RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER OF CLAIMS
1. Physical Activity Risks
 I understand that Move to the Beat is a high-intensity interval training (HIIT) class involving strength, cardio, and rhythm-based exercises. I affirm that I am in good physical condition and able to participate in this class. I understand that participation carries inherent risks, including but not limited to sprains, muscle strains, broken bones, heat exhaustion, or other potential injuries.
2. Voluntary Participation
 I voluntarily choose to participate in this activity and assume all risks, known or unknown, related to my participation.
3. Medical Disclaimer
 This fitness class is not a substitute for medical attention, examination, diagnosis, or treatment. If I experience any pain or discomfort, I will listen to my body, adjust the movement, and inform the instructor. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in this class.
4. Photo & Video Release
 I grant permission to Move to the Beat and Wear the Damn Shorts, LLC to use photos, videos, or recordings taken during the class for marketing, promotional, or social media purposes, unless I opt out in writing prior to the event.
5. Release of Liability
 I hereby release and hold harmless the instructors, event partners, affiliates, and Wear the Damn Shorts, LLC from any liability, injury, loss, or damage sustained while participating in the class, including any claims arising from negligence.

In executing this Waiver/Release of Liability/Hold-Harmless
Agreement (hereinafter referred to as the Waiver) I acknowledge
the facts set forth herein and agree to all terms and conditions
contained herein. I acknowledge that EXTRA MILE CARE - Sports
Recovery Center is a facility that conducts hands-on; Assisted
Stretching Techniques, Compression Boots, Percussion,
Cupping, and Scrapping Therapy. I hereby consent to EXTRA
MILE CARE (EMC) agents/employees providing me with hands
on; Assisted Stretching Techniques, Compression Boots,
Percussion, Cupping, Scrapping Therapy, and Cold Plunge
guidance.
I agree that EMC has adequately explained the techniques that
are going to be used in the Assisted Stretching Techniques,
Compression Boots, Percussion, Cupping, Scrapping, and Cold
Plunge Therapy that will be performed upon me and I consent to
the same. I have had an opportunity to ask questions and have
been fully informed of all risks associated with the activities that
are to be performed upon me as a result of the Assisted
Stretching Techniques, Compression Boots, Percussion,
Cupping, and Scrapping Therapy, and, given same, I have agreed
to move forward with the techniques and any/all additional
activities with EXTRA MILE CARE (EMC).

I acknowledge that this Waiver is meant to protect the owner,
operator and location (individually, jointly and collectively), as
more specifically set forth herein, from any and all claims,
demands, causes of action of whatever kind or nature, arising
out of all known and unknown, foreseen and unforeseen acts,
injuries or damages, by any and all persons taking part in any
and all activities/stretches being conducted by EXTRA MILE
CARE, and any/all of their agents, employees, owners, officers,
directors, managers, members, associates, affiliates, sponsors,
etc. (collectively referred to throughout this Waiver as EXTRA
MILE CARE).
I, the undersigned participant, by signing my signature as set
forth below, do hereby acknowledge that the activities in which I
intend to engage and have engaged with EXTRA MILE CARE
involve an element of inherent risk of injury to myself. I
acknowledge that the Assisted Stretching Techniques,
Compression Boots, Percussion, Cupping, and Scrapping
Therapy that may occur to me may be a test of my physical
limits and carries with it the potential for bodily injury, strains,
sprains, muscle pulls, bruises, contusions, etc. I hereby assume
all of the risks of participating in the activities being offered
and therapy techniques performed by EXTRA MILE CARE (EMC)
and its staff, said risks being known and/or unknown to me.

I certify that I am physically fit, have sufficiently trained and
prepared for participation in these activities and have not been
advised otherwise by a qualified medical person. I hereby
consent to receive medical treatment which may be deemed
advisable in the event of injury, accident and/or illness during
my activities with EXTRA MILE CARE (EMC), I understand that all
medical and/or emergency evacuation costs for myself will be
borne by me or my heirs.
EXTRA MILE CARE (EMC), as defined herein, is in no way liable or
responsible for any medical costs that I may incur. As a material
inducement for myself taking part in this event with EXTRA MILE
CARE (EMC), and/or any and all activities put on by EXTRA MILE
CARE (EMC), I agree to indemnify, defend and hold harmless
EXTRA MILE CARE (EMC) by agreeing, for myself, my executors,
administrators, heirs, next of kin, successors, and assigns to take
the following actions:
A — Waive, Release and Discharge from any and all liability for
my death, disability, personal injury, property damage, property
theft or actions of any kind (including negligence) which may
here after accurate me during any event/activity contemplated
herein, the following entities or persons: EXTRA MILE CARE -
Sports Recovery Center and each and all of their agents,
employees, owners, officers, directors, managers, members,
associates, affiliates, sponsors, representatives, etc.

B — Indemnify and Hold Harmless the entities o persons
mentioned in this paragraph from any and all liabilities or claims
made by other individuals or entities as a result of any actions I
undertake with EXTRA MILE CARE (EMC) - including but not
limited to Assisted Stretching, Compression Boots, Percussion
Cupping, and/or Scrapping Therapy.
C — To not sue EXTRA MILE CARE (EMC) for any claim for
damages or injuries arising or growing out of my participation in
any activities with EXTRA MILE CARE (EMC).
I acknowledge that this Accident Waiver and Release of Liability
form will govern my actions and responsibilities at said events. I
understand that it shall be construed broadly to provide a
release and waiver to the maximum extent permissible under
applicable law. I hereby certify that I have read this Accident
Waiver and Release of Liability and I understand its content. It is
further understood and agreed that this waiver, release and
assumption of risk is to be binding on my heirs and assigns. I
have read, understand and agree to abide by the rules of the
event.
