FOR THE PLOT SOCIETY — RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
Please read carefully. This is a legally binding agreement. By signing up and checking the box below, you agree to the following terms.
In consideration of being permitted to participate in any activities organized by For The Plot Society ("FTP"), including but not limited to weekly group runs and walks, social events, and any related gatherings (collectively, the "Activities"), I acknowledge and agree as follows:
1. Eligibility. I confirm that I am at least eighteen (18) years of age.
2. Assumption of Risk. I understand that the Activities involve physical exertion and inherent risks that could result in property damage, bodily injury, illness, permanent disability, or death. These risks include, but are not limited to: overexertion, dehydration, heat-related illness, cardiac events, slips, trips, and falls; uneven, wet, or hazardous surfaces; running or walking on or near public roadways and in traffic; weather conditions; the actions or inaction of other participants, spectators, dogs, or third parties; and the negligence of the released parties. I voluntarily and knowingly assume all such risks, both known and unknown, and accept full responsibility for my participation.
3. Physical Condition and Medical Care. I represent that I am physically fit and have no medical condition that would prevent my safe participation. I understand that FTP recommends I consult a physician before participating. I participate at my own risk and authorize FTP to seek emergency medical care on my behalf if needed, at my own expense.
4. Release and Waiver of Liability. To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and covenant not to sue For The Plot Society and its founder, organizers, hosts, volunteers, staff, sponsors, affiliated venues, and their respective owners, officers, agents, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action of any kind arising out of or related to my participation in the Activities, INCLUDING ANY SUCH LIABILITY, CLAIM, OR CAUSE OF ACTION CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, whether resulting in property damage, personal injury, illness, disability, or death. This release applies to me, my heirs, assigns, personal representatives, and next of kin.
5. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or connected to my participation, except to the extent caused by the gross negligence or willful misconduct of a Released Party.
6. Rules and Conduct. I agree to follow all reasonable safety instructions given by FTP organizers, to obey all traffic and pedestrian laws, and to conduct myself respectfully toward others. If I bring a dog, I accept full responsibility for its behavior and any injury or damage it may cause, and I agree to keep it leashed and under my control at all times.
7. Media Release. I grant FTP permission to use my likeness in photographs, video, and audio recordings taken during the Activities for promotional, marketing, and social media purposes, without compensation. If I do not wish to be included, it is my responsibility to notify an organizer in writing.
8. Governing Law. This agreement is governed by the laws of the State of Florida, and any dispute shall be brought exclusively in the state or federal courts located in Orange County, Florida.
9. Severability. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
10. Acknowledgment. I HAVE READ THIS RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I AGREE TO IT FREELY AND VOLUNTARILY.
