THIS IS A RELEASE AND WAIVER.
PLEASE READ THIS RELEASE AND WAIVER CAREFULLY. UNDERSTAND IT FULLY AND
COMPLETELY, AND ASK QUESTIONS IF ANYTHING IS UNCLEAR. BY SIGNING THIS RELEASE AND
WAIVER YOU AGREE YOU ARE SIGNING AWAY YOUR LEGAL RIGHTS AND YOU AGREE TO BE
BOUND BY ALL TERMS OF THIS RELEASE AND WAIVER.
House of Core LLC is a Pilates studio located at 131 S. Barrington Place, Suite 100, Los Angeles, California 90049
(“Studio”) that offers challenging Pilates group classes and private training Pilates sessions. House of Core LLC also
at times offers Yoga group classes. All of House of Core LLC’s Pilates and/or Yoga group classes, including but not
limited to LIT HOUSE and HOT HOUSE are referred to herein as “group class” or “group classes”). House of Core
LLC’s private training Pilates and/or Yoga sessions are referred herein as “private training sessions”. House of Core
LLC is referred to below as “HOC” and is defined as including but is not limited to any past, present and future
officer, director, manager, employee, partner, instructor, trainer, attorney, agent, representative, member, owner,
founder, affiliate, volunteer, subsidiary, successor, contractor, executor, landlord, lessor, lessee, assign, administrator
and any and all other persons and/or entities who are and/or may be liable. The undersigned client (“client”) agrees
to the entirety of this RELEASE AND WAIVER.
CANCELLATION POLICY
The client may cancel a group class up to 12 hours from the time of the group class without any charge of a
cancellation fee. If the client cancels a group class within 12 hours of the group class, the client agrees to either
redeem class credits or pay a $20 Late Cancel Fee, or a $25 No Show Fee, depending on membership and/or plan.
PHYSICAL CONDITION OF CLIENT
The client represents, warrants, and agrees the client is in good physical condition and the client has no disability,
impairment, and/or ailment that will prevent the client from engaging in any group class or private training session,
active or passive exercise and/or any exercise and/or move at the Studio that could in any way be detrimental to the
client’s health, safety, comfort, and/or physical condition. The client acknowledges HOC has neither made claims as
to medical results nor suggested medical treatment to the client. The client acknowledges HOC expects the client to
consult a physician prior to any group class and/or private training session. The client understands it is the client’s
responsibility to immediately inform HOC and the instructor of the group class or private training session of any
pain or discomfort experienced before, during or after participating in any group class and/or private training session
so the exercise may be immediately terminated.
RED LIGHT THERAPY PANELS
Red light therapy is generally considered safe for most people, but there are several contraindications and
precautions you should consider before taking any LIT HOUSE class. Be aware of eye safety. Avoid looking directly
at any light source. We have glasses for you to wear while in our studio during any LIT HOUSE class. Always
consult your physician before attending any LIT HOUSE class. Particularly if you have any concerns and/or
questions and/or any of the including but not limited to ailments, conditions and/or issues: Pregnancy;
Photosensitivity; Cancer; Epilepsy; Open Wounds; Infections; Tattoos; Recent Cosmetic Procedures; Skin
Conditions; Heart Conditions; Pacemakers; Heat Sensitivity or Sensation issues. Consult your physician
immediately if you ever experience any issue, irritation or discomfort. By signing this RELEASE AND WAIVER,
you understand, acknowledge and agree you have consulted with your physician before attending any LIT HOUSE
class. You also understand, acknowledge and agree you will stop immediately if you feel any discomfort of any sort
and consult your physician.
HOT HOUSE
The client completely and fully understands the Studio will be heated, in some circumstances, up to 105 degrees F.
This can be strenuous and aggravate any physical and/or medical condition, ailment, issue, and/or injury. Before
participating in any group class and/or private training session in the Studio, consult your physician. By signing this
RELEASE AND WAIVER, you understand, acknowledge and agree you have consulted with your physician before
attending any HOT HOUSE class. You also understand, acknowledge and agree you will stop immediately if you
feel any discomfort of any sort and consult your physician.
FOR CLIENTS UNDER 18 YEARS OF AGE:
If the client is under 18 years old, the client represents and warrants the client’s parent and/or legal guardian has
reviewed this RELEASE AND WAIVER, and agrees to this RELEASE AND WAIVER on behalf of the client. The
client cannot attend any group class and/or private training session without the client’s parent and/or legal guardian’s
consent. If the client attends any group class and/or private training session and/or is present in the Studio for any
reason, it is HOC’s expectation and the client’s representation the client’s parent and/or legal guardian agrees on
behalf of the client to the entirety of the RELEASE AND WAIVER.
PHOTO RELEASE AND WAIVER
Client grants HOC permission to use client’s likeness in a photograph, video, reel, story and/or any electronic and/or
digital and/or print media (collectively referred to as “photo”) in any and all of its publications, including web-based
publications and social media platforms, without payment and/or other consideration. The client fully and
completely understands and agrees any photo is the property of HOC. The client irrevocably authorizes HOC to edit,
alter, copy, exhibit, publish and/or distribute any photo for any lawful purpose. The client RELEASES AND
WAIVES any right to inspect and/or approve any photo. Additionally, the client RELEASES AND WAIVES any
right to royalties and/or other compensation and/or for any intellectual property right and/or purpose arising out of
and/or related to the use of the photo. The client hereby holds harmless, releases, and fully and forever discharges
HOC from any and all claims, demands, losses, costs, fees, monies, damages, intellectual property rights and causes
of action of any kind, which equitable or legal, whether based on federal, state, local or any governmental statute,
regulation and/or ordinance on behalf of the client and any and all heirs, representatives, executors, agents,
administrators and/or any persons acting on client’s behalf and/or on behalf of the client’s estate.
THE CLIENT AGREES SHE/HE HAS READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. THE
CLIENT AFFIRMS HE/SHE IS AT LEAST 18 YEARS OF AGE, OR, UNDER 18 YEARS OF AGE, HAS
OBTAINED THE REQUIRED CONSENT OF HIS/HER PARENTS/GUARDIANS.
WAIVER AND INDEMNIFICATION
Client is familiar with, understands fully and completely, and acknowledges and recognizes the danger and risk of
injury to the client and/or property which may result from participating in any group class, private training session
and/or the use of the Studio, including, without limitation, injury from slipping and falling, excess fatigue or stress,
muscle strain, muscle sprain, or any other unforeseen cause, illness, injury and/or condition. With full knowledge
and understanding of any and all risks, the client agrees to use the Studio, attend any group class and/or private
training session at his or her own risk and PERSONALLY ASSUMES THE RISK for any harm, injury, and/or
damage that may arise out of and/or occur from use of the Studio, attendance and/or participation in any group class
and/or private training session and/or presence in the Studio. Client hereby fully and completely RELEASES,
RELINQUISHES, ACQUITS, WAIVES AND DISCHARGES HOC and the client holds harmless, defends and
indemnifies HOC of any and all past, present and/or future personal injuries of any kind, injuries in general,
ailments, conditions, issues, death, property damage, negligence, premises liability, claims, rights, demands,
damages, costs, losses, loss of services, expenses, lost wages, loss of earning capacity, fees including attorneys’ fees,
income, compensation, monies and/or monies due of any nature whether it is based on equity, based on a tort,
contract and/or any other theory of recovery, based on federal, state, local and/or any governmental statute,
regulation, and/or ordinance, including without limitation, any and all known or unknown claims that have been
asserted and/or could be asserted, suspected or unsuspected, and any and all claims of whatever kind and/or
character which arise from and/or arise out of and/or are directly or indirectly related to HOC, the Studio, group
class and/or private training session, attendance and/or presence in the Studio.
This RELEASE AND WAIVER is governed exclusively by the laws of the State of California and includes a waiver
of California Civil Code section 1542. The client signs this RELEASE AND WAIVER with the express intention of
effecting the legal consequences provided by California Civil Code section 1541, and any other federal, state or
local laws of similar effect. The client RELEASES AND WAIVES and fully and completely relinquishes any and all
claims against HOC, whether or not known or suspected and expressly waive any and all rights and benefits
conferred upon the client by the provisions of California Civil Code section 1542 and/or any federal, state or local
laws of similar effect. California Civil Code section 1542 reads as follows:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY
DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE
RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR
HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
If any provision, word, and/or phrase and/or any part herein is deemed invalid and/or unenforceable, the other
provisions in this RELEASE AND WAIVER will remain in full force and effect. This RELEASE AND WAIVER
constitutes the entire agreement between HOC and the client. This RELEASE AND WAIVER may not be amended,
changed and/or altered except by another written agreement signed by the client. By agreeing to this RELEASE
AND WAIVER, the client agrees to have read this RELEASE AND WAIVER and fully and completely understands
all of its contents and knowingly and voluntarily and without any undue influence from anyone in any way agrees to
be bound to all of its terms.
Client expressly warrants and represents and does hereby state and represent that no promise or agreement which is
not herein expressed has been made to him/her in executing this RELEASE AND WAIVER, and the client is not
relying upon any statement and/or any representation of HOC, including but not limited to all persons and/or entities
included as defined above.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS,
UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT
FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING
MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF
LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
eSIGNATURE NOTICE
By checking the applicable box in this RELEASE AND WAIVER, the client confirms the client has read and fully
consents to this RELEASE AND WAIVER and eSignature Notice. This client’s consent will remain effective for any
and all group classes and/or private training sessions attended by the client, any presence of the client in the Studio
and/or anything arising out of and/or relating to HOC and/or the Studio unless and until expressly withdrawn in
writing by the client to HOC at paula@houseofcore.com. The client may request a paper version of this RELEASE
AND WAIVER by emailing paula@houseofcore.com.
