Flow Fests - RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT

By signing this Release, Waiver of Liability, and Indemnity Agreement, the Participant named above wishes to participate in the event described below and recognizes that there are risks of damage or injury arising from participation in this event or from other activities that may be associated with participation in this event:  
        
The undersigned Participant at the Flow Fests event is aware that the Participant’s participation in Yoga, Poi Spinning, Dance, Hoop Dance, Juggling, Object Manipulation, and Movement Workshops may result in accident and/or bodily injury.  By the Participant’s signature below, or by the signature of the Participant’s parent/guardian, and in consideration of being permitted to participate, the Participant, or the Participant’s parent/guardian on behalf of the Participant, voluntarily agrees to assume and/or incurs all risks of loss, impairment, damage or injury of whatever kind, including bodily injury, mental injury, and/or death, that may be sustained or suffered by participation in Yoga, Poi Spinning, Dance, Hoop Dance, Juggling, Object Manipulation, and Movement Workshops at the Flow Fests event, whether or not the result is in whole or in part from the acts or omissions, negligence or other unintentional fault of the event sponsor, including Casandra Tanenbaum, Monkey Dust Productions, LLC, property owners, and/or the participating instructors and/or vendors.  The Participant discharges and covenants not to sue Casandra Tanenbaum, Monkey Dust Productions, LLC, Flow Fests event volunteer staff members, property owners, and/or the participating vendors or instructors, each of them their officers and employees, all referred to as releasees, from all liability to and any claim or damage therefore on account of injury to the Participant or resulting in death of the Participant whether caused by the negligence of the releasees or otherwise while Participant is participating in Yoga, Poi Spinning, Dance, Hoop Dance, Juggling, Object Manipulation, and Movement Workshops.  The Participant also represents that the Participant is in good health and suffers from no physical impairment that may cause or contribute to any resulting bodily injury from participating in Yoga, Poi Spinning, Dance, Hoop Dance, Juggling, Object Manipulation, and Movement Workshops at the Flow Fests event. Participant acknowledges and is aware that the participating instructors, vendors and the event sponsors and Monkey Dust Productions, LLC have not and will not render any medical services including medical diagnosis of the Participant’s physical condition.

The undersigned Participant is aware and acknowledges that many children will be present at the Flow Fests event.  The Participant further acknowledges that the Participant is completely responsible for the Participant’s child or children.  By the Participant’s signature below, or by the signature of the Participant’s parent/guardian, and in consideration of being permitted to participate at Flow Fests event the Participant, or the Participant’s parent/guardian on behalf of the Participant, voluntarily agrees to assume and/or incurs all risks of loss, impairment, damage or injury of whatever kind, including bodily injury, mental injury, and/or death, that may be sustained or suffered by the undersigned’s child or children at Flow Fests event, whether or not the result is in whole or in part from the acts or omissions, negligence or other unintentional fault of the event sponsor, including Monkey Dust Productions, LLC, Flow Fests staff, property owners, and/or the participating vendors or instructors.  The Participant discharges and covenants not to sue Casandra Tanenbaum, Monkey Dust Productions, LLC, Flow Fests volunteers, Flow Fests staff, property owners, and/or the participating vendors or instructors, its officers and members, instructors, owners and lessees of the premises, each of them their officers and employees, all referred to as releasees, from all liability to and any claim or damage therefore on account of injury to the Participant’s child or children or resulting in death of the Participant’s child or children whether caused by the negligence of the releasees or otherwise while the Participant’s child or children are present at the Flow Fests event.  The Participant also represents that the Participant’s child or children are in good health and suffers from no physical impairment which may cause or contribute to any resulting bodily injury from participating at Flow Fests event.  

Participant acknowledges and is aware that the participating instructors, vendors and the event sponsor, Monkey Dust Productions, LLC, have not and will not render any medical services including medical diagnosis of the Participant’s child or children’s physical condition.

In the event that the Participant, or the Participant’s child or children, breaks or damages any property or material of any kind at the Flow Fests event, the Participant, and/or his parent/ guardian, is responsible for monetary replacement of the damaged property or material.

By the Participant’s signature below, or by the signature of the Participant’s parent/guardian, and in consideration of being permitted to participate, the Participant, or the Participant’s parent/guardian on behalf of the Participant, voluntarily waives all rights of ownership to any written, photographic or video use (whether in written or electronic form) of the Participant’s name, image or representation (“Data”), and hereby grants permission for the publication, announcement and/or distribution of said Data thereof by instructors, vendors and the event sponsor Monkey Dust Productions, LLC, Casandra Tanenbaum, participating at Flow Fests event. I understand that my participation may be recorded and agree that using photographs and video footage does not constitute a violation of my personal rights and hereby release any claims for the use of such without further consideration.

In consideration of being permitted to attend Flow Fests event, the Participant, or the Participant’s parent/guardian, (including his/her heirs, assigns and personal representatives) agrees to release, hold harmless, and indemnify, Monkey Dust Productions, LLC, Casandra Tanenbaum, from and against any claims, demands, actions, causes of action, lawsuits, expenses or losses (including attorneys’ fees) on account of property damage or personal injury (including death) arising out of or attributable to the Participant’s attendance at Flow Fests event.  Participant agrees to indemnify Casandra Tanenbaum, Monkey Dust Productions, LLC from any loss, liability, damage or costs, including attorneys’ fees he may incur due to the attendance of Participant at Flow Fests event, whether caused by negligence of releasees or Casandra Tanenbaum, Monkey Dust Productions, LLC or otherwise.

Participant agrees that this Release, Waiver of Liability, and Indemnity Agreement is intended to be as broad and inclusive as permitted by local, state and federal law and that if any portion of the Agreement is held invalid, it is agreed that the balance shall, not withstanding, continue in full force and effect.  This document contains the entire agreement between the parties and the terms of this document are contractual and not a mere recital.
