## MIDNIGHT MILES — PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK

**Friday Night • 10:00 PM • New Location Each Week**

Welcome to **MDNT MILES™ — Midnight Miles**, a community movement experience built around **Movement • Ministry • Motivation**.

By registering for, attending, participating in, or otherwise joining any MDNT MILES™ event, you acknowledge and agree to the following terms.

### 1. VOLUNTARY PARTICIPATION

I understand that participation in MDNT MILES™ is completely voluntary. Activities may include, but are not limited to:

* Running
* Jogging
* Walking
* Biking/cycling
* Stretching
* Bodyweight exercises
* Squats, jumping jacks, and other fitness movements
* Group activities and challenges
* Outdoor movement activities
* Community gatherings before, during, or after the event

I understand that I am responsible for selecting a level of participation appropriate for my physical ability and personal circumstances.

### 2. ASSUMPTION OF RISK

I understand that physical activity and outdoor nighttime events involve inherent risks.

These risks may include, but are not limited to:

* Falls, trips, slips, or collisions
* Muscle strains, sprains, or other injuries
* Dehydration, overheating, or exhaustion
* Traffic and interaction with vehicles
* Uneven, wet, dark, or unfamiliar surfaces
* Weather conditions
* Bicycles, runners, pedestrians, animals, or other participants
* Loss, theft, or damage to personal belongings
* Risks associated with participating outdoors at night
* Serious injury, permanent disability, or death

I voluntarily assume all known and unknown risks associated with my participation in MDNT MILES™.

### 3. NIGHTTIME EVENT & LOCATION

I understand that MDNT MILES™ takes place at approximately **10:00 PM on Fridays** and that the meeting location may change from week to week.

The location may be provided through the official MDNT MILES™ communication channels or registration platform.

I understand that participating in a nighttime outdoor activity requires me to use reasonable personal safety precautions, including remaining aware of my surroundings and following event instructions.

I agree to follow all applicable traffic laws, posted signs, pedestrian rules, and instructions provided by event organizers or designated leaders.

### 4. PERSONAL RESPONSIBILITY

I am responsible for knowing my own physical limitations and determining whether I am physically capable of participating.

I agree to stop participating if I experience pain, dizziness, shortness of breath, weakness, injury, illness, or any other concerning symptom.

I understand that MDNT MILES™ organizers, volunteers, leaders, and participants are not acting as my personal medical professionals.

I am responsible for bringing any medications, hydration, equipment, reflective gear, lights, or other personal items I may reasonably need.

### 5. EMERGENCY MEDICAL CARE

If an emergency occurs and I am unable to provide consent, I authorize MDNT MILES™ event organizers or designated representatives to seek reasonable emergency assistance on my behalf.

I understand that I am responsible for any medical expenses, emergency transportation, treatment, or other costs associated with an injury or medical emergency, except where otherwise required by applicable law.

### 6. CHILDREN & MINORS

**Children and minors are welcome only when permitted by the specific MDNT MILES™ event.**

A parent or legal guardian **must supervise their child/minor at all times.**

MDNT MILES™ is **not a drop-off program, childcare service, or supervised youth program.**

A minor may not attend an MDNT MILES™ event independently unless MDNT MILES™ has expressly authorized otherwise in writing.

#### Separate Minor Registration Required

**Every child/minor participating in MDNT MILES™ must have a separate participant registration and minor waiver completed by their parent or legal guardian.**

If this is the minor's **first MDNT MILES™ event**, the parent/legal guardian must complete the required minor registration and waiver before the minor participates.

A parent/legal guardian may be required to provide updated registration or consent if MDNT MILES™ changes its minor participation requirements.

The parent/legal guardian understands that they remain responsible for the minor's safety, behavior, participation level, transportation, and supervision throughout the event.

By registering a minor, the parent/legal guardian represents that they have the legal authority to provide consent on behalf of that minor.

### 7. GROUP SAFETY

MDNT MILES™ promotes a **NO WOMAN LEFT BEHIND** community philosophy; however, participants remain responsible for exercising good judgment and communicating when they need assistance.

Participants are expected to:

* Stay aware of their surroundings
* Follow the designated route and event instructions
* Remain with the group when instructed
* Communicate if they become separated
* Respect event leaders, volunteers, and other participants
* Avoid reckless or dangerous behavior
* Respect pedestrians, cyclists, drivers, residents, and businesses
* Follow all applicable laws

MDNT MILES™ may modify, delay, relocate, or cancel an event due to weather, safety concerns, location conditions, emergencies, or other circumstances.

### 8. PERSONAL PROPERTY

I understand that I am responsible for my personal belongings.

MDNT MILES™, its organizers, volunteers, leaders, sponsors, and affiliates are not responsible for lost, stolen, or damaged personal property.

### 9. RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, I release and hold harmless MDNT MILES™, Midnight Miles, its owners, organizers, event leaders, volunteers, representatives, sponsors, affiliates, and participating partners from claims arising from my participation in an MDNT MILES™ event, including claims relating to personal injury, property damage, illness, or other loss, **except to the extent caused by conduct that cannot legally be released under applicable law.**

I understand that this waiver is intended to be interpreted as broadly as legally permitted.

### 10. CONDUCT & COMMUNITY EXPECTATIONS

MDNT MILES™ is intended to be a positive, inclusive, encouraging, and judgment-free community.

Participants agree to:

Participants are expected to speak positively, respect others, avoid harassment or intimidation, and refrain from behavior that creates an unsafe environment.

MDNT MILES™ reserves the right to remove a participant from an event when, in the reasonable judgment of event organizers, the participant's conduct presents a safety concern or violates event rules.

### 11. WEATHER & ENVIRONMENTAL CONDITIONS

I understand that MDNT MILES™ may take place outdoors and that conditions may change quickly.

I accept responsibility for dressing appropriately and determining whether I am personally comfortable participating under the conditions present.

MDNT MILES™ may cancel, postpone, relocate, or modify an event when organizers determine that conditions create an unreasonable safety concern.

### 12. PHOTOGRAPHY & VIDEO

I understand that MDNT MILES™ events may be photographed, recorded, or otherwise documented.

Unless I opt out through an available event-specific process, I understand that my image or likeness may appear in photographs, videos, social media content, promotional materials, or other documentation related to MDNT MILES™.

I understand that I may be asked to notify event organizers if I do not wish to be photographed or recorded.

### 13. SPIRITUAL & COMMUNITY ACTIVITIES

MDNT MILES™ may begin or include prayer, scripture, encouragement, worship music, positive affirmations, or other faith-based community activities.

Participation in these activities is voluntary.

### 14. ACKNOWLEDGMENT

By checking the acknowledgment box during registration, I confirm that:
