This Comprehensive Liability Waiver, Release of Claims, Assumption of Risk, and Gifted Product Acknowledgment Agreement (“Agreement”) is entered into by the registered participant (“Participant”) in favor of Callie Federow, Center, Elmhurst Art Museum, the owner or operator of the event premises, and their respective owners, officers, trustees, directors, employees, contractors, instructors, volunteers, sponsors, gifting partners, affiliates, insurers, successors, and assigns (collectively, the “Released Parties”).

This Agreement applies to Participant's attendance at or participation in indoor Pilates classes and related check-in, warm-up, exercise, cool-down, social gatherings, distribution of complimentary products, and other event activities organized or instructed by Callie Federow and Center at Elmhurst Art Museum in Elmhurst, Illinois, including the monthly Pilates event series beginning in October 2026 (collectively, the “Activities”).

This Agreement applies to each event for which Participant registers and accepts this Agreement through the registration platform.

Participant agrees to provide accurate registration information and comply with all applicable event requirements.

2. ASSUMPTION OF RISK
Participant understands that Pilates and other physical activities involve inherent risks, including but not limited to:

Muscle soreness, strains, sprains, joint or back injuries, dizziness, overexertion, or other physical injury;

Slips, trips, or falls involving exercise mats, equipment, flooring, or surrounding objects;

Accidental contact with other participants, instructors, or objects within the event space;

Aggravation of existing injuries, illnesses, or medical conditions;

Participant understands that they may request modifications, take breaks, or discontinue participation at any time.

3. RELEASE AND WAIVER OF LIABILITY
TO THE FULLEST EXTENT PERMITTED UNDER ILLINOIS LAW, PARTICIPANT KNOWINGLY, VOLUNTARILY, AND EXPRESSLY RELEASES, WAIVES, AND FOREVER DISCHARGES THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO PARTICIPANT'S ATTENDANCE AT OR PARTICIPATION IN THE ACTIVITIES.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER LOSS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, INCLUDING NEGLIGENT INSTRUCTION, SUPERVISION, EVENT OPERATION, EQUIPMENT HANDLING, PRODUCT DISTRIBUTION, OR MAINTENANCE OR CONDITION OF THE PREMISES.

Participant understands that this provision means Participant is giving up the right to bring claims covered by this Agreement, including claims alleging ordinary negligence by a Released Party.

Nothing in this Agreement is intended to waive or release claims arising from willful and wanton misconduct or any liability that cannot legally be waived under Illinois law.

4. MEDICAL FITNESS AND PARTICIPANT RESPONSIBILITY
