Final Miles is our official pre-race shakeout bringing the Miami running community together one last time before race day. We’ll meet at Shoe Gallery for a short shakeout, then hang, fuel up, and soak in the energy with runners from across the city.

ASSUMPTION OF RISK WAIVER AND RELEASE OF CLAIMS
For purposes of this document, “Assumption of Risk Waiver and Release of Claims” (hereinafter, “Waiver”), 

“Event” means any indoor or outdoor group run, social gathering, panel, activation, cheer zone, social function, or other event of any kind organized by, hosted by, sponsored by, relating to, or involving HERD LLC, J.E.D.E. Land Holdings, Shoe Gallery Inc., HOKA LLC, and/or Deckers Outdoor Corporation (each, a “Company,” and collectively, the “Companies”).
 
“Participant” means any individual competing, observing, cheering, running, walking, volunteering, or otherwise participating in or present at an Event.
 
“Parent/Guardian” means any parent or other legal guardian of a Participant under the age of 18.
In consideration of the opportunity to participate in the Event, I, the Participant or Parent/Guardian, acknowledge and agree that:

1. ASSUMPTION OF RISK
Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death and/or illness), property loss or damage, and minor to severe economic or noneconomic losses. These risks may result from my own actions or inactions, the actions or inactions or negligence of others, or the condition of the premises, equipment, or environment.

There may be other risks not known to me and not reasonably foreseeable at this time. I understand and have considered and evaluated the nature, scope, and extent of the risks involved, and I voluntarily choose to assume all such risks, both known and unknown, including those arising from the negligence of the Released Parties (defined below) or others, and I assume full responsibility for my participation in the Event.

I warrant that the Participant is physically and mentally able to participate in the Event. I consent to medical treatment for the Participant in the event of an emergency or other incident in which, in the reasonable judgment of on-site personnel, medical care is required. I agree to pay all costs associated with such medical care and to indemnify and hold harmless the Released Parties from any costs or claims arising from such medical care.


2. RELEASE FROM LIABILITY

I, for myself and on behalf of my heirs, estate, insurers, successors, and assigns, fully and forever release and discharge:
HERD LLC


J.E.D.E. Land Holdings


Shoe Gallery Inc.


HOKA LLC


Deckers Outdoor Corporation


Arlo Hotels


and each of their respective past, present, and future parents, subsidiaries, affiliates, officers, directors, shareholders, members, employees, agents, contractors, representatives, volunteers, sponsors, advertisers, insurers, successors, and assigns, as well as all owners or lessors of premises used in connection with an Event
 (collectively, the “Released Parties”), from any and all injuries (including death and/or illness), losses, damages, claims (including claims based on negligence), demands, lawsuits, expenses, or liabilities of any kind, whether known or unknown, foreseen or unforeseen, arising directly or indirectly out of or in connection with my participation in or attendance at the Event.


3. AGREEMENT NOT TO FILE SUIT
I agree not to institute any lawsuit or other legal proceeding against any of the Released Parties for any injury, loss, damage, or expense arising out of or related to my participation in or attendance at the Event.


4. AUTHORIZATION TO RECORD AND USE LIKENESS
I grant the Released Parties the irrevocable right to photograph, film, video record, or otherwise record my name, image, likeness, voice, appearance, and biographical information during the Event (“Recording”), and to use such Recordings, in whole or in part, in any media now known or later developed, for any lawful purpose, including but not limited to marketing, promotional, and commercial uses, without further consent or compensation.


5. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, costs, expenses, or liabilities (including reasonable attorneys’ fees) arising from or related to my participation in the Event or breach of this Waiver.


6. NO ORAL MODIFICATION
This Waiver may not be altered or modified except in a written document signed by an authorized representative of the Released Parties.


7. SEVERABILITY
If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


8. ELECTRONIC ACKNOWLEDGEMENT
I understand that my electronic signature or acknowledgement of this Waiver is legally binding and equivalent to a handwritten signature.

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
