PARTICIPANT WAIVER AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.
In consideration of being permitted to participate in the [Name of 5K Race] (the “Event”), I acknowledge, agree, and represent the following:
1. Voluntary Participation
I am voluntarily participating in the Event, which includes running and walking on public streets, sidewalks, and trails, and I fully accept all risks associated with participation.
2. Assumption of Risk
I understand that participation in a road race involves inherent risks including, but not limited to:
Falls, contact with other participants, spectators, volunteers, or vehicles
Weather conditions (heat, cold, humidity, rain, storms, etc.)
Road hazards, uneven pavement, traffic, and natural terrain
Dehydration, exhaustion, or other health-related conditions
Serious injury, permanent disability, or death
I knowingly and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of the Released Parties (defined below).
3. Release of Liability
I, for myself and my heirs, executors, and assigns, hereby release, discharge, and hold harmless:
[Race Company Name], its directors, officers, employees, agents, and volunteers
Event sponsors, partners, vendors, contractors, and venue owners
Local municipalities, government agencies, and police/fire/EMS personnel assisting with the Event
(collectively, the “Released Parties”), from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in the Event, including but not limited to claims for personal injury, property damage, or wrongful death.
This release applies even if caused by the negligence of the Released Parties.
4. Medical Treatment
I authorize Event staff, volunteers, and medical professionals to provide medical care deemed necessary during my participation. I understand I am solely responsible for any medical costs incurred.
5. Fitness to Participate
I represent that I am physically fit and sufficiently trained to participate in the Event. I will not participate if I am ill, injured, or otherwise unfit, and I am solely responsible for monitoring my health before, during, and after the Event.
6. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims brought by me or on my behalf, or by any third party arising from my participation in the Event.
7. Weather, Course & Event Changes
I understand that the Event may be delayed, altered, or canceled due to weather, natural disaster, unsafe conditions, or other reasons beyond the control of the Event organizers. No refunds will be issued in such circumstances.
8. Photography/Media Release
I grant the Event organizers and partners the right to use photographs, video, and other media of me participating in the Event for promotional and marketing purposes, without compensation.
9. Severability
If any portion of this waiver is held invalid, the remainder shall remain in full force and effect.
10. Jurisdiction
This waiver shall be governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts of Travis County, Texas.
