fxbadhabits – LIABILITY WAIVER AND RELEASE AGREEMENT
IMPORTANT LEGAL NOTICE
By signing or electronically accepting this waiver, you (“Participant”) are waiving your right to bring legal action against fxbadhabits, its organizers, volunteers, sponsors, affiliated partners, and the city or location where the events take place.
1. PARTICIPANT ACKNOWLEDGMENT AND VOLUNTARY ASSUMPTION OF RISK
I, the undersigned Participant, acknowledge that I am voluntarily participating in one or more physical and social activities organized by fxbadhabits. These may include but are not limited to: community runs, group workouts, fitness challenges, social meetups, and any other events (collectively, the “Events”).  I acknowledge and agree that: - My participation is entirely voluntary and at my own risk. - I am in good physical condition or knowingly assume the risks without medical clearance. - I understand that running and physical activity involve inherent risks, including but not limited to: slips, trips, falls, collisions, overexertion, dehydration, heat stroke, muscle injury, traffic accidents, and even death. - Events may occur on public streets, trails, beaches, sidewalks, or private property where hazards may exist beyond the organizers' control.
2. RELEASE OF LIABILITY AND WAIVER
In consideration of being permitted to participate, I hereby waive, release, and forever discharge fxbadhabits, its organizers, volunteers, sponsors, affiliates, and property owners (collectively, the “Released Parties”) from all liability, claims, demands, or legal actions for any injury, illness, loss, or damage arising from my participation in the Events, whether caused by negligence or otherwise.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, lawsuits, judgments, costs, or expenses (including attorney’s fees) arising out of: - My participation in the Events; - Any act or omission by me; - Any injury or damage I cause to other persons or property.
4. MEDIA RELEASE
I grant fxbadhabits and its partners the unrestricted, royalty-free, perpetual right to use my name, image, voice, and likeness in photos, videos, and promotional content in any media format, including social media and advertising, without compensation or approval.
5. COMMUNICABLE DISEASES
I understand that participating in these Events may expose me to contagious diseases, including but not limited to COVID-19, and I voluntarily accept all such risks, even if caused by the negligence of the Released Parties.
6. GOVERNING LAW
This agreement shall be governed by the laws of the State of Florida. Any legal dispute shall be resolved exclusively in a court of competent jurisdiction located in Miami-Dade County or Broward County, Florida, and I consent to personal jurisdiction and venue in such courts. 
7. ACKNOWLEDGMENT
By signing below or checking the box, I confirm that I have read and understood this Liability Waiver and Release Agreement and agree to its terms freely and voluntarily.
