1. ASSUMPTION OF RISK & VOLUNTARY PARTICIPATION

I understand that participation in wellness, fitness, and celebration activities organized by Traynor & Co., LLC (“Company”), including but not limited to yoga, Pilates, mini massages, facials, hydration and nourishment bars, and related services, involves inherent risks, including minor or serious injury, illness, allergic reactions, or property damage. I voluntarily choose to participate and assume full responsibility for any risk of loss, injury, or damage that may occur as a result of my participation.


2. ACKNOWLEDGMENT OF INDEPENDENT VENDORS

I acknowledge that certain services and activities during the event are provided by independent vendors and not by Traynor & Co., LLC. These vendors include, but are not limited to, food, beverage, spa, wellness, and entertainment providers. Each vendor is solely responsible for its own conduct, licensing, and safety. I agree that Traynor & Co. is not responsible for the actions, omissions, negligence, or performance of any vendor or its employees or contractors.


3. MEDICAL DISCLOSURE & FITNESS TO PARTICIPATE

I certify that I am physically fit to participate in the activities offered and have not been advised otherwise by a qualified medical professional. I have disclosed any relevant allergies, medical conditions, or injuries to Traynor & Co. or the event organizer. I understand that it is my responsibility to consult with a physician prior to participation and that participation is voluntary.


4. RELEASE OF LIABILITY & INDEMNIFICATION

In consideration of being allowed to participate in the event, I hereby release, waive, discharge, and hold harmless Traynor & Co., LLC, its owners, members, employees, agents, contractors, and vendors from any and all claims, demands, damages, liabilities, losses, or expenses (including attorney’s fees) arising from or related to my participation. This includes, but is not limited to, claims for bodily injury, illness, property damage, or negligence (except gross negligence or willful misconduct).


5. PHOTO/VIDEO CONSENT & RELEASE (FLA. STAT. §540.08)

I grant Traynor & Co., LLC and its designees’ permission to photograph, record, and use images, video, or audio of me for marketing, promotional, and social media purposes, without further consent or compensation. I waive any right to inspect or approve such materials and release Traynor & Co. from any claims arising out of their use, including claims under Florida’s right of publicity statute (§540.08), invasion of privacy, or defamation. I understand these materials may be used in print, digital, or online formats.


6. GOVERNING LAW & DISPUTE RESOLUTION

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising under or relating to this Waiver shall be resolved by binding arbitration under the Florida Arbitration Code (Chapter 682) with venue in Orange County, Florida. The prevailing party shall be entitled to reasonable attorney’s fees and costs. Both parties waive the right to a jury trial.


7. PARENT/GUARDIAN CONSENT FOR MINORS

If the participant is under 18 years of age, I, the parent or legal guardian of the minor named above, consent to the minor’s participation and agree to all terms of this Waiver on their behalf. I further grant permission for emergency medical treatment to be administered if deemed necessary. I understand and agree that I am releasing all claims both on my own behalf and on behalf of the minor.


8. ACKNOWLEDGMENT & UNDERSTANDING

I have read this Participant Consent & Liability Waiver in its entirety and fully understand its contents. I am signing it voluntarily and understand that by signing I am giving up certain legal rights. This release shall be binding upon me, my heirs, executors, and assigns.

This Agreement may be signed electronically. Electronic signatures will have the same legal effect as handwritten signatures under Florida and federal law.
