PILATES ADDICTION STANDARD LIABILITY WAIVER
The following contains important legal disclosures and proposed releases. It explains the risks the undersigned (“you”) are assuming by beginning the exercise program at Pilates Addiction (as defined below). It is critical that you read and understand it completely before you agree to it. This waiver is subject to, and incorporated by reference into, you Pilates Addiction Membership Agreement.
Assumption of Risk: You recognize that the exercise program might be difficult and strenuous and that there could be dangers inherent in the exercise program for some individuals. You represent and warrant that you are in good physical condition. You understand that if you are pregnant you should not be participating in the exercise program other than Pelvic Floor & Pregnancy Conditioning classes upon receipt of your doctor's consent to participate. You acknowledge that the possibilities of certain unusual physical changes during exercise do exist. These changes include abnormal blood pressure; fainting; disorders in heartbeat; heart attack; and, in rare instances, death. You understand that as a result of my participation in this exercise program, you could suffer an injury or physical disorder that could result in my becoming partially or totally disabled and incapable of performing any gainful employment or having a normal social life. You recognize that an examination by a physician should be obtained by all participants prior to involvement in any exercise program. You hereby agree that your participation in any Pilates Addiction exercise program is at your own risk You acknowledge and agree that you assume, with fill knowledge of, the potential risks associated with any and all activities and/or exercises in which you participate including temporary muscle soreness, fatigue, dizziness, joint or back discomfort, exacerbation of existing injuries, aggravation of spinal or postural conditions, strain or sprain of muscles or ligaments, nausea, cramping, minor bruising, and in rare cases, loss of balance or falls leading to injury. You acknowledge and agree that no warranties or representations have been made to me regarding the results You will achieve from this program. You understand that results are individual and may vary. YOU ACKNOWLEDGE THAT YOU HAVE THOROUGHLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING ANY RIGHT YOU OR YOUR SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST Pilates Addiction AND ITS REPRESENTATIVES.
You certify that you have adequate insurance with a U.S. insurance company to cover any injury or damage you may cause or suffer while participating. Otherwise, you agree to bear the costs of such injury or damage yourself. You further certify that you are willing to assume the risk of any medical or physical condition you may have.
COVID-19: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
Pilates Addiction cannot prevent you or others, including your children from becoming exposed to, contracting, or spreading COVID-19 while utilizing Pilates Addiction services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Pilates Addiction services and/or enter onto Pilates Addiction premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. You have read and understood the above warning concerning COVID-19.
You hereby choose to accept the risk of contracting COVID-19 for yourself and/or others, including your children, in order to utilize Pilates Addiction’ services and enter Pilates Addiction’ premises. These services are of such value to you that you accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize said services and premises in person rather than arranging for an alternative method of enjoying the same services virtually (e.g. videoconference). You hereby forever release and waive your right to bring suit against Pilates Addiction in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Pilates Addiction’ services and premises. You understand that this waiver means you give up your right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim you may have to seek damages, whether known or unknown, foreseen or unforeseen.
You understand and acknowledge that this agreement, as well as your interaction with and use of Pilates Addiction services will be governed by the substantive laws of the State of California without giving effect to any conflict of law principals. You agree that any action arising out of this Agreement or relating to your use of services provided by Pilates Addiction, must be brought exclusively in any state or federal court located in Los Angeles County, California and you hereby irrevocably consent and submit to the personal and exclusive jurisdiction of such courts and waive all objections thereto. You agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and affect.
Injury Waiver, Informed Consent, and Covenant Not to Sue: You have volunteered to participate in a program of physical exercise under the direction of various instructors at Pilates Addiction, which will include, but may not be limited to resistance training. In consideration of Pilates Addiction’ agreement to instruct, assist, and train you, you do forever release and discharge and hereby agree to indemnify and hold harmless Kunkel Pilates Holdings I, LLC dba PilatesAddiction East Austin (collectively, “Pilates Addiction”) and their respective officers, directors, agents, partners, shareholders, subsidiaries, affiliates, heirs, assigns, contractors, and employees (collectively, “Representatives”)  from any and all losses, damages, charges, costs, expenses (including reasonable outside attorneys’ and other professionals’ fees), liabilities, settlements, recoveries or judgments arising from or related to any claims, demands, rights of action or causes of action, present or future, arising out of or connected with your use of Pilates Addiction equipment or facilities and your participation in this or any exercise program including, without limitation, any injuries resulting therefrom. THIS WAIVER AND RELEASE OF LIABILITY INCLUDES, WITHOUT LIMITATION, INJURIES WHICH MAY OCCUR AS A RESULT OF (1) EQUIPMENT THAT MAY MALFUNCTION, DROP OR BREAK (2) ANY SLIP OR FALL AND (3) Pilates Addiction’ OR ANY OF THEIR REPRESENTATIVES’ NEGLIGENT INSTRUCTION OR SUPERVISION.
CALIFORNIA-SPECIFIC NOTICES:
Pursuant to California Civil Code § 1542, you expressly waive the provisions of that statute, which states:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
You acknowledge the enforceability of this waiver to the fullest extent permitted by California law and understand that minors must have their parent or legal guardian sign this agreement on their behalf.
CLASS ACTION WAIVER:
The parties agree that: (i) I will not bring any class action proceeding against Pilates Addiction; (ii) No proceeding hereunder, whether a consumer dispute or business dispute, shall be certified or proceed as a class action, or on any basis involving claims brought in a purported representative capacity on behalf of the general public, other customers, or similarly situated individuals; and (iii) No arbitration proceeding shall be consolidated with, or joined in any way with, any other arbitration proceeding.
THE PARTIES AGREE TO ARBITRATE ANY DISPUTE ON AN INDIVIDUAL BASIS AND EXPRESSLY WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.
IMAGE USE: You understand and agree that while on Pilates Addiction premises, your image—or the image of your minor child (including live or recorded video)—may be used on Pilates Addiction websites, promotional materials, or social media platforms (e.g., Facebook, Instagram, YouTube). By entering the premises, you consent to such use. You acknowledge that Pilates Addiction facilities may be monitored by continuous audio and video surveillance for security and training purposes.
WAIT LIST ALERT: You MUST "Opt In" to receive our emails in order to receive wait list notifications. If you do not Opt-In you will not receive confirmation that you have a reservation through our wait list but you will be responsible for all Late Cancels and/or No Shows you incur.
STUDIO PRECAUTIONS.
As you participate in any Pilates Addiction program you take full responsibility for your medical/health condition, to include but not limited to, any medications you may be taking which could result in a medical emergency or unsafe condition. You must know your own limitations and assume all risks associated with any activities you may engage in at Pilates Addiction. You further understand staff at Pilates Addiction should not be construed as a substitute for a medical examination, diagnosis, or treatment. You understand that the staff working at Pilates Addiction are not diagnosing, prescribing, or treating any physical or mental illness, and nothing said in the course of a session should be construed as such.
REDUCE SLIPPING AND FALLING: USE CAUTION WHEN IN A PILATES ADDICTION STUDIO. THE FLOOR MAY BE SLIPPERY AND DANGEROUS DUE TO MOISTURE. THERE IS NO RUNNING IN OUR FACILITY—PLEASE WATCH WHERE YOU ARE GOING AND PROCEED AT YOUR OWN RISK. ALL CLIENTS ARE REQUIRED TO WEAR PROPER FOOTWEAR, SPECIFICALLY GRIP SOCKS, DURING CLASSES TO MINIMIZE THE RISK OF SLIPPING AND ENSURE A SAFE WORKOUT ENVIRONMENT.
IF ANY OF THE BELOW APPLY TO YOU, CONSULT YOUR PHYSICIAN PRIOR TO PARTICIPATION IN ANY PILATES ADDICTION PROGRAMS:
Medications. Individuals who are using prescription drugs should seek the advice of their physician or a pharmacist before participating in Pilates Addiction programs. 
Proper Hydration and Consumption of Food. In all situations, it is required that you be hydrated for your program. You must have appropriately nourished your body before your program as well. Failure to do so could result in lightheadedness or unconsciousness.
Jewelry. Any hanging jewelry should be removed before beginning any exercise program.
Hemophiliacs / Individuals Prone To Bleeding. Participation in any Pilates Addiction program should be avoided by anyone who is predisposed to bleeding.
Fever. An individual with a fever should not participate in any Pilates Addiction program until the fever subsides.
Alcohol & Drug Abuse.  The use of alcohol, drugs, or medications before an exercise program may lead to unconsciousness. Smoking, e-cigarettes, drugs and alcohol of any kind are strictly prohibited in all Pilates Addiction facilities and you may not use any of the foregoing at any such facilities.
Cardiovascular Issues, Obesity, or Diabetes. Individuals suffering from obesity or with a medical history of heart disease, low or high blood pressure, circulatory problems, or diabetes should consult a physician before beginning any exercise program. 
Pregnancy. Pregnant women should not participate in any Pilates Addiction program, except for Pelvic Floor & Pregnancy Conditioning classes and only then upon receipt of a doctor's consent to participate.
Joint Injury. If you have a recent (acute) joint injury, consult with your physician participating in any Pilates Addiction program
Implants. Individuals with metal pins, rods, artificial joints, or other surgical implants should consult their physician before participating in any Pilates Addiction program.
Pace Maker / Defibrillator. Consult with your physician participating in any Pilates Addiction program.
Back Injuries. Individuals with a history of back injuries, including herniated discs, chronic back pain, or spinal conditions, should consult with their physician before participating in any Pilates Addiction program. If you are currently experiencing back pain, inflammation, or limited mobility, you should not participate until cleared by a medical professional. Participation may aggravate existing conditions and increase the risk of further injury.
Muscle Strains / Tears. Individuals with current or recent muscle strains, sprains, or tears should not participate in any Pilates Addiction program until fully healed and cleared by a medical professional. Exercising with an existing muscle injury may worsen the condition, delay recovery, and increase the risk of further injury.
IN THE RARE EVENT THAT YOU EXPERIENCE PAIN, LIGHTHEADEDNESS, EXHAUSTION, A FEELING OF UNWELLNESS, DIZZINESS, DISCOMFORT, INJURY OR ANY OTHER ADVERSE REACTION, IMMEDIATELY DISCONTINUE PARTICIPATION IN YOUR PILATES ADDICTION PROGRAM.
DO NOT PARTICIPATE IN ANY PILATES ADDICTION PROGRAM IF ANY OF THE FOLLOWING APPLY TO YOU: (I) IF PREGNANT (EXCEPT FOR PELVIC FLOOR & PREGNANCY CONDITIONING CLASSES UPON RECEIPT OF YOUR DOCTOR'S CONSENT TO PARTICIPATE); (II) HAVE A FEVER; (III) RECENTLY HAD SURGERY; (IV) RECENTLY USED ANY DRUGS, TOBACCO, ALCOHOL OR MEDICATION; (V) ARE PREDISPOSED TO BLEEDING; (VI) HAVE A HISTORY OF DIZZINESS OR FAINTING (VII) HAVE ANY OPEN WOUNDS OR OTHER FLESH WOUNDS; (VIII) HAVE OR HAVE HAD CARDIOVASCULAR ISSUES; (IX) HAVE A PACEMAKER AND/OR DEFIBRILLATOR; OR (X) HAVE ANY CHRONIC ILLNESS OR DISEASE.
Scheduling Policies and Membership Terms
Class Booking & Account Access. All sessions must be scheduled in advance. Bookings can be made via the Pilates Addiction® mobile app, online at the Pilates Addiction® website (under your enrolled studio), or in person. Your account is protected by secure login credentials—please do not share your information and contact support if you require assistance.
Refunds & Class Credit Usage. All class credit sales are final and non-refundable, unless otherwise required by law. Class credits are non-transferable and non-assignable without express written consent. Unused credits expire at the end of the membership term and will be forfeited without refund.
Booking & Reservation Policy. Unlimited Memberships: May hold up to two (2) active class reservations at a time and book classes up to thirty (30) days in advance. Base Memberships: May hold up to two (2) active reservations at a time and book up to fifteen (15) days in advance.
Check-In & Attendance. Arrive at least 10 minutes before class begins. Entry may be denied if arriving fewer than 5 minutes before the scheduled start time. At 5 minutes prior, educators may release unclaimed spots to walk-ins or waitlisted clients. Denied entry due to tardiness results in forfeiture of the reservation and class credit without refund.
Late Cancel Policy. Cancellations must be made at least 12 hours in advance via the app, website, or in person. Package Holders: Forfeit one class credit for cancellations made within 12 hours. Unlimited Members: Subject to a $30 late cancel fee; class credit is retained.
No-Show Policy. If you fail to attend a booked class: (i) All Members: A $35 no-show fee applies; (ii) Package Holders: Class credit is forfeited; and (iii) Unlimited Members: Class credit is retained, but the fee still applies.
Private & Semi-Private Appointments. All late cancellations or no-shows for private or semi-private sessions are subject to a $50 fee.
Late Payment Fee. Any late payment, including for membership dues, is subject to a $25 late payment fee per instance.
Early Termination Fee. If you cancel your membership before the end of its committed term, an early termination fee of $120 will apply.
Instructor Substitution. Purchasing a class credit entitles you to a session with Pilates Addiction®, not with a specific instructor. Instructor substitutions may occur at the studio’s discretion.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

MINOR PARTICIPANT ACKNOWLEDGMENT AND RELEASE:
In addition to, and not in limitation of, the foregoing terms and conditions above, participants must be at least thirteen (13) years of age to attend group classes at Pilates Addiction. Minors under the age of 18 must have a parent or legal guardian sign this agreement on their behalf. No minors may participate in one-on-one instruction, private sessions, or semi-private training. All minors without a valid driver’s license must be dropped off and picked up promptly by a parent or legal guardian before and after each class.
By signing below, the undersigned parent or legal guardian certifies that they have read and agree to all terms of this waiver and consent to their child’s participation in classes at Pilates Addiction. The parent or legal guardian assumes all risks on behalf of the minor and agrees to indemnify and hold harmless Pilates Addiction and its representatives from any liability arising from the minor’s participation, including risks associated with exercise activities, equipment, or transportation to and from the facility

Cancellation policy
