We’re bringing the cold plunge experience! If you’re taking the plunge, bring an extra towel and change of clothes. We won’t be providing towels, so come prepared to dry off and refresh.

PILATES IN THE CLUB – WAIVER & RELEASE OF LIABILITY

(November 20, 2025 – Club Afër Houston, TX)

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration of being permitted to attend and participate in Pilates in the Club – Afro House Edition on November 20, 2025 (the “Event”) hosted at Club Afër in Houston, Texas. By purchasing a ticket, registering, or entering the premises, the Participant agrees to the following:

1. Assumption of Risk

• I acknowledge that participating in Pilates, fitness classes, and related activities involves strenuous physical movement and inherent risks, including but not limited to: muscle strains, sprains, fractures, fainting, dehydration, abnormal blood pressure, heart disorders, dizziness, or other injuries.
• I understand and accept all risks associated with participation and acknowledge that Pilates in the Club, Club Afër, instructors, DJs, vendors, contractors, and affiliates are not responsible for any injury, illness, or medical condition that may occur.

2. Venue, Environment & Drones

• I understand this Event takes place in a nightclub environment with flashing and strobe lights, amplified music, fog or atmospheric effects, and limited visibility.
• I acknowledge that drones will be operated during the Event for videography and photography. I understand there is a small risk of accidental contact and agree that Pilates in the Club, Club Afër, drone operators, and affiliates are not liable for any injury or inconvenience caused by drone use.
• I understand that other attendees may take independent photos or videos, which Pilates in the Club cannot control or restrict.

3. Photography, Videography & Publicity Release

• I grant full permission to Pilates in the Club, Club Afër, and their affiliates to record, photograph, and capture video or audio footage (including drone footage) during the Event.
• I authorize the use of my likeness in all promotional, marketing, or commercial materials without compensation or restriction.
• I waive any right to inspect or approve such materials and release all claims related to their use in any format or medium.

4. Age, Alcohol & Personal Responsibility
• Alcohol will be served to 21+ guests only with valid ID. By consuming alcohol, I accept full responsibility for my actions and any resulting consequences.
• Pilates in the Club, Club Afër, and affiliates are not responsible for any incident, injury, or legal issue resulting from alcohol consumption.

5. Attendance, Punctuality & Refund Policy

• I understand that it is my responsibility to arrive early to allow time for parking and check-in.
• If I arrive late, miss my class, or fail to bring a mat, I forfeit my ticket.
• All sales are final. There are absolutely no refunds, transfers, or credits for any reason, including late arrivals, missed classes, scheduling conflicts, dissatisfaction, illness, or weather-related issues.

6. Equipment & Sanitation

• I agree to bring my own exercise mat; mats are not provided.
• I acknowledge that shoes are not permitted on the main floor for sanitary reasons.
• I understand that while the venue is cleaned before each event, the organizers cannot guarantee an allergen-free or germ-free environment.

7. Food, Beverage & Vendors

• Food and beverage vendors may be present. I consume all items at my own risk.
• Pilates in the Club and Club Afër are not responsible for allergic reactions, foodborne illness, or any other adverse effects resulting from consumption.

8. Parking & Transportation

• Parking options include valet, street parking, or the lot off Fannin Street, used at my own discretion and risk.
• Pilates in the Club and Club Afër are not responsible for theft, damage, towing, or vehicle-related incidents.
• If I consume alcohol, I am solely responsible for arranging safe transportation.

9. Drones, Lighting & Media Notice

• I understand that drone and handheld filming may take place overhead or near participants.
• I agree to remain aware of my surroundings and exercise caution when drones or cameras are in use.
• I release Pilates in the Club, Club Afër, and all affiliated media contractors from any claims arising from the operation of drones or other filming equipment.

10. COVID-19 & Communicable Diseases

• I acknowledge the risk of exposure to COVID-19 and other communicable diseases by attending the Event.
• I release Pilates in the Club, Club Afër, and affiliates from any claims or liabilities related to illness or complications arising from attendance.

11. Release of Liability & Indemnification

• I release, waive, and discharge Pilates in the Club, Club Afër, instructors (including Maria Posa), DJ Eddie Oliver, vendors, contractors, employees, and affiliates from all claims, demands, actions, or causes of action arising out of or related to my participation, whether caused by negligence or otherwise.
• I agree to indemnify and hold harmless the above parties from any third-party claims or damages resulting from my conduct.

12. Acknowledgment of Understanding

• I have read and fully understand this Waiver and Release of Liability.
• I acknowledge that it is legally binding and intended to protect Pilates in the Club, Club Afër, and affiliates in every aspect of the Event.
• By purchasing a ticket and attending, I voluntarily agree to all terms and conditions, including the no-refund policy and full personal responsibility for my participation.
