICIPANT CONDUCT
If I bring a dog or other pet, I agree to keep it leashed and under control, clean up after it, and accept responsibility for any injury or damage it causes.
Participants under 18 must have the required parent or legal guardian permission and comply with event age restrictions and supervision requirements. Nothing in this waiver is intended to waive a minor's independent legal claims.
I agree to behave respectfully toward other participants, volunteers, and park users and to follow applicable park rules and event safety guidelines.
7. ACKNOWLEDGMENT & AGREEMENT
I have carefully read and understand this waiver. I understand that I am voluntarily participating in Fearless Run Club ATX activities and that this agreement releases certain legal rights, including claims involving ordinary negligence to the extent permitted by law.
By submitting my RSVP or participating in a Fearless Run Club ATX event through SweatPals, I acknowledge that I have read, understood, and voluntarily agree to this waiver.
