EW ERA FITNESS & PERFORMANCE
SPINNING CLASS PARTICIPATION & LIABILITY WAIVER
Please read this waiver carefully before participating in any spinning/cycling class at New Era Fitness & Performance. By
signing below, I acknowledge that indoor cycling is a physically demanding activity and that I am voluntarily choosing to
participate.
1. Assumption of Risk
I understand that spinning/cycling classes may involve vigorous cardiovascular exercise, rapid changes in resistance and
pace, standing and seated cycling, repetitive motion, loud music, strobe or changing lights, heat, perspiration, and interaction
with other participants and equipment. I understand that participation may result in risks including, but not limited to, falls,
collisions, muscle strains, sprains, joint or back injuries, dizziness, fainting, dehydration, overheating, cardiovascular events,
or other injury, illness, disability, or death. I voluntarily assume all known and unknown risks associated with participation to
the fullest extent permitted by law.
2. Health & Medical Clearance
I represent that I am physically able to participate safely in spinning classes. I understand that New Era Fitness &
Performance does not provide medical advice, diagnosis, or treatment. I will consult a physician or qualified healthcare
professional before participating if I have any medical condition, injury, pregnancy, recent surgery, or other concern that could
affect my ability to exercise safely. I agree to immediately stop exercising and notify the instructor if I experience pain,
dizziness, shortness of breath, chest discomfort, unusual weakness, or any other concerning symptom.
3. Proper Use of Equipment
I agree to follow all instructor directions and use the stationary bike and other equipment properly. I will ask for assistance if I
am unsure how to adjust or operate equipment. I understand that improper bike setup, excessive resistance, unsafe riding
technique, or ignoring instructor directions may increase the risk of injury.
4. Personal Responsibility
I agree to exercise within my own fitness level and to modify or stop an exercise whenever necessary. I understand that
instructors may provide general exercise guidance but cannot monitor every participant continuously or guarantee that an
exercise is appropriate for my individual condition.
5. Release and Waiver of Claims
To the fullest extent permitted by applicable law, I release and agree to hold harmless New Era Fitness & Performance, its
owners, operators, employees, instructors, contractors, agents, and representatives from claims, demands, damages, losses,
or expenses arising from or related to my participation in spinning classes, including claims arising from ordinary negligence,
except to the extent such a release is prohibited by law. This provision does not waive rights that cannot legally be waived.
6. Emergency Medical Treatment
If I become injured or ill during a class and am unable to communicate, I authorize New Era Fitness & Performance and/or
emergency personnel to seek or arrange reasonable emergency medical assistance for me. I understand that I am
responsible for any medical, transportation, or related expenses.
7. Live DJ, Music & Studio Environment
I understand that certain spinning classes may include a live DJ, amplified music, and elevated sound levels. I acknowledge
that loud music may affect hearing, communication, balance, or comfort. I agree to notify the instructor if I need to reduce
exposure or leave the class. I understand that special lighting, smoke/fog effects, or other event-style elements may be used
when applicable.
8. Personal Belongings
I understand that I am responsible for my personal belongings. New Era Fitness & Performance is not responsible for lost,
stolen, or damaged personal property, except where liability cannot legally be excluded.
9. Photography, Video & Promotional Content
I understand that photos or video may be taken during classes or events for business, social media, or promotional purposes.
I may notify staff before class if I do not wish to appear in promotional content. Any specific written media release required by
law or requested by the facility will be handled separately.
10. Acknowledgment
I confirm that I have read and understand this waiver, have had the opportunity to ask questions, and am signing voluntarily. I
understand that I am responsible.
