Comprehensive Participation Waiver & Release of Liability
Including Waterloo Pickleball & Urban Pickleball – Barton

1. Definitions & Scope

This Waiver applies to all programs, events, tournaments, leagues, clinics, socials, offsite gatherings, and activities (collectively, the “Activities”) organized, hosted, sponsored, or associated with Capital City Pickleball LLC, Waterloo Pickleball, Urban Pickleball – Barton, their affiliates, owners, officers, directors, employees, contractors, hosts, representatives, volunteers, sponsors, vendors, and partners (the “Released Parties”).

2. Acknowledgment & Assumption of Risks

I understand that participation in the Activities involves inherent and unforeseen risks, including but not limited to:

Slips, trips, collisions, or falls

Being hit by a paddle, ball, or equipment

Sprains, strains, fractures, concussions, head/spinal injuries

Heat exhaustion, dehydration, or overexertion

Outdoor hazards (weather, insects, uneven surfaces, lighting conditions)

Food or beverage consumption, including alcohol or allergens

Property damage, theft, or loss

Travel to and from Activities (personal vehicles, carpools, ride shares)

Serious injury, illness, paralysis, or death

I voluntarily assume all such risks, whether known or unknown, including those caused by negligence of the Released Parties.

3. Release & Waiver of Liability

For myself and my heirs, executors, administrators, assigns, and representatives, I waive, release, discharge, and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from my participation in the Activities, including but not limited to:

Negligence of the Released Parties

Premises liability (onsite or offsite)

Use or misuse of facilities, property, or equipment (personal or rented)

Alcohol or food consumption before, during, or after Activities

Conduct of other participants, spectators, or third parties

4. Medical Fitness & Emergency Treatment

I certify that I am in good physical and mental condition to safely participate. I consent to receive emergency medical treatment if deemed advisable, and I release the Released Parties from liability for any medical decisions, treatment, or lack thereof. I am solely responsible for related costs.

5. Conduct, Alcohol, & Facility Rules

I agree to comply with all rules of the Released Parties and venues, including but not limited to:

No unsafe, aggressive, or disruptive conduct

No unauthorized use of courts or facilities

Minors under 14 must be supervised at all times

Alcohol may only be consumed if lawfully provided or permitted by the event. If I choose to consume, I accept full responsibility for my actions, conduct, and safety.

The Released Parties are not responsible for transportation, conduct, or safety before, during, or after Activities, including pre- or post-event gatherings.

I accept liability for any damage I cause to facilities, property, or equipment.

6. Equipment Responsibility

I acknowledge that the use of personal or provided equipment (paddles, nets, balls, rental gear) carries inherent risks. I assume full responsibility for the condition, use, and safety of such equipment and release the Released Parties from liability relating to it.

7. Minors & Guardianship

If registering a participant under 18, I certify that I am their parent/legal guardian with authority to bind them to this Agreement. I accept full responsibility for the Minor’s safety, conduct, and supervision, unless otherwise explicitly permitted by organizers.

8. Media Release

I grant the Released Parties irrevocable rights to use my name, image, likeness, and/or voice in photographs, video, audio, or other media captured during Activities, for promotional, commercial, or educational purposes in any format or channel, without compensation.

9. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, suits, damages, liabilities, judgments, or expenses (including attorneys’ fees) arising out of:

My participation in the Activities

My consumption of food, beverages, or alcohol

My violation of rules or this Agreement

Claims brought by third parties due to my conduct

10. Sponsors, Vendors, & Partners

I acknowledge that sponsors, vendors, and partners may be present at Activities. Their involvement does not create liability on their part. I release them from any and all claims relating to my participation, including consumption of their products or services.

11. Lost, Stolen, or Damaged Property

I agree the Released Parties are not responsible for personal property that is lost, stolen, or damaged before, during, or after Activities.

12. Communicable Diseases

I understand there are risks of exposure to communicable diseases (including COVID-19). I voluntarily assume all risks related to such exposure and release the Released Parties from any related claims.

13. Weather & Acts of Nature

I understand that outdoor Activities may be affected by weather or natural conditions (heat, rain, wind, insects, air quality). I assume all risks related to such conditions and waive claims for cancellations, delays, or impacts caused by weather or acts of nature.

14. Governing Law & Venue

This Agreement is governed by the laws of the State of Texas. Any legal action shall be brought exclusively in the courts of Travis County, Texas, to which I consent.

15. Dispute Resolution (Optional)

In the event of a dispute, I agree to attempt resolution through mediation or binding arbitration before pursuing litigation.

16. Severability

If any part of this Agreement is found unenforceable, the remaining provisions remain in effect.

17. Entire Agreement & Acknowledgment

This Agreement constitutes the entire understanding between the parties and supersedes prior representations. I certify that I have read this Agreement, understand its terms, and sign it voluntarily with full knowledge of its significance.
