Participant understands that FOR OUR CITY TRAINING CLUB and its trainers and instructors are not physicians and do not provide medical diagnosis, medical treatment, physical therapy, or medical advice.

Participant is responsible for consulting a qualified healthcare professional before participating, especially if Participant is pregnant, recently gave birth, has an injury or medical condition, takes medication, or has received medical restrictions.

Participant agrees to disclose relevant injuries, illnesses, pregnancy, medical conditions, and physical limitations before participating. Such disclosure does not transfer responsibility for Participant’s health or safety to a Released Party.

Participant agrees to immediately stop participating and notify a trainer or instructor if Participant experiences pain, dizziness, weakness, difficulty breathing, chest discomfort, loss of balance, unusual fatigue, or another concerning symptom.

3. ASSUMPTION OF RISK

Participant understands that physical exercise, fitness training, wellness services, recreational activities, and entering or using a fitness facility involve inherent and other risks that cannot be completely eliminated.

These risks include strains, sprains, bruises, cuts, fractures, dislocations, torn muscles, tendon or ligament injuries, falls, collisions, dropped weights, contact with other participants, equipment failure or malfunction, wet or uneven surfaces, overexertion, dehydration, heat-related illness, fainting, abnormal blood pressure, heart attack, stroke, respiratory distress, cardiac arrest, allergic reactions, infection, communicable illness, aggravation of known or unknown medical conditions, traffic, vehicles, weather, crowds, third-party locations, property loss, permanent disability, paralysis, dismemberment, death, and other foreseeable or unforeseeable injuries or losses.

PARTICIPANT KNOWINGLY AND VOLUNTARILY ACCEPTS AND ASSUMES ALL RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE, DISABILITY, DEATH, OR OTHER LOSS ARISING FROM OR RELATED TO THE ACTIVITIES. THIS INCLUDES RISKS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF FOR OUR CITY TRAINING CLUB OR ANOTHER RELEASED PARTY.

Participant voluntarily chooses to participate despite these risks and accepts personal responsibility for Participant’s participation.

4. EXPRESS RELEASE AND WAIVER OF NEGLIGENCE CLAIMS

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, PARTICIPANT, ON BEHALF OF PARTICIPANT AND PARTICIPANT’S SPOUSE, HEIRS, ESTATE, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, INSURERS, SUCCESSORS, AND ASSIGNS, KNOWINGLY AND VOLUNTARILY RELEASES, WAIVES, AND FOREVER DISCHARGES THE RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, ACTIONS, AND CAUSES OF ACTION ARISING FROM OR RELATED TO PARTICIPANT’S PARTICIPATION IN THE ACTIVITIES OR PRESENCE AT A COVERED LOCATION.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS CAUSED IN WHOLE OR IN PART BY THE PRESENT OR FUTURE ORDINARY NEGLIGENCE OF FOR OUR CITY TRAINING CLUB OR ANOTHER RELEASED PARTY, WHETHER ACTIVE OR PASSIVE.

It also includes claims involving equipment failure, slips, trips, falls, collisions, contact with equipment or people, outdoor or off-site activities, third-party locations, and loss or damage involving personal property.

This release applies to known and unknown claims and to injuries or losses occurring before, during, or after an Activity, provided the claim arises from or relates to the Activities or Participant’s presence at a covered location.

THIS AGREEMENT DOES NOT RELEASE LIABILITY THAT CANNOT LAWFULLY BE RELEASED, INCLUDING LIABILITY FINALLY DETERMINED TO HAVE RESULTED FROM GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT.

5. COVENANT NOT TO SUE

To the maximum extent permitted by law, Participant agrees not to initiate or maintain a lawsuit or other claim against a Released Party for a matter released under this Agreement.

If Participant brings a claim that a court determines was released under this Agreement, the Released Party may seek reasonable attorneys’ fees and costs to the extent permitted by Texas law.

6. INDEMNIFICATION

To the maximum extent permitted by law, Participant agrees to indemnify, defend, and hold harmless the Released Parties from third-party claims, liabilities, damages, judgments, and reasonable attorneys’ fees arising from Participant’s negligent, reckless, or intentional conduct; failure to follow instructions or safety rules; misuse of equipment or facilities; violation of this Agreement; or injury or property damage caused by Participant to another person.

This provision does not require Participant to indemnify a Released Party for gross negligence or intentional misconduct.

7. EMERGENCY MEDICAL AUTHORIZATION

If Participant becomes injured or ill and cannot provide informed consent, Participant authorizes FOR OUR CITY TRAINING CLUB and its representatives to contact emergency services and arrange reasonably necessary emergency assistance.

Participant accepts financial responsibility for ambulance services, emergency care, hospitalization, treatment, medication, and other expenses incurred on Participant’s behalf. Participant understands that the Released Parties do not guarantee the availability, timing, or adequacy of emergency care.

8. RULES AND PERSONAL RESPONSIBILITY

Participant agrees to follow posted rules and reasonable staff instructions, use equipment only as instructed and for its intended purpose, request assistance before using unfamiliar equipment, avoid participating while impaired, stop participating whenever continuing may be unsafe, and promptly report damaged equipment, unsafe conditions, injuries, or emergencies.

Participant understands that the presence of a trainer or instructor does not eliminate Participant’s responsibility to use reasonable judgment and remain within Participant’s abilities and medical restrictions.

9. PERSONAL PROPERTY

Participant is solely responsible for personal property brought to any facility or Activity. The Released Parties are not responsible for property that is lost, stolen, misplaced, left unattended, or damaged, including property stored in vehicles, lockers, bathrooms, changing areas, or common areas.

10. NO GUARANTEE OF RESULTS

Participant understands that fitness, health, strength, performance, body-composition, and weight-loss results vary. FOR OUR CITY TRAINING CLUB does not promise or guarantee any specific result.

11. GOVERNING LAW AND VENUE

This Agreement shall be interpreted under the laws of the State of Texas. To the extent legally enforceable, any lawsuit or judicial proceeding arising from this Agreement or Participant’s participation must be filed in a court of competent jurisdiction located in the Texas county where FOR OUR CITY TRAINING CLUB’s primary facility is located.

12. SEVERABILITY

If any provision is found invalid or unenforceable, it shall be enforced to the maximum extent permitted or modified only as much as necessary to make it enforceable. The remaining provisions shall continue in full force and effect.

13. CONTINUING EFFECT

This Agreement applies to Participant’s current and future visits, memberships, training sessions, classes, services, programs, competitions, and events unless replaced by a later written agreement. Ending or canceling Participant’s membership does not affect claims or obligations arising while this Agreement was in effect.

14. ELECTRONIC ACCEPTANCE AND FINAL ACKNOWLEDGMENT
