I understand that the event involves inherently dangerous activities, including but not limited to:
    •    Alcohol consumption
    •    Crowded social environments
    •    Loud music and reduced awareness
    •    Slippery surfaces
    •    Docks, vessels, marinas, water adjacency
    •    Uneven terrain, stairs, decks, and outdoor conditions
    •    Third-party behavior
    •    Transportation before and after the event

I voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, even if arising from negligence.

2. ALCOHOL ACKNOWLEDGMENT & ALTERNATIVE OPTION

I acknowledge:
    •    Alcohol is optional
    •    Alcohol is available only to designated pass holders
    •    Non-alcoholic social passes are available
    •    I chose freely whether or not to consume alcohol

I affirm that I am 21 years of age or older and understand that I alone control my alcohol intake.

3. EXPRESS RELEASE OF NEGLIGENCE (CRITICAL CLAUSE)

To the maximum extent permitted by Florida law, I expressly release and waive any and all claims against The Club Palm Beach LLC and all related parties for ordinary negligence, including but not limited to:
    •    Alcohol service or refusal of service
    •    Alleged overservice or underservice
    •    Failure to supervise, monitor, or intervene
    •    Premises conditions
    •    Security decisions
    •    Actions or omissions of staff, bartenders, vendors, or contractors

4. DRAM SHOP & INTOXICATION DISCLAIMER

I acknowledge that:
    •    The Company does not encourage intoxication
    •    I am solely responsible for my behavior
    •    I waive any claim related to intoxication, impairment, or judgment

I agree that no representation has been made regarding alcohol strength, quantity, or effects.

5. THIRD-PARTY & BYSTANDER CLAIM WAIVER

I release the Company from any claim brought by a third party that arises directly or indirectly from my actions, conduct, or alcohol consumption, including but not limited to injury, assault, property damage, or transportation incidents.

6. INDEMNIFICATION & DEFENSE OBLIGATION

I agree to indemnify, defend, and hold harmless The Club Palm Beach LLC from any and all claims, lawsuits, damages, fines, penalties, costs, and attorney’s fees arising from:
    •    My conduct
    •    My alcohol consumption
    •    Any injury or damage I cause
    •    Any violation of law

This duty survives the event.

7. MARITIME, DOCK & WATERFRONT DISCLAIMER

I acknowledge heightened risk related to vessels, docks, marinas, and water, including drowning and serious injury. I release the Company from any maritime-related claims, whether occurring on land or water.

8. NO DUTY TO CARE, MONITOR, OR RESCUE

I acknowledge that the Company has no duty to:
    •    Monitor intoxication
    •    Prevent injury
    •    Provide medical care
    •    Arrange transportation

I waive any claim based on alleged failure to act.

9. REMOVAL WITHOUT REFUND

I understand the Company may remove any guest for any reason, including perceived intoxication or safety concerns, without refund, and that removal does not create liability.

10. MEDICAL & HEALTH WAIVER

I certify I am physically and mentally able to attend. I assume all medical risks, including those aggravated by alcohol, dehydration, or exertion.

11. MEDIA & LIKENESS RELEASE

I grant the Company perpetual rights to my image, likeness, and voice without compensation.

12. CLASS ACTION WAIVER

I agree that any claim must be brought individually, and I waive the right to participate in any class or collective action against the Company.

13. SEVERABILITY & SURVIVAL

If any provision is found unenforceable, the remainder remains in full force. All releases and indemnities survive the event.

14. GOVERNING LAW & VENUE

This Agreement is governed exclusively by Florida law, with venue in Palm Beach County, Florida.
