GENERAL RELEASE - BARBELL 13 FACILITIES AND EQUIPMENT
DNA of Training, LLC a Florida Limited Liability Company d/b/a Barbell 13 operates certain
fitness facilities (specifically located at 436 Plumosa Ave Casselberry, Florida 32707) and offers general
and specialized fitness equipment to paid members or members who accompany a personal trainer into
their facilities collectively “Members”
.
Members agree that the use of Barbell 13 facilities and equipment is only authorized by Barbell
13 with the execution of this specific General Release which must be signed and executed in its entirety
before using or continuing to use Barbell 13’s facilities and equipment, the execution of this General
Release and as applicable Members fees and Barbell 13’s allowing access to the facilities and equipment
is sufficient consideration between the parties.
In exchange for Members access to Barbell 13’s facilities and equipment the Member agrees to
certain and specific limitations and waivers in Barbell 13’s favor. Specifically, Members understand that
engaging in strenuous activity carries the potential of serious injury and up to and including potential
death. Members waive any and all liability Barbell 13 may have in the event Members are injured,
become disabled, or die during, before, or after their use of Barbell 13 facilities and equipment regardless
of cause is by accident or negligence. Members and Barbell 13 agree that in any and all suits of law or
equity against Barbell 13 that the Members their estate and heirs may only recover the value of the
membership paid to Barbell 13 or $200 dollars whichever is less. The Members understand that this
provision is material to Barbell 13 in allowing Members to utilize the facilities and equipment listed
above, and to the extent allowable the Members assume all risks associated with utilizing the facilities and
equipment and any potential injuries, disabilities or potential death which may occur.
Members represent and warrant to Barbell 13 that they have undergone a medical examination by
a qualified medical professional and have determined for themselves that they are physically fit and able
to engage in physical exercise. Members understand that they have the right and ability to stop physical
exercise at anytime and agree to immediately inform any personal trainer or staff member if they are
feeling unwell and need medical professionals such as EMS to be called to evaluate them. Members
understand that personal trainers and Barbell 13 staff are not medical providers and cannot give medical
advice.
The parties agree that this General Release shall be governed by the laws of the State of Florida
and that any suits shall lie in the courts of Seminole County, Florida. The parties agree to waive any trial
by jury and agree that only a Judge will decide any suit at law or equity against each other. This General
Release shall continue in full force and effect even if Members cancel membership or no longer utilize the
facility.
As part of your use of Barbell 13’s facilities you authorize Barbell 13 to utilize your image and
likeness in photographs, videos, or other media for promotional purposes without compensation or
limitation. Y ou further agree to abide by general rules of the gym such as not slamming weights and
reporting any broken equipment.
I have read the foregoing and agree to be immediately bound by this General Release for myself,
my estate and heirs from this point forward.
