DISCLAIMER OF LIABILITY: ISI® Elite Training urges all members to obtain a physical examination for their physicians prior to initiating any exercise program. The member warrants and represents that the member or any family member or guest entitled to use the facility of ISI® Elite Training under the terms of membership, has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The Member acknowledges and agrees that: 
ISI® Elite Training will rely on the foregoing warranty in issuing the Membership. 
ISI® Elite Training shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition.
If any fitness assessment or similar testing is performed by ISI® Elite Training; it is solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes. 
ISI® Elite Training shall not be subject to any claim, demand, or injury whatsoever on account of ISI® Elite Training’s evaluation or interpretation of such fitness assessment or similar testing. 
ISI® Elite Training shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each member and guest should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing. 
LIABILITY AND WAIVER OF LIABILITY: Each member of ISI® Elite Training shall be liable for any property damage and/or personal injury (caused by the Member, Member’s Family, Guest, or any other person) at ISI® Elite Training or any activity or function operated, arranged, or sponsored by ISI® Elite Training. It shall be the obligation of the member to pay for any costs involved upon presentation of a statement thereof.
Accordingly, I agree to waive, relinquish, discharge, release, and covenant not to sue LYBL Training, LLC or its parent, sister, affiliated and/or subsidiary corporations and related entities, their members, franchise partners, officers, directors, partners, employees, consultants, contractors, advisors, agents, insurers, attorneys and volunteers, from any and all rights, claims of injury, demands, causes of action, damages, liabilities or loss that I, my minor/ward, or other family member may have or that may accrue to me, my minor/ward, or other family members arising out of, connected with, or in any way associated with the training services provided by the LYBL Training, LLC in no event shall we be liable for any cause of action, claim, demand, expense, fine, investigation, liability, or penalty in excess of the amounts that you paid to us in the preceding 12 months, whether one time or in the aggregate. You agree to defend, hold harmless, and indemnify us for any of your negligent or reckless acts or omissions. You warrant and represent that you have no medical or other condition, which would prohibit you from participating in any of our programs.
This Agreement constitutes the entire agreement between the Parties on the issues contained in this Agreement and supersedes all prior agreements and/or memoranda. This Agreement may only be modified in writing with the written consent of both Parties. This Agreement is intended to bind only the Parties hereto, and their successors, and may not be assigned by either Party without the express written consent of the other.
This Agreement shall be governed by the laws of the State of Nevada. All Parties irrevocably consent that the venue and jurisdiction of any dispute shall lie in Clark County, Nevada. In the event that a court determines that any provision of this Agreement is invalid, all other provisions shall survive, and the Agreement shall be interpreted to fulfill the intent of the Parties as shown in this Agreement.
I have read this Agreement thoroughly and fully understand it. I enter into it voluntarily on behalf of myself, my spouse, my heirs, next of kin, assigns, personal representatives, related individuals and related entities. No one has made to me any representations, statements, or inducements that change or modify anything written in this Agreement.
PHOTOGRAPH & VIDEO RELEASE FORM: I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area.
