ADULT EVENT WAIVER, ASSUMPTION OF RISK & RELEASE OF LIABILITY
IMPORTANT: PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
ALL THE BEAUTY BOOST TEMECULA VALLEY EVENTS ARE INTENDED FOR ATTENDEES AGE 18 AND OLDER. BY ACCEPTING THIS AGREEMENT, I CONFIRM THAT I AM AT LEAST 18 YEARS OLD.
1. VOLUNTARY PARTICIPATION & ASSUMPTION OF RISK
I understand that participation in The Beauty Boost Temecula Valley (“TBB Temecula Valley”) events is voluntary.
Events may include, without limitation, fitness classes, yoga, stretching, dance, movement, wellness activities, workshops, demonstrations, beauty and wellness experiences, food and beverages, outdoor activities, and services or experiences offered by independent third-party providers.
I understand that participation may involve inherent and other risks, both known and unknown, including but not limited to falls, strains, sprains, physical injury, illness, allergic or adverse reactions, accidents, property damage, and other risks associated with event activities, venues, products, food, beverages, treatments, demonstrations, or services.
I voluntarily choose whether to participate in each activity or experience and knowingly assume the risks reasonably associated with my participation.
I understand that I may decline or discontinue any activity or experience at any time.
2. RELEASE OF LIABILITY — INCLUDING ORDINARY NEGLIGENCE
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I RELEASE, WAIVE, AND DISCHARGE THE BEAUTY BOOST TEMECULA VALLEY, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, VOLUNTEERS, EVENT STAFF, AND REPRESENTATIVES (“RELEASED PARTIES”) FROM CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR REASONABLY RELATED TO MY PARTICIPATION IN THE EVENT, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED.
I understand that this means I am agreeing to give up certain legal rights that I might otherwise have if I am injured or suffer damages because of ordinary negligence in connection with my participation in an event.
This release does not apply to gross negligence, reckless or willful misconduct, fraud, intentional wrongdoing, violations of law that cannot legally be waived, or any other liability that California law prohibits from being released or waived.
3. THIRD-PARTY PARTNERS, PROFESSIONALS & SERVICE PROVIDERS
I understand that TBB Temecula Valley events may include independent businesses and third-party providers, including fitness instructors, wellness professionals, medical or aesthetic providers, chiropractors, massage or bodywork providers, photographers, food and beverage providers, speakers, sponsors, partners, and other businesses or professionals.
Unless expressly stated otherwise, these providers operate independently and are not employees of TBB Temecula Valley.
Participation in any third-party treatment, service, consultation, demonstration, sampling, assessment, activity, or experience is voluntary.
I am responsible for deciding whether a particular service or experience is appropriate for me, asking questions before participating, providing relevant information regarding allergies, sensitivities, injuries or other conditions when appropriate, and reviewing and completing any additional consent, disclosure, or waiver required by the individual provider.
A TBB TEMECULA VALLEY EVENT WAIVER DOES NOT REPLACE ANY INFORMED CONSENT, PROFESSIONAL DISCLOSURE, HEALTH SCREENING, OR SERVICE-SPECIFIC WAIVER THAT A THIRD-PARTY PROVIDER MAY BE LEGALLY OR PROFESSIONALLY REQUIRED TO OBTAIN.
To the fullest extent permitted by law, I understand that TBB Temecula Valley is not responsible for the independent acts or omissions of third-party businesses or providers.
Each third-party provider remains responsible for its own services and for complying with applicable licensing requirements, laws, professional standards, insurance requirements, informed-consent requirements, and scope-of-practice limitations.
4. HEALTH & MEDICAL RESPONSIBILITY
I understand that I am responsible for determining whether I am physically and medically able to participate safely in an event activity.
If I have an injury, medical condition, pregnancy, allergy, sensitivity, medication concern, physical limitation, or other circumstance that could affect my participation, I am responsible for consulting an appropriate healthcare professional when necessary and deciding whether to participate.
I agree to stop or modify an activity if I experience pain, dizziness, shortness of breath, illness, unusual discomfort, or other symptoms indicating that I should discontinue participation.
TBB Temecula Valley does not provide medical advice, diagnosis, or treatment through its events unless such services are separately provided by an appropriately licensed professional acting within that professional's scope of practice.
5. EMERGENCY MEDICAL ASSISTANCE
If I experience a medical emergency, I authorize TBB Temecula Valley representatives or event personnel to contact emergency medical services when they reasonably believe assistance is necessary.
I understand that TBB Temecula Valley cannot guarantee the availability or outcome of emergency medical care.
I accept responsibility for medical, ambulance, hospital, or other emergency-service costs incurred on my behalf, subject to applicable law and insurance coverage.
6. FOOD, BEVERAGES & ALLERGIES
I understand that food, beverages, samples, supplements, wellness products, or other consumable items may be available at certain events.
I am responsible for determining whether any food, beverage, ingredient, product, or sample is appropriate for me and for asking the applicable provider about ingredients or allergens when necessary.
TBB Temecula Valley cannot guarantee that food, beverages, or products offered at an event will be free from allergens or cross-contact.
7. ALCOHOL
Some TBB Temecula Valley events may offer or make alcoholic beverages available through the venue or an appropriately authorized third-party provider.
I understand that I am responsible for my decision to consume alcohol and for doing so responsibly.
I agree not to participate in an activity when alcohol consumption would make participation unsafe.
TBB Temecula Valley and/or the applicable venue or provider may refuse service or participation when reasonably necessary for safety or as required by law.
I am responsible for arranging safe transportation and agree not to drive while impaired.
8. PERSONAL PROPERTY
I am responsible for my personal belongings while attending an event.
To the fullest extent permitted by law, TBB Temecula Valley is not responsible for personal property that is lost, misplaced, stolen, or damaged during an event.
9. PHOTOGRAPHY, VIDEO & MEDIA
I understand that TBB Temecula Valley events may be photographed, filmed, livestreamed, or otherwise recorded for legitimate business, promotional, social media, website, advertising, and marketing purposes.
Subject to applicable law and any separate media consent presented during registration, I authorize TBB Temecula Valley to use photographs, video, audio, or other recordings in which I appear for such purposes without additional compensation.
If I have a concern about being photographed or recorded, I understand that I should notify TBB Temecula Valley staff at check-in so reasonable efforts can be made to accommodate my request.
I understand that TBB Temecula Valley cannot guarantee that I will not appear incidentally in background or crowd imagery at a public or group event.
10. TICKETS, CANCELLATIONS & REFUNDS
Unless different terms are stated for a particular event, ticket sales are final and non-refundable for attendee cancellations, scheduling conflicts, illness, personal emergencies, or failure to attend.
Any permitted ticket transfer, credit, or other accommodation will be governed by the terms applicable to the specific event.
If TBB Temecula Valley cancels, materially reschedules, or materially changes an event, refunds, credits, transfers, or other remedies will be handled according to the applicable ticket terms and California law.
Nothing in this agreement is intended to waive or eliminate any consumer right or remedy that cannot legally be waived.
11. COMMUNITY STANDARDS & EVENT CONDUCT
I agree to treat attendees, staff, ambassadors, partners, speakers, venue personnel, and other participants respectfully.
TBB Temecula Valley may require an attendee to discontinue an activity or leave an event for legitimate, nondiscriminatory reasons, including but not limited to:
Harassment or threatening behavior
Unwanted physical or sexual contact
Unsafe or seriously disruptive behavior
Inappropriate sexual conduct
Significant interference with an instructor, speaker, partner, or attendee
Unsafe intoxication
Damage to property
Refusal to comply with reasonable safety, venue, or event instructions
Conduct that reasonably threatens the safety of attendees or event personnel
These standards apply to all attendees.
TBB Temecula Valley creates experiences designed to empower, support, and connect women. Our programming and community are centered around women and the female experience. While women are our intended audience, our publicly offered events welcome attendees who support and respect the purpose, environment, and community standards of The Beauty Boost.
12. VENUE RULES
I agree to comply with reasonable rules and safety requirements established by the event venue.
I understand that individual venues may require additional waivers, rules, restrictions, or acknowledgments and that acceptance of this agreement does not replace those requirements.
13. SEVERABILITY
If any provision of this agreement is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
14. GOVERNING LAW
This agreement is governed by the laws of the State of California.
15. ENTIRE AGREEMENT REGARDING EVENT WAIVER
This agreement constitutes my acknowledgment and agreement concerning the assumption of risk and release applicable to my participation in the event, except for additional terms, consents, waivers, or disclosures that may apply to a particular venue, activity, service, or third-party provider.
16. ACKNOWLEDGMENT & ACCEPTANCE
I CONFIRM THAT I AM AT LEAST 18 YEARS OLD.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ AND UNDERSTAND THIS AGREEMENT.
I UNDERSTAND THAT PARTICIPATION IN EVENT ACTIVITIES AND THIRD-PARTY EXPERIENCES IS VOLUNTARY AND THAT I MAY DECLINE OR STOP PARTICIPATING IN AN ACTIVITY AT ANY TIME.
I UNDERSTAND THAT THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CERTAIN LEGAL RIGHTS, INCLUDING CERTAIN CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
BY CHECKING THE ACCEPTANCE BOX, ELECTRONICALLY SIGNING, PHYSICALLY SIGNING, OR OTHERWISE AFFIRMATIVELY ACCEPTING THIS AGREEMENT DURING REGISTRATION, I VOLUNTARILY AGREE TO THESE TERMS.
