The **Grounded Grit Combine** is all about giving you a chance to measure your strength and performance in a fun, supportive environment to test your max strength on our core moves.

Push your limits and see what you’re capable of. You’ll rotate through performance tests like:

• Box jump for height

• Heavy sets of:

 – Deadlift

 – Bench press

 – Hang clean

This is a legally binding agreement. Please read carefully before signing.

1. Acknowledgment of Risk

I, [customer.name] acknowledge that participation in fitness activities, classes, programs, personal training sessions, and/or general use of the facilities at Grounded Performance involves inherent risks. These risks include, but are not limited to:


Physical injury (e.g., sprains, strains, fractures, paralysis)

Health complications (e.g., cardiovascular incidents, allergic reactions)

Illness, including contagious diseases such as COVID-19

Risk of death or permanent disability

I voluntarily assume full responsibility for these risks, whether arising from my own actions or those of others, including staff or fellow participants.

2. Waiver and Release of Liability

In consideration for being permitted to use the premises and services of Grounded Performance, I hereby release, waive, discharge, and hold harmless:

Grounded Functional Fitness LLC ("Grounded Performance")

Its owners, officers, employees, contractors, and agents

Any affiliates or successors

...from any and all claims, liabilities, causes of action, damages, or demands related to injuries, illness, death, or loss sustained during or as a result of any activity, whether caused by negligence or otherwise.

3. Medical Acknowledgment

I affirm that:

I am physically fit and capable of participating in fitness activities.

I have consulted with or assume the risk of not consulting with a physician.

I am solely responsible for monitoring my health and wellbeing during exercise.


4. Indemnification

I agree to indemnify and hold harmless Grounded Performance and its representatives from any and all claims, damages, liabilities, and expenses (including legal fees) arising from my conduct, participation, or breach of this agreement.

5. Safety & Conduct Compliance

I agree to comply with all posted rules, hygiene protocols, equipment usage guidelines, and instructions from Grounded Performance staff. I understand that repeated violations may result in revoked access without refund.

6. Emergency Medical Treatment Authorization

In the event of injury or illness, I authorize Grounded Performance staff to administer first aid and/or summon emergency medical services. I understand I am financially responsible for any medical treatment rendered.

7. Notice of Filming and Photography

I understand that Grounded Performance may occasionally record photos or videos during regular operation for promotional purposes (including social media, websites, YouTube, and other advertising platforms). By entering the premises, I consent to the use of my likeness unless I provide written notice requesting exclusion.

8. Jurisdiction and Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of Texas. Any legal proceedings shall be brought exclusively in the courts of Travis County, Texas.

9. Severability

If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Binding Agreement

I certify that I am at least 18 years of age and legally competent to sign this agreement. If under 18, this waiver must be signed by a legal parent or guardian.


Grounded Performance Terms of Service:

Grounded Performance Group Training Sessions and Personal Training Release, Covenant Not to Sue, and Waiver

I hereby acknowledge and agree to the following:

Grounded Performance coaches are not physicians and are not trained to provide medical diagnosis, treatment, or advice. If I am unsure about my ability to perform intense exercise, I agree to consult a physician immediately.

I understand that if I feel tired, pain, or discomfort during any session, I should stop and consult a physician if necessary.

Grounded Performance training carries risks, including injury or illness such as musculoskeletal injury, cardiovascular issues, or even death, including exposure to contagious diseases like COVID-19. I assume full responsibility for the risks of participating in these activities, including natural elements and illnesses.

I consent to participating in Grounded Performance’s programs, which may include strength, endurance, and cardiovascular exercises. I understand that exercise can carry risks such as muscle injuries, abnormal blood pressure, and, in rare cases, heart attack or death. Every effort will be made to minimize these risks.

All personal information regarding my fitness level and progress is confidential and will only be shared with my physician with my written consent. I understand that I can discontinue participation at any time.

I agree to release and waive any responsibility from Grounded Performance and its affiliates for any injury, illness, or property damage related to my participation in these programs.

I acknowledge that photos and videos may be taken during classes and events, and I grant permission for my likeness to be used for marketing purposes.

Personal Training

Rates: Rates will be agreed upon by the trainer and client before the start of the session.

Attire: Wear appropriate workout attire and dress in layers that breathe, as summer heat can affect performance. A water bottle is required to stay hydrated. No flip-flops, wear comfortable athletic shoes or no shoes if you prefer.

Training Sessions: Sessions will begin promptly at the scheduled time. Payment is required before participating, and your registration is not guaranteed until payment is received. Sessions last 60 minutes unless otherwise agreed upon by the trainer.

Cancellations: A 24-hour notice is required to cancel or reschedule a session to receive credit. Failure to cancel within this time or no-shows will result in being charged for the full session. Exceptions may be made for medical emergencies at the trainer’s discretion.

Weather-Related Cancellations: In the event of severe weather, Grounded Performance may cancel classes or training sessions for safety reasons. Members will receive credit for any session canceled due to weather conditions.

Reimbursement or Credits: Grounded Performance does not offer refunds or credits. If an injury prevents you from completing the sessions, a partial refund may be issued with a physician’s note.

Injury: You are fully responsible for any injuries sustained before, during, or after training sessions. Grounded Performance and its trainers are not liable for any injuries. Clients must remain focused during training and communicate any discomfort.
