Motion Circle Event Waiver and Release of Liability
By registering for and attending this Motion Circle event, I acknowledge and agree to the following:
1. Health & Fitness Confirmation
I confirm that I am in good physical and mental health, have no medical condition that would make participation unsafe, and am adequately trained and prepared for the types of activities offered by Motion Circle, including but not limited to running, yoga, sports, exercise, and wellness events. I understand it is my responsibility to consult with a medical professional prior to participation if I have any concerns.
2. Assumption of Risk
I understand that participating in Motion Circle activities carries inherent risks, including but not limited to physical injury, illness, permanent disability, paralysis, and death. These risks may result from my own actions or inactions, the actions or inactions of others, the conditions of the event, or the negligence of Motion Circle LLC and its representatives. I voluntarily and knowingly assume all such risks, both foreseen and unforeseen, and accept full responsibility for any resulting injury, illness, damage, loss, or death.
3. Release of Liability
In consideration of being allowed to participate in Motion Circle activities, I, on behalf of myself, my heirs, executors, administrators, assigns, and personal representatives, irrevocably release, waive, and discharge Motion Circle LLC, its founders, organizers, team members, employees, volunteers, collaborators, and event partners from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, damage, loss, or death that may occur during or as a result of my participation, whether caused by ordinary negligence or otherwise, to the fullest extent permitted by Florida law.
4. Indemnification
I agree to indemnify and hold harmless Motion Circle LLC and its representatives from any loss, liability, damage, or cost they may incur due to my participation in the event, including but not limited to claims arising from my own actions, negligence, or intentional conduct.
5. Medical Consent
In the event of injury or illness, I authorize Motion Circle to secure medical treatment for me as deemed necessary. I accept full financial responsibility for any and all medical expenses incurred.
6. Photo & Video Release
I grant Motion Circle full permission to capture, use, reproduce, and distribute photos, videos, or other media of me taken during the event for promotional, advertising, or marketing purposes, without compensation and without any right to approval.
7. Personal Belongings
I understand that Motion Circle is not responsible for any personal items lost, stolen, or damaged during the event.
8. Governing Law
This agreement shall be governed by and interpreted under the laws of the State of Florida, with exclusive jurisdiction in Miami-Dade County.
9. Acknowledgment of Understanding
I have carefully read and fully understand this waiver. I acknowledge that I am giving up substantial legal rights, including the right to sue for damages in the event of injury, illness, or death. I confirm that I am agreeing to this document freely, voluntarily, and with the intent to be bound by its terms to the fullest extent permitted by law.
