  * Please **bring your own yoga mat** for the pilates portion
  * **Rackets** will be provided by Bay Padel
  * **Please note that session participation will be on a first come, first serve basis.**

By creating an account, booking a court, or participating in activities at Bay Padel, you acknowledge that you have read, understood, and agreed to this document in full. If you have any questions, please contact our customer service team before proceeding.


1. Assumption of Risk and Waiver of Liability
1.1 Acknowledgment of Risk

By booking a court at Bay Padel, you acknowledge that padel and pickleball, as well as other activities available at the facility—including but not limited to ping pong, cornhole, pool table, and bouncy house—carry inherent risks. These risks include but are not limited to slips, falls, collisions, and equipment-related injuries. You voluntarily assume these risks and release Bay Padel from liability.

1.2 Release of Liability

You agree to release, hold harmless, and discharge Bay Padel, LLC, its owners, affiliates, employees, agents, and partners ("Releasees") from any claims, liabilities, or damages arising out of:

Use of any court, equipment, or facilities.
Participation in matches, tournaments, clinics, lessons, or events.
Accidents, injuries, or losses caused by the negligence of Bay Padel or others.
This waiver includes claims related to facility maintenance, instruction, or supervision, except in cases of gross negligence or intentional misconduct as prohibited by law.

If the participant is a minor (under 18 years of age), their parent or legal guardian acknowledges these risks on their behalf and accepts full responsibility for their participation. The parent or legal guardian agrees to all terms of this waiver and releases Bay Padel from any liability related to the minor’s participation.



2. Publicity Consent and Rights
2.1 Use of Name, Image, and Likeness

By creating an account or participating in Bay Padel activities, you grant Bay Padel permission to use your name, image, and likeness for promotional purposes. This includes use in marketing materials, social media posts, advertisements, and other media formats directly related to Bay Padel.

2.2 Opt-Out Option

If you do not consent to publicity use, you may opt out by contacting our customer service team at info@baypadel.us.

2.3 Fair Use

Bay Padel will not sell or transfer your personal information to third parties unrelated to the operation or promotion of the club.


3. Facility Rules and Safety
3.1 Adherence to Rules

You agree to follow all safety guidelines and rules posted at Bay Padel facilities. Failure to comply may result in termination of your reservation and access privileges.

3.2 Reporting Hazards

If you observe any safety hazards, please notify a staff member immediately.


4. Legal Jurisdiction and Dispute Resolution
4.1 Governing Law

This agreement is governed by the laws of the state where the facility is located.

4.2 Dispute Resolution

Any disputes arising out of this agreement must be resolved in the state or federal courts nearest to the Bay Padel facility where the incident occurred.

5.Dog Policy

Any dogs brought onto Bay Padel property must remain on a leash at all times. Owners are solely responsible for the behavior and control of their dogs and must comply with this policy to ensure the safety and comfort of all patrons. Bay Padel reserves the right to ask patrons to remove any dog that poses a safety concern or disrupts the facility environment.

6. General Terms
6.1 Indemnification

You agree to indemnify and hold Bay Padel harmless from any claims, damages, or expenses resulting from your use of the facilities or violation of this agreement.

6.2 Modification of Terms

Bay Padel reserves the right to update this agreement at any time. Please review it periodically for changes.

6.3 Acknowledgment of Understanding

By signing this waiver or proceeding with your reservation, you acknowledge that you have read, understood, and agree to the terms outlined in this document.

I ACKNOWLEDGE THAT I AM SIGNING THIS WAIVER FREELY AND VOLUNTARILY AND THAT IT AFFECTS MY LEGAL RIGHTS. I INTEND THIS WAIVER TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
